In re: Children's Village - Legal Fees for Appeal of Declaratory Judgment
TO TUE OAKLAND COCNTY BOA1:D OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
-WHEREAS by Miscellaneous Resolution 1/83118 the Board of Commissioners
authorized the hiring of outside counsel to represent the board, the
county executive and the probate judges in a court action seeking
a declaratory designating the appropriate party te -
Childre's Village and Camp Oakland; and
WHEREAS such case was heard by the Circuit Court of the County
of Oakland and a declaratory judgment was issued by judge Gage; and
WHEREAS the Probate Court has upoeilel this decision and has
requested immediate consideration for a. stay of execution of the
Board of Commissioners action transferring control or Children's
Village and Camp Oakland to the count\ e:.e•atiye; and
:: if will be necessary for the parties to this action lo
be represented in the appeal Ly outside legal counsel.
NOW THEREFORE BE lT RE .-:o'\A that the I nd County Board of
Commissioners authorizes both the Prubate and the county Board. of
Commissioners, telcough its ellaiepikesen, to hire outside legal counsel
t o represen t them in this matter.
BE IT STRITER RESOLVED that the Oakland County Boaxd. of 'Commissioners
appropriate an amount not to exceed $10,000, $5,000 for each at
fro...! the 1983 co account, such funds to be transferred to the
le•cal, services Tine item in the appropriate deollental Ia!!•.: Is.
KR. CHAIRPERSON, on behalf of the Finance Committee, I move the
adoption of the foregoing resolution.
