William Caddell, County Commissioner - District #25 RE: SENATE BILL 858 (SUPPORT) PROHIBITION OF POSSESSION, USE, DELIVERY, MANUFACTURE, SALE AND ADVERTISING OF DRUG PARAPHERNALIA TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Senate Bill 858, a bill to amend the Michigan Public Health.Code, to include the prohibition of possession, use, delivery, manufacture, or sale of controlled substances and drug paraphernalia and the advertising for sale of drug Paraphernalia, was introduced to the Michigan Senate on September 9, 1986 and has been referred to the Committee on Judiciary; and WHEREAS, enactment of this bill will punish violators with imprisonment for not more than 90 days or a fine of not more than $5,000 or both, and the punishment increases to imprisonment for not more than one year or a fine of not more than $7,500 or both for a person of more than 18 years of age who delivers drug paraphernalia to a person of less than 18 years of age; and WHEREAS, a statewide, uniform approach to prohibiting the proliferation of drug paraphernalia is the most sensible approach for enforcement of this type of law and prevents the possibility of pushing drug traffic from one neighborhood to the next. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners does hereby go on record as supporting SB 858 and does hereby urgently request that the State Senate take immediate action to hasten the passage of SB 858. BE IT FURTHER RESOLVED that certified copies of this resolution be sent to the members of the Senate Committee on Judiciary, to all of the Legislators representing Oakland County and to the County's Legislative Agent.
