WILLIAM CADDELL, CHAIRPERSON IN RE: FACILITIES ENGINEERING DIVISION - CONTRACT AWARD FOR BARRIER - FREE IMPROVEMENTS TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS by Miscellaneous Resolution #85374 the Board of Commissioners authorized the County Executive's Department of Central Services to receive bids for Barrier Free Improvements at an estimated cost of $60,000; and WHEREAS in accordance with bidding procedures, bids for the above mentioned were received and opened on October 16, 1986; and WHEREAS the County Executive's Department of Central Services has reviewed all bids submitted and recommends that the lowest responsible bidder, HMS Associates be awarded a contract for general building trades in the amount of $36,300; and WHEREAS additional costs are estimated to be $8,700; and WHEREAS the total cost of the above mentioned work is estimated to be $45,000 as detailed in the attached schedule; and WHEREAS funding for the above mentioned project is available in the 1986 Capital Improvement Program - Buildings Section. NOW THEREFORE BE IT RESOLVED as follows: 1) The contract proposal of HMS Associates of Walled Lake, Michigan, in the amount of $36,300 be accepted and the contract awarded in concurrence with Planning and Building Committee recommendations, 2) Funds be provided in the amount of $8,700 to cover the remaining project costs, 3) The Chairperson of the Board of Commissioners, is hereby authorized and directed to execute a contract with HMS Associates of Walled Lake, Michigan on behalf of the County of Oakland, 4) The County Executive's Department of Central Services, Facilities Engineering Division, shall notify the awardee of this award, in writing no later than 10 days after adoption of this resolution. The award shall not be effective until the awardee has been notified. Mr. Chairperson, on behalf of the Finance Committee, I move the adoption of the foregoing resolution. File PROJECT NO.. 85-33 CONTRACT NO.: 793 WORK ORDER NO.: C-201 CONTRACT THIS AGREEMENT, made this the 20th day of November, 1986, by and between the County of Oakland, a Michigan Constitutional Corporation, acting herein through its Board of Commissioners, hereinafter called the "OWNER" and HMS Associates, 1339 East Lake Drive, Walled Lake, Michigan, 48088, a partnership, hereinafter called the "CONTRACTOR." WITNESSETH, that the CONTRACTOR and the OWNER for the considerations hereinafter named agree as follows: The CONTRACTOR shall furnish all the materials, means of construction, and other accessories and perform all of the Work shown on the Drawings and described in the Specifications entitled: BARRIER-FREE IMPROVEMENTS VARIOUS OAKLAND COUNTY BUILDINGS COUNTY PROJECT 85-33 AS PREPARED BY: The Facilities Engineering Division of the Oakland County Executive's Department of Central Services, all in accordance with this Agreement, the General Conditions of the Contract, the Proposal, the Specifications, and the Drawings. The CONTRACTOR hereby agrees to commence Work under this Contract on or before receipt of the written notice to proceed, and shall fully complete the Work within Sixty (60) calendar days from the notice to proceed. The OWNER shall pay the CONTRACTOR for the performance of the Contract, subject to additions and deductions provided therein, as follows: Thirty-Six Thousand Three Hundred and 00/100 Dollars ($36,300.00) which price is the base bid. The OWNER shall process payments on account of the Contract as provided therein, as follows: On or about the fifth (5th) day of each month ninety (90) percent of the value, based on the Contract prices of labor and materials incorporated in the Work and of the materials suitably stored at the site thereof up to the last day of the previous month, less the aggregate of previous payments; and upon substantial completion of the entire Work, a sum sufficient to increase the total payments to ninety-five (95) percent of the Contract price. The OWNER may at any time after fifty (50) percent of the Work has been completed, if he finds that satisfactory progress is being made and with written consent of surety, approve any of the remaining partial payments for payment in full. Final payment shall be due thirty (30) days after completion of the Work provided the Contract is fully performed. Before final payment the CONTRACTOR - shall submit evidence satisfactory to the OWNER that all payrolls, material bills, and other indebtedness connected with the Work have been paid.
