Lanni, Chairperson IN RE: COMMUNITY DEVELOPMENT DIVISION - 1933 EMERGENCY JOBS B FUNDS RECAPTURE PROCESS & CRITERIA WHEREAS the County of Oakland by Miscellaneous Resolution 116961 of January 23, 1975 declared its intention to become designated as an Urban County under the Federal Housing and Community Development Act of 1974, as amended; and WHEREAS the County of Oakland by Miscellaneous Resolution 1183169 of June 23 and June 30, 1983 allocated a grant amount of $2,137,000 in Federal funds to 46 participating communities as a result of the "Emergency Jobs Appropriation Bill of 1983," Public Law 98-8; and WHEREAS these participating communities were advised that the intent of the legislation was to meet the objectives of the CDBG program, obligate and disburse funds as rapidly as possible, utilize funds to the extent practicable in high unemployment areas and utilize funds to maximize creation of new employment opportunities; and WHEREAS the U.S. Department of Housing and Urban Development has notified the County of Oakand That all Emergency Jobs Bill funds must be expended in accordance with the intent of Congress and by December 31, 1985; and WHEREAS, The Oakland County Community Development Advisory Council recommends approval of the agreement; and WHEREAS the Community Development Division's Jobs Bill Status Report as of December 31, 1984 for Part II, Special Activities indicates both the slow movement of some of these projects and the lack of current documentation evidencing the fulfillment of projected jobs associated with the project. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the Recapture Process and Criteria for the Part II Special Activity Funds in accordance with the attachment. Mr. Chairperson, on behalf of the Public Services Committee, I move the adoption of the foregoing resolution. PUBLIC: SERVICES COMMITTEE RECAPTURE PROCESS & CRITERIA FOR PART II: SPECIAL ACTIVITY FUNDS Special Activity Projects as of December 31,1984: Community Project Title Unexpended Funds $ Clawson, City Neighborhood Facility $ 24,100 Hunter School Commerce Township Street Improvement $ 79,300 Welch Road Extension Ferndale, City Beautification $ 75,000 Novi, City Economic Development $364,000 X-Way Ramp Oak Park, City Sewer and Water -0- Roosevelt School Walled Lake, City Parking Facility $ 97,000 Hazel Park, City Administration $ 14,800 Oxford Village Beautification $ 34,800 Oakland County Administration $ 700 PROCESS FOR REVIEW OF PROJECTS: Community Notification Staff will notify referenced communities in writing of: * The recapture process and criteria Required documentation needed to substantiate project proposals regarding short term and long term job creation, and necessary private sector commitments. Any documentation that you wish reviewed for adequacy should be submitted as soon as possible because no further documents will be received past the deadline. Effective Date This process and its criteria will be effective immediately on approval of the required resolution. * All requested documentation be received in the Community Development office by 5:00 p.m., March 1, 1985. Documentation Required 1. Proof of project implementation by March 1, 1985. * Examples of acceptable documentation: - signed contract documentation - purchase agreements - other funding source expenditures 2. Proof of project expenditure by deadline date of December 31, 1985: Examples of acceptable documentation: - project completion date commitment - outstanding billing submittals - performance Bond by Contractor regarding completion of project 3. Proof of Long term employment projections: Examples of acceptable documentation: - names, dates employed - projected date of employment availability, location, and type - private sector commitments and/or action 4. Proof of private sector commitment towards development of projected sources of employment. * Examples of acceptable documentation: - land purchase agreement - engineering firm contract for specific site development - financial commitment (loans, mortgages, etc.) - building proof of ownership Evaluation Staff will review documentation submitted by March 1, 1985, 5:00 p.m. and evaluate if required proofs have been met. Documentation will be measured against the following criteria to determine if a community's special activities funds will be recommended for recapture to the Board of Commissioners. Criteria for Recapture of Special Activity Funds: Special Activities Funds will be recommended for recapture if a community's documentation meets the following measures: - no response to documentation request notification letter late response, documentation received after deadline - documentation does not provide sufficient proof of: 1. projects contractual commitment by March 1, 1935 2. proposal's long term and short term job projections 3. proposal's private sector commitment towards the development of th projected sources of employment. Staff Recommendation Staff will recommend, based on evaluation of documentation, which communities fulfill the above recapture criteria. A resolution recommending which communities shall be subject to the recapture of their Special Activity Funds will be submitted to the Oakland County Board of Commissioners for their approval. CDII February 8, 1985 Dear : RE: Recapture Process and Criteria for Special Activity Jobs Bill Funds Reference my letter of November 19, 1984 requesting any new documentation you may have received or developed in support of your Jobs Bill Projects. The Public Services Committee of the Oakland County Board of Commissioners expressed its concern over the slow movement and lack of supporting documentation for some of these Special Activity Projects on our quarterly report ending December 31, 1984. Therefore, we have been directed to prepare and present a Jobs Bill Funds recapture process and criteria resolution at the next committee meeting on February 19, 1985. A draft copy of this resolution is attached for your information and appropriate action. The significant items to be considered are: - Slow movement of some Projects - The U.S. Department of Housing and Urban Development has informed us that these funds must be expended by December 31, 1985. - There is a lack of current documentation evidencing the fulfillment of projected jobs associated with the project. - That you are on notice of the recapture process and criteria for your projects. - All project supporting documentation must be submitted to our office by 5:00 p.m., March 1, 1985. - As previously notified, a meeting on this subject is scheduled for 1:30 p.m., February 11, 198.5 in Room 105 of the Oakland County Executive Building. This legislation required HUD and localities to move quickly to obligate and expend these funds for meaningful labor intensive CDEG activities. Many localities have proceeded expeditiously to complete their programs. However, a few localitis have etcount7Ired problems and still have substantial unspent funds. We would like to encourage these localities to review their program status, to reprogram if necessary-, and to complete all expenditures by September 30, 1985. Since Jobs Bill funds were a special appropriation requiring separate accounting records, the closeout of your Jobs Bill Program will require formal action by the locality and HUD. Upon completion of all activities, the program must be audited. Jobs Bill funds may be included in your regular audit as long as the funds are identified and tracked separately. Separate audits for Jobs Bill funds are encouraged where waiting for completion of the normal audit cycle would lead to extensive delay. A final Grantee Performance Report (6 copies) is also necessary along with three HUD Form 4011s Certificate of Completion with original signatures. Prior to our being able to proceed with the closeout, a complete and accurate final report EUD-7008, Special Quarterly Status Report must be submitted to us and our Central Office.
