TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS:
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, the Oakland County Board of Commissioners by Miscellaneous
Resolution #8234 (November 18, 1982) authorized that medical control be
provided by the nine participating Oakland County hospitals and the Oakland
County Council for Emergency Medical Services (OAKEMS), consistent with the
Public Health Code; and
WHEREAS, on March 9, 1983, the Michigan Department of Public Health
approved the Oakland County Council for Emergency Medical Service as the
medical control authority for the Oakland County Emergency Medical Services
System responsible to assure medical accountability within the system through
the adoption of standards of care, and operating procedures; and
WHEREAS, quality assurance is a major goal of the Oakland County Council
for Emergency Medical Services, (Miscellaneous Resolution #84236, August 30,
1984); and
WHEREAS, the nine participating Oakland County hospitals have requested
the Oakland County Council for Emergency Medical Services to assist the
hospitals by conducting quality assurance activities through a partnership
between the hospitals and the County of Oakland and recommends to the Oakland
County Board of Commissioners to enter into the attached Quality Assurance
Confidentiality Agreement; and
WHEREAS, on January 17, 1985 the Oakland County Council for Emergency
Medical Services adopted the attached Quality Assurance program consistent
with the Bylaws and Public Health Code and recommends to the Oakland County
Board of Commissioners to authorize the attached Quality Assurance Program.

NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners authorizes the Oakland County Council for Emergency Medical
Services Quality Assurance Program consistent with the attached program
summary materials; and
BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners
amends the Oakland County Council for Emergency Medical Service Bylaws to
include the Quality Assurance Committee as a standing committee; and'
BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners
be authorized to execute the attached Quality Assurance Confidentiality
Agreement with the nine participating Oakland County hospitals; and
BE IT FURTHER RESOLVED that the following new classification and
corresponding 1985 salary ranges be established:

and to create one budgeted position as follows: EMS Quality Assurance
Coordinator.
BE IT FURTHER RESOLVED that written quarterly reports be presented at the
Public Services Committee by the Manager of the Emergency Medical Services and
Disaster Control Division and to the balance of the memebers of the Board of
Commissioners.

EXECUTIVE SUMMARY
EMS PROGRAM SUMMARY
Oakland County Board of Commissioners policy authorized, and the Michigan
Department of Public Health approved, OAKEMS as the medical control
authority for assuring medical accountability within the Oakland County
EMS System through the adoption of standards of care and operating
procedures, consistent with the Public Health Code.
The EMS and Disaster Control Division, in conjunction with OAKEMS, plans,
coordinates, monitors, and evaluates the EMS System, which consists of 9
nospitals, 32 life support agencies, 72 ambulances, 70 emergency
physicians, 900 emergency medical technicians, "0"COM, and other support
resources to deliver emergency medical care.
PROBLEM STATEMENT
An OAKEMS goal, as approved by the Board of Commissioners, is to provide
for quality assurance in the medical component of EMS. In addition,
Michigan Department of Public Health rules require OAKEMS, as a medical
control authority, to adopt quality assurance review procedures.
OAKEMS has, in the past, conducted one-shot quality reviews; however,
there is no EMS quality assurance program that continually reviews and
evaluates the quality of care rendered within the EMS System.
RECOMMENDED SOLUTION
After careful review and analysis over a two year period, the nine
participating Oakland County hospitals and OAKEMS (Attachment A)
recommends to the Board of Commissioners to conduct an OAKEMS Quality
Assurance Program (Attachment B) on an information and cost-share oasis
through a contractual partnership (Attachment C) between the hospitals and
the County.
Because of the broad scope and the massive amounts of information a
quality assurance program generates, a team effort is required between a
Quality Assurance Committee and a Quality Assurance Coordinator.
The OAKEMS Quality Assurance Committee, representing the nine hospitals,
would be responsible for the assurance of patient care quality, measures
of patient outcome, and monitoring medical report data elements. Each
hospital would provide an emergency department physician director and EMS
medical report information at an estimated cost of $30,720 (12 meetings x
3 hours per meeting x $80 per hour x 10 physicians, plus 2 hours extra
each meeting for chairman).
The EMS Quality Assurance Coordinator (Attachment D) would be responsible
for the day-to-day operations of the Quality Assurance Program. The
Coordinator assists the Committees to complete quality assurance studies
and reports, reviews quality assurance data, and prepares information for
the Committees review and action. The County would provide an EMS Quality
Assurance Coordinator at an estimated annual cost of $29,920 for salary
and fringes.
The recommended solution will improve the Oakland County EMS System
services by providing for a(n):
o continual review and evaluation to improve the quality of care.
o reduction of liability exposure.
o reduction and better control of EMS System costs.
o identification of continuing education needs.
o assurance of compliance with policies and standards.

