In re: House Bill 4367 (Support) Forgiving Counties of 10% Community
Placement Obligation TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr.
Chairperson, Ladies and Gentlemen: WHEREAS in 1977 the State
Department of Mental Health began establishing community placement homes
for mentally-impaired and developmentally-disabled residents with little
or no notification to county governing bodies, thereby prohibiting proper
consideration and inclusion in the county budget process; and WHEREAS
the State Department of Mental Health subsequently claimed that county
governments have a retroactive liability for the share of the costs of
these community placement services based on the matching funds requirement
of the Mental Health Code; and WHEREAS this claim of the state agency
is contrary to the provision of the Uniform Budget Act which prohibits
county govern ments from adopting deficit budgets and requires strict
adherence to the appropriations process; and WHEREAS House Bill 4367,
as originally introduced, presented a reasonable approach to the community
placement funding issue by forgiving counties of any financial liability
for community placement services prior to September 30, 1984; and WHEREAS
the House of Representatives has amended House Bill 4367, changing the
effective date of the relief of financial obligation to all services
provided prior to June 30, 1983. NOW THEREFORE BE IT RESOLVED that the
Oakland County Board of Commissioners continues its support of the concept
of House Bill 4367 as originally established in Miscellaneous Resolution
85122, dated April 19, 1985. BE IT FURTHER RESOLVED that the Board of
Commissioners requests the legislature to consider further amendment of
the effective date of liability forgiveness to include all service
provided prior to July 1, 1984, which is the first date Oakland County
received a detailed and auditable invoice for community placement
services. MR. CHAIRPERSON, on behalf of the General Government Committee,
