IN RE: CORPORATION COUNSEL - REAL ESTATE SECTION - Agreement to Extend
and Modify Lease - 52nd District Court, 3rd Division
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS:
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS by Miscellaneous Resolution No. 9430, adopted by the Oakland
County Board of Commissioners at their meeting held on June 5, 1980, the
County of Oakland leased premises consisting of approximately 7079 square
feet of space in a building known end designated as 520 Pine in the City of
Rochester, Michigan for use by the 52nd District Court, 3rd Division; and
WHEREAS, the lease was for a period of five years beginning on
June 1, 1980 and ending on the 31st day of May, 1985;
WHEREAS, the District Court must be located within the city limits
of the largest city of the contiguous municipalities it serves; and
WHEREAS the County advertised for a facility to be located in the
City of Rochester Hills, Michigan; and
WHEREAS the Board of Commissioners, by Miscellaneous Resolution
No. 85062, adopted at their meeting of March 14, 1985, approved a lease for
the 52nd District Court, 3rd Division for a term of ten (10) years commencing
August 1, 1985, or as soon thereafter as the facility is ready for occupancy;
and
WHEREAS the County of Oakland desires at this time to enter into an
Agreement to Extend and Modify the Existing Lease on a month-to-month basis
beginning June 1, 1985 and ending July 31, 1985 at a rate of Eight Thousand,
Eight Hundred, Forty-Eight and 75/100 ($8848.75) Dollars per month, payable
in advance on the first day of each month.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners agree to lease Suites 7, 8, 9, 10, 11, 12, 6B and Suite 3 of
the Annex in the premises known as 530 Pine in the City of Rochester for the
3rd Division of the 52nd District Court at a rate of $8848.75 per month for
an area of approximately 7079 square feet on a month-to-month basis commencing
June 1, 1985 and ending on the 31st day of July, 1985.
BE IT FURTHER RESOLVED that the Chairperson of the Board of
Commissioners be and is hereby authorized to execute said Lease in accordance
with the terms of the Lease.

I move the adoption of the foregoing resolution.

BACKGROUND INFORMATION
52/3 Court
1. Present lease expires May 31, 1985
Rate of $6371.10 per month - $10.80 s/f ($76,453.20 year); County
pays its proportionate share of tax increases over the base year,
1979.
Rental rate includes janitorial and utilities. County pays as
additional rental any increase of utility costs in excess of
$1.31 s/f or $9,273.49 annually.
2. Month-to-month lease will be for the period commencing June 1,
1985 and ending July 31, 1985.
Rate of $8848.75 per month - $15.00 s/f plus all utilities.
Rental increase monthly of $2477.65.
New court facility lease/contract has been awarded., Lease to
commence August 1, 1985.

TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
Pursuant to Rule XI-C of this Board, the Finance Committee has reviewed
Miscellaneous Resolution #85142 and finds the sum of $7,870 (rent, $4,956;
utilities $2,914) necessary to fund the additional cost for 52nd District
Court, 3rd Division lease extension and modification for a two month period
beginning June 1, and ending July 31, 1985.
Further, the Board of Commissioners appropriates $7,870 from the 1985
Contingency Account and transfers said amount to the 1985 District Court,
Division III budget as follows:
