HomeMy WebLinkAboutResolutions - 2010.10.21 - 10273October 6, 2210 MISCELLANEOUS RE01,UTIGN#1 0 260 BY: PUBLIC SERVICES COMMITTEE, JIM RUNESTAD, VICE-CHAIRPERSON IN RE: SHERIFF'S OFFICE -AMENDMENT #1 FOR POLICE DISPATCH SERVICE FOR OAKLAND COMMUNITY COLLEGE FOR 2007-2012 TO TEE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS it is the policy of the Oakland County Board of Commissioners to permit the Sheriff's Office to enter into contractual agreements for the purpose of E'oLiee Dispatch services; and crEERFAS at too request of Oakland Community College the Sheriff's 01f1ce has been dispatching police calls for Oakland Community College bolice; and WHEREAS Miscellaneous Resolution 1+07077 authorized a police aisoafcn contract for the years 2207-2012 between the County and Oakland Community College; and WHEREAS Oakland Community College has requested that the Sheriff's Office 70 perform additional services 70 include the entry of warrants into the li Enforcement Information Network (7_,EIN); and WHEREAS Corporation Counsel has reviewed this amendment and Is in agreement with the attached amendment; and WHEREAS the Sheriff's Office along with the Department of Management /a Budget is recommending the attached amendment for dispatching and warrant entry services at the proposed rates of $8,704.99 per month for November 1, 2110 through March 31, 2011 and $9,417.16 per month for April 1, 2011 to March 31, 2012 between the County of Oakland and Oakland Community College. HOW THEREFORE BE IT RESOLVED that the Oakland County Board of Ec,r-m-is,sioners authorizes the Chairperson of the Board to enter into the attached Police Dispatch Amendment with Oakland Community College. Cnairperson, on behalf of the Public Services Committee, E move the adoption of the foregoing resolution. PUBLIC SERVICES COMMITTEE Public Services Committee Vote: Motion carried unanimously on a roll call vote with Middleton absent The monthly sum of: $6,847.50 $7,444.83 $8,306.67 $8,538.33 $8,704.99 $9,417.16 2007 -2012 POLICE DISPATCII'SERVICE AGREEMENT BETWEEN THE COUNTY OF OAKLAND AND OAKLAND COMMUNITY COLLEGE AMENDMENT 1 Pursuant to paragraph 25 of the 2007-2010 Police Dispatch Service Agreement between the County of Oakland and Oakland Community College, the Parties hereby agree to amend said contract by replacing paragraph 2.1 and paragraph 11 of the Agreement with the following paragraph 2.1 and paragraph 11: 2.1 "POLICE DISPATCH SERVICE(S)" shall be defined to include: any emergency or non-emergency telephone call or notice, of any kind, received by the 0.C.S.D., which either requests, requires, or in the sole judgment of the O.C.S.D. or designated COUNTY AGENTY(S), appears to request or require the presence, attention, or services of any O.C.C. POLICE PERSONNEL to address, respond, or attend to any issue, event, or circumstance involving public safety, breach of peace, public health, an accident or accidental injury, the protection of property, any emergency (including, but not limited to criminal, medical, fire, health, civil disputes, and/or civil infractions), which results in any O.C.S.D. or designated COUNTY AGENT(S) radio communication, or any attempted radio communication to any 0.C.C. POLICE PERSONNEL. Said services shall also include the entry of warrants into the Law Enforcement Information Network (LEIN) at the request of OCC POLICE PERSONNEL, the storage by 0.C.S.D. of said warrants after entry into LEIN, the updating of information stored in LEIN upon timely notification by O.C.C. POLICE PERSONELL of any changes to the status or continued validity of a warrant entered into LEIN, and the confirmation, when requested, of the existence and continued validity of said warrants upon request by authorized law enforcement officers and agents. 11. In consideration of the COUNTY'S promises and efforts under this Agreement, 0.C.C, shall pay the COUNTY as follows: For the period of: April, 2007 through March 31, 2008 April 1, 2008 through March 31, 2009 April 1,2009 through March 31, 2010 April 1, 2010 through October 31, 2010 November 1, 2010 through March 31, 2011 April 1,2011 through March 31, 2012 2007 -2012 POLICE DISPATCH SERVICE AGREEMENT BETWEEN THE COUNTY OF OAKLAND AND OAKLAND COMMUNITY COLLEGE AMENDMENT 1 Pagel of 2 09/15/10 All other contactual provisions Of thy 7007-2012 Police Dispatch Service Agreement between the County of Oaldand and Oakland Community College not otherwise affected by this Amendment shall remain in full force and effect. FOR AND IN CONSIDERATION of the mutual assurances, promises, acknowledgements, set forth in this Amendment 1 to the 2007-2012 Police Dispatch Service Agreement Between the County of Oakland and Oakland County Community College ("Amendment") and for other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the undersigned hereby execute this Amendment on behalf of the Parties, and by doing so legally obligate and bind the Parties to the terms and conditions of this Amendment. IN WITNESS WHEREOF, Clarence E. Brantley, Vice-Chancellor, Administrative Services, hereby acknowledges that he has been authorized by a resolution of the Oakland Community College Board of Trustees to execute this Amendment on behalf of Oakland Community College and hereby accepts and binds the Oakland Community College to the terms and conditions of this Amendment. OAKLAND COMMUNITY COLLEGE Dated: Clarence E. Brantley, Vice-Chancellor, Administrative Services IN WITNESS WHEREOF, Bill Bullard, Jr., Chairperson, Oakland County Board of Commissioners, hereby acknowledges that he has been authorized by a resolution of the Oaldand County Board of Commissioners, to execute this Amendment on behalf of Oakland County and hereby accepts and binds Oakland County to the terms and conditions of this Amendment. FISCAL NOTE (MISC. #10260) October 21, 2010 BY: Finance Committee, Tom Middleton, Chairperson IN RE: SHERIFF'S OFFICE — AMENDMENT #1 FOR POLICE DISPATCH SERVICE FOR OAKLAND COMMUNITY COLLEGE FOR 2007 -2012 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced resolution and finds: 1. The Oakland Community College (OCC) has requested to amend their contract with the Oakland County Sheriffs Office to add warrant data entry service into the Law Enforcement Information Network (LEIN) system in addition to providing contracted police dispatch services. 2. A contract agreement with the Sheriffs Office for police dispatch services is in effect for the years 2007 — 2012; this resolution proposes to amend this contract for the Sheriff's Office to perform data entry services for the OCC police for seventeen (17) months, commencing on November 1, 2010 through March 31, 2012. 3. This resolution adds warrant data entry services at the proposed rates of $8,704.99 per month for November 1,2010 through March 31, 2011 and $9,417.16 per month for April 1,2011 to March 31, 2012. 4. The contract rates established for the calendar year period of November 1, 2010 through December 31, 2010 total annual revenue and cost of $17,409.98, for the calendar year period of January 1, 2011 through December 31, 2011 total annual revenue and cost of $110,869.41, and for the calendar year period of January 1, 2012 through December 31, 2012 total annual revenue and cost of $113,005.92, and for the calendar year period of January 1,2013 through September 30, 2013 total annual revenue and cost of $84,754.44. 5. Budget amendments based on fiscal years commencing on October 1 st and ending September 30th are $100,027.91 for FY 2011 (representing 11 months from November 1 st through September 30 th), $113,005.92 for FY 2012 (12 months), and $113,005.92 for FY 2013 (12 months). 6. The total authorized billing amount covering the contract period of November 1, 2010 through March 31, 2012 is $156,530.87. 7.
