IN RE: SUBMISSION OF CHANGES IN MERIT SYSTEM RULE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS Section IV, Subsection A. of the Merit System Resolution
requires that all changes in the rules and regulations of the Merit System
shall be submitted to the Board of Commissioners at a regular meeting of
the Board and shall become effective thirty (30) days after such meeting
unless objection is received in writing by the Chairperson of the Board of
Commissioners, in which case the objection shall become a matter of business
at the next meeting of the Board; and
WHEREAS it has become desirable to add a new subsection J to
Section III of Merit Rule 13 - Leave of Absence Without Pay - as spelled
out in the attachment to this resolution; and
WHEREAS your Personnel Committee has reviewed and approved these
changes at its meeting of March 20, 1985,
NOW THEREFORE BE IT RESOLVED that the reading of this notice and
the distribution of this notice and the attached document labeled "Proposed
Changes in the Merit System Rules" to all Commissioners present and absent
to be considered as the official submission to the Board of Commissioners
of the described changes in Merit Rule 13.
Mr. Chairperson, on behalf of the Personnel Committee, I move the
adoption, of the foregoing resolution.

ATTACHMENT A
REASON
During the 1985 budget review process the Health and Personnel Departments
explored various staffing alternatives to provide the Health Department and
others with the maximum staffing flexibility in order to meet required budget
reductions.
The Health Department felt they could meet some of their objectives through
voluntary leaves of absence without pay. However, they are hampered by re-
strictions in the Merit Rules. The time limits on current types of leaves
are insufficient and there are no provisions for administration initiated
leaves without pay. Further, the Health Department felt employees would
be reluctant to volunteer for leave without pay if they had to exhaust all
sick leave and annual leave accumulations, a pre-requisite for most catego-
ries of leave without pay under the current rule.
The Personnel Department is in the process of drafting major revisions to
Merit Rule 13 - Leaves of Absence Without Pay. However, these changes will
not be complete, including administrative reviews and informational reviews
with union groups, in time to meet the needs of the Health Department. With
the vacation season but a few weeks away, the Health Department feels it
can best achieve its staffing objectives through voluntary leaves during
the spring and summer months.
This proposed change would, if moved quickly, provide the flexibility re-
quested. The administrative leave without pay for budgetary or organiza-
tional purposes, although initiated by a department head, would not jeopar-
dize an employee's status in that it would require the designated employee's
signed agreement to the leave. In practice departments would most likely
solicit volunteers.
The administrative leave for unauthorized absence is merely formalizing past
practice. It, in effect, provides for docking an employee for time off work
for which the employee has not .followed Merit Rule provisions for leave
authorization. Merit Rules are clear that paid leaves (sick leave, annual
leave) are authorized by specific call-in or advance notice requirements.

Moved by McDonald supported by McPherson the resolution be adopted.
The Chairperson stated that pursuant to Merit System Rules the resolution
shall lay over for 30 days.
