Hobart, Chairperson RE: DEPARTMENT OF TRANSPORTATION, STATE OF MICHIGAN, EXCESS PROPERTY IN OXFORD TOWNSHIP (CORPORATION COUNSEL - PROPERTY MANAGEMENT DIVISIONJ TO: OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the Department of Transportation, State of Michigan, owns excess property (Control 63112 - Parcels 65S and C-65-S-1) in the Township of Oxford described as: That part of the West Half of Section 4, T5N, RlOE, Oxford Township, Oakland County, Michigan, described as: Commencing at the Southwest corner of said Section 4; thence North 88 33' 07" East, along the South line of said Section 4, a distance of 1554.35 feet; thence North 51 40' 11" West, 258.91 feet; thence North 26 33' 23" West, 1364.00 feet to the point of beginning, said point being a point on the Easterly limited access right of way line, restricting all ingress and egress, of Highway M-24; thence continuing North 26 33' 23" West, along said limited access right of way line, 1313.40 feet; thence North 01 01' 10" West, 208.61 feet; thence North 89 09' 19" East, 1027.82 feet to the Westerly line of the former Penn Central Railroad right of way; thence South 07 34' 38 East, along said Westerly line, 1116.41 feet; thence South 63 26' 37" West, 652.91 feet to the point of beginning. No representations or warranties are made to fluid mineral and gas rights by the Michigan Department of Transportation. There shall be no right of direct ingress or egress from Highway M-24 and Thomas Road to and from and between the lands herein described. Contains 25.69 acres, more or less. WHEREAS the Department of Transportation has determined that the aforedescribed property is excess to highway needs; and WHEREAS the Department of Transportation property procedure provides that local governmental units be given a chance to indicate their interest in the purchase of the property at current market value prior to offering the property for sale to the general public; and WHEREAS your Planning and Building Department has reviewed the described property and finds no County need. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners not respond to the Department of Transportation's correspondence whereby failure to respond will be taken as an indication that the County of Oakland is not interested in the purchase of said property.
