RE: Corporation Counsel - Real Estate Section - EASEMENT FOR
WATERMAIN TO THE CITY OF AUBURN HILLS FOR ANIMAL CARE AND
TRUSTY CAMP FACILITY
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, the County of Oakland is the owner of
property located at 1700 Brown Road in the City of Auburn Hills,
Michigan, known as the Animal Care Shelter and Trusty Camp; and
WHEREAS, pursuant to Miscellaneous Resolution #86185,
an 8 inch watermain is to be constructed for the Animal Care
Shelter and Trusty Camp; and
WHEREAS, a permanent easement is required by the City
of Auburn Hills prior to accepting the operation and maintenance
of said watermain; and
WHEREAS, Gerald Mitchell, P.E., Design Engineer of
Facilities Engineering, recommends the County of Oakland grant
this easement to the City of Auburn Hills.
NOW THEREFORE BE IT RESOLVED that the Oakland County
Board of Commissioners approve the conveyance of this easement
to the City of Auburn Hills.
BE IT FURTHER RESOLVED that the Oakland County Board
of Commissioners directs its Chairperson to execute said
easement.
Mr. Chairperson, on behalf of the Planning and Building
Committee, I move the adoption of the foregoing resolution.

EASEMENT
KNOW ALL MEN BY THESE PRESENTS, That the
County of Oakland, a Michigan Constitutional Corporation, whose
address is 1200 North Telegraph Road, Pontiac, Michigan 48053,
(County), for and in consideration of the sum
of One Dollar ($1.00 ) paid to it by the City of
Auburn Hills, a Michigan Municipal Corporation, whose address is
1827 N. Squirrel Road, Auburn Hills, Michigan 48057, (City),
does hereby grant to the City the right to construct, operate,
maintain, repair and/or replace a water supply system across and
through the following described land:
To wit: Land situated in the City of Auburn Hills,
Oakland County, Michigan, and being more particularly
described as being a parcel of land being described as
the N 1/2 of the NW 1/4 of Section 3, T3N, R1 0E, City
of Auburn Hills, excepting therefrom a parcel of land
described as beginning at a point distant north
1,494.00 ft along the 1/4 section line from the center
of said Sect ion 3, thence continuing north along said
1/4 line a distance of 559.50 ft„ thence N 83 degrees,
33'55" W 1000.20 ft, thence S 00 degrees, 31'20" W
670.20 ft, thence S 89 degrees _ 57'10" E 1000.00 ft to
the point of beginning, and also excepting therefrom a
parcel described as beg inning at a point distant S 87
degrees, 24 1 55" W, 1307.77 ft, and sr 00 degrees 2437"
E 60.04 ft from the NW 1/4 corner, thence S 00 degrees
24'37" E 765.35 ft, thence N 87 degrees 24'55" E 347.80
ft. thence S 86 degrees 19 1 55 7T, E 939.82 ft, thence N
02 degrees 46'00" W 867.16 ft, thence S 87 degrees
24'55" W 1250.23 ft. to the point of beginning,
containing 52.60 acres, ±, and otherwise known as tax
sidwell No. 14-03-100-019 on the City of Auburn Hills
Tax Rolls.
The Permanent Easement is described as being 12.0 ft wide with a
centerline described as commencing at the N 1/4 corner of
Section 3, T3N, R10E, in the City of Auburn Hills, Michigan,
thence S 87 degrees 24'55" W 1407.22 ft along the north section
of Section 3 to the point of beginning; thence S 07 degrees
24'55" W 67.50 ft, thence S 02 degrees 51'05" E 1232.50 ft to
the point of ending.
As further condition of -granting this easement, the City agrees
to the following:
If the Water Supply System is abandoned or relinquished on this
easement area, then the easement shall be considered null and
void and shall "revert" to the County, its successors and
assigns.
The premises so disturbed by reason of the exercise_ of any of
the foregoing powers shall be -reasonably restored to its
original condition by the County.
This instrument shall be binding upon and inure to the benefit
of the part ies hereto, their heirs, representatives, successors,
and _assigns.
