MISCELLANEOUS RESOLUTION 8813
BY: FINANCE COMMITTEE, DENNIS MURPHY, CHAIRPERSON
IN RE: ADDITIONAL LEGAL FEES ON THE KEITH LESTER CASE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS by Miscellaneous Resolutions #8023 and 8179, the Sheriff was
authorized to spend up to $11,500 to challenge a court order reinstating
an employee discharged for proper cause; and
WHEREAS it was necessary to retain outside legal counsel for more time
than was provided by Miscellaneous Resolutions #8023 and 8179; and
WHEREAS the additional expense amounted to $1,501.70; and
WHEREAS outside counsel was successful in challenging the court order;
and
WHEREAS attorneys for Keith Lester have filed a second case against
the County and the Sheriff; and
WHEREAS Civil Counsel because of the complexities of the case involved
and the familiarity of outside counsel with this case, believes it is in
the best interest of the County to continue employment of outside counsel;
and
WHEREAS an additional expense of up to $7,500 will be incurred in
defending the second case.
NOW THEREFORE BE IT RESOLVED $9,001.70 be transferred from the Contingent
Fund to the Sheriff Department's Administration Professional Services line-
item to cover the additional legal expenses associated with the Keith Lester
case.
The Finance Committee, by Dennis Murphy, Chairperson, moves the adoption
of the foregoing resolution.
