HomeMy WebLinkAboutResolutions - 1985.06.13 - 11148MISCELLANEOUS RESOLUTION NO. 85182 June 13, 1985 BY: PLANNING AND BUILDING COMMITTEE IN RE: DRAIN COMMISSIONER--LAKE IMPROVEMENT REVOLVING FUND TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS MR. CHAIRMAN, LADIES AND GENTLEMEN: WHEREAS, the Oakland County Board of Commissioners adopted Miscellaneous Resolution 9574 on September 18, 1980; and WHEREAS, the Inland Lake Improvement Act of 1966, Public Act 345 of 1966, in Section 6 of the Act, authorizes a County Board of Commissioners to provide for a revolving fund to pay for the preliminary costs of lake improvement projects within the County; and WHEREAS, the Oakland County Board of Commissioners, pursuant to Section 6 of Act 345 of the Public Acts of 1966, as amended, provided for the establishment of a Lake Improvement Revolving Fund and transferred the sum of $25,000.00 to pay for the preliminary costs of lake improvement projects; and WHEREAS, the Oakland County Board of Commissioners requires as a condition for the advance of any funds for the preliminary costs of lake improvement projects that the Lake Improvement Board desig- nate the Oakland County Treasurer as the custodian of all funds collected and disbursed by the Lake Improvement Board for lake improvement projects within the County; and WHEREAS, any advances from the Revolving Fund to pay for the preliminary costs of lake improvement projects shall be repaid by assessment against the property owners in the Assessment District by the Lake Improvement Board, and such assessment shall be made whether or not the project is finally implemented; and WHEREAS, no provisions of this resolution shall prevent a Lake Improvement Board from making repayment of advances by the Revolving Fund from gifts or grants received by the Lake Improvement Board pursuant to Section 25 of Act 345 of 1966; and WHEREAS, the number of active Lake Improvement Boards in Oakland County has increased and the number and scope of proposed lake improvement projects in Oakland County has increased; and WHEREAS, additional funds are needed to pay for the pre- liminary costs of lake improvement projects; and WHEREAS, lake improvement projects provide for the pro- tection of the public health, welfare and safety and the conser- vation of the natural resources of the state, or to preserve property values around a lake; and WHEREAS, the Oakland County Board of Commissioners desires to transfer the additional sum of $50,000.00 to the Lake Improvement Revolving Fund to provide a total of $75,000.00 to pay for the preliminary costs of lake improvement projects within Oakland County. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners directs the transfer of the sum of $50,000.00 to the Lake Improvement Revolving Fund to provide a total of $75,000.00 to pay for the preliminary costs of lake improvement projects within Oakland County. BE IT FURTHER RESOLVED that any resolutions or parts of resolutions that are in conflict with this resolution are hereby rescinded. WILLIAM CADDELL, CHAIRPERSON IN RE: DRAIN COMMISSIONER - LAKE IMPROVEMENT REVOLVING FUND TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: Pursuant to Rule XI-7C of this Board, the Finance Comittee has reviewed Miscellaneous Resolution # and finds: 1) The Oakland County Board of Commissioners per Miscellaneous #9574, September 18, 1980 directed the transfer of $25,000 to the Lake Improvement Revolying Fund as appropriated by Miscel- laneous Resolution #9444 and authorized by the Inland Lake Improvement Act of 1966, P.A. 345 of 1966, Section 6, 2) The Oakland County Board of Commissioners desires to transfer an additional sum of $50,000 to the Lake Improvement Revolving Fund for a total of $75,000 to pay the preliminary costs of lake improvement projects within Oakland County, 3) The Finance Committee finds $50,000 in the General Fund available for transfer to the Lake Improvement Fund and transfers said amount as follows: 1-10100-001-001 General Fund $(50,000) 1-10100-088-810 Lake Improvement 50,000 Revolving Fund $ -0- FINANCE COMMITTEE 13th day of 1985 A LEN #85182 June 13, 1985 Moved by Hobart supported by Richard Kuhn the resolution with Fiscal Note attached, be adopted.
