WILLIAM CADDELL, CHAIRPERSON IN RE: SHERIFF'S DEPARTMENT - INMATE
CLASSIFICATION GRANT CONTRACTORS INDEMNIFICATION
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr . Chairperson, Ladies and Gentlemen
:
WHEREAS the Inmate Classification Grant authorized by the Board of
Commissioners on Miscellaneous Resolution No. 86215 provided that independent
contractors would be retained to work in this program; and
WHEREAS the Sheriff's Department is presently in the process of negotiating
contracts with individuals to carry out the provisions of Miscellaneous Resolution
No. 86215; and
WHEREAS it was not intended that such individuals would be required to provide
their own overhead items such as office space, equipment, insurance coverage , etc
.; and
WHEREAS it is incumbent upon the County of Oakland to provide the Inmate
Classification individual contracted staff with liability insurance and for
indemnification while acting within the scope of their contracted responsibilities.
NOW THEREFORE BE IT RESOLVED that the Inmate Classification contracted personnel
in this grant shall be included in the indemnification provisions of Miscellaneous
Resolution No. 85339 and No. 86124 previously adopted by the Oakland County Board of
Commissioners.
Mr. Chairperson, on behalf of the Finance Committee, I move the adoption of the
foregoing resolution.
FINANCE COMMITTEE
PROFESSIONAL SERVICES CONTRACT
I
THIS AGREEMENT, made this day of September, 1986, between the COUNTY OF
OAKLAND, a Michigan Constitutional Corporation, hereinafter referred to as "
County" and
WITNESSETH
For and in consideration of the mutual covenants and agreements herein
contained, it is agreed between the parties that the County shall retain
as an independent contractor, pursuant to Miscellaneous Resolution
86215, as adopted on August, 1986 with the parties agreeing to the following terms
and conditions:
The duties of shall be:
1. To interview inmates in the Oakland County Jail who require processing through
the Inmate Classification Program for the purpose Or determining initial housing
placement and program referral while in Oakland County Jail or any Satellite.
2. To verify information obtained through these interviews immediately through
inquiry into computer management information system available.
3. To initiate emergency and routine referrals for those individuals who require
immediate services or who wish services
4 To docoment any and all communications with inmates, inmates' family members, or
other agents' communications which relate to the classification, housing or
treatment within the Oakland County Jail or the Corrective Services System
5. To participate in required training and educational programs which shall be
scheduled.
6 To review inmate roster data and to initiate classification review for all
maximum security inmates every 30 days and to initiate reclassification of other
inmates as directed by Project Supervisor.
7 To perform other tasks and- duties related to Inmate Classification as assigned
by the Program Supervisor.
8. To refrain from engaging in any activity or enterprise as assuming any
employment which may conflict with the duties as outlined in this agreement
The duties of the County shall be:
1. To compensate at an hourly rate of for no
more than 30 and not less than 15 hours every week. Payment shall be made on a
bi-weekly basis for services rendered beginning September, 1986.
2 . To indemnify, defend and hold harmless from any liability,
suits or damages which may arise from his/her performance pursuant to the terms of
this contract
3 The County reserves the right to terminate this contract when
breaches any of the terms and conditions, or
upon termination of this contract as described below.
IT IS MUTUALLY AGREED
1. That the relationship of and the County is and shall continue to
be that of an independent contractor and no liability or benefits such as, but
not limited to Workers' Compensation
benefits, retirement and pension benefits, insurance benefits, or such other
rights or liabilities arising out of an employer/employee relationship shall
arise to either party as a result of this contract .
2 . This contract shall be considered effective as of
3 . This contract shall terminate under the following conditions:
(a) On June 30, 1987 or when funding for the Inmate Classification
Program is expended and is not replenished by the State of Michigan or
the Oakland County Board of Commissioners; or
(b) The County terminates this contract because
of breach of one of its terms or conditions by
( c ) withdraws his/her services from
the County.
4. This contract may be extended for a period not to exceed six ( 6 )
months .