OAKEMS QUALITY ASSURANCE PROGRAM
I. Definition of Quality in EMS
A. Health care provided in the pre-hospital emergency setting the
form of judgment or actions which produces outcomes which are
acceptable (preferably optimal) to the patient physically,
physiologically, phychologically, and socially.
Definition of Quality Assurance
A. A methodology which monitors and assures the planning,
implementation, and assessment of quality of health care.
Objectives of Quality Assurance
A. To improve patient care.
B. To reduce liability exposure.
C. To ensure compliance with policies and standards.
D. To improve documentation of care.
E. To make rational performance appraisals
F. To identify continuing education needs.
IV. Committee Responsibilities
A. Review and Audit Committee
1. Composed of interdisciplinary membership.
2. Responsible for monitoring system quality control.
a. To review compliance with criteria consistent with the
Quality Assurance program and to report to the Medical
Control Committee on a regular basis.

QUALITY ASSURANCE CONFIDENTIALITY AGREEMENT
This Agreement made and entered into this day of
, 1985, by and between the COUNTY OF OAKLAND, hereinafter
referred to as "COUNTY," and the nine Oakland County participating hospitals as identified
in Attachment A, hereinafter referred to as "HOSPITALS."
WHEREAS, by Michigan Department of Public Health approval, the Oakland
County Council for Emergency Medical Services (OAKEMS) is the Medical Control Authority
for the Oakland County Emergency Medical Services (EMS) System responsible to assure
medical accountability within the system through the promulgation of minimum standards of
medical care, protocols, and operating procedures; and
WHEREAS, the OAKEMS Bylaws requires the provision for quality assurance in
the medical component of emergency medical services through effective review and audit;
and
WHEREAS, OAKEMS, on January 17, 1985 approved the Quality Assurance
Committee Resolution (Attachment B).
WHEREAS, in order to maintain strict confidentiality of OAKEMS records and
information under MCLA 333.21515, MCLA 333.20202(2) (c) and MCLA 333.20175, while
performing the responsibilities of "Medical Control" as required by MCLA 333.20705(2), it is
necessary for the HOSPITALS to designate the Quality Assurance Committee of OAKEMS as
an entity responsible for collecting records, data and knowledge for individuals or
committees assigned professional review functions by each hospital pursuant to MCLA
333.20175(5) and 21515.
WHEREAS, it is also necessary for the COUNTY and the OAKEMS Quality
Assurance Committee to provide the records, data, and knowledge which it collects to the
professional review entity of each hospital.
NOW THEREFORE IT IS AGREED AS FOLLOWS:
A. The HOSPITALS designates the OAKEMS Quality Assurance Committee as a
committee assigned a "professional review function" according to MCLA 333.20175(5).
B. The COUNTY and HOSPITALS agree:
1. That the COUNTY, through the OAKEMS Quality Assurance Committee, will
provide each of the HOSPITALS the records, data or knowledge collected on
behalf of the HOSPITALS' professional review functions, or reports derived
therefrom, for the purpose of assisting those hospitals in improving the care
rendered to patients before and after a patient is admitted to the hospital and
for the purpose of reducing morbidity and mortality.

2. That all records, data and knowledge collected by the COUNTY and the
OAKEMS Quality Assurance Committee are collected for the purpose of
providing such records, data, and knowledge, or reports derived therefrom, to the
professional practice review entities established in each of the HOSPITALS. As
part of this process, each of the HOSPITALS assign to the COUNTY and the
OAKEMS Quality Assurance Committee the responsibility of collecting records,
data and knowledge as part of the HOSPITALS' ongoing professional review
program.
3. That the administration and management of the quality assurance records is to
be provided by the Oakland County Division of Emergency Medical Services and
Disaster Control in accordance with COUNTY policies.
4. That all records, data, reports and knowledge developed and existing in either
printed form or in the COUNTY computer system or the files of the Oakland
County EMS and Disaster Control Division shall be clearly identified as being
confidential and further that any unauthorized access, acquisition, duplication,
and/or dissemination of same shall subject such individual(s) to disciplinary
provisions of COUNTY Merit System Rules.
5. That all of the aforementioned records, data, and reports shall be stored either
in the COUNTY computer system or the offices of the Oakland County EMS and
Disaster Control Division, and further, access, acquisition, duplication, and/or
dissemination of the reports generated by the quality assurance activities shall
be permitted only as authorized in writing by the OAKEMS Chairman of the
Quality Assurance Committee and with the concurrence of the Quality
Assurance Committee.
6. That the "OAKEMS EMS Medical Report" submitted to the COUNTY be
destroyed at the expiration of twelve (12) months from the date of the OAKEMS
EMS Medical Report.
7. To treat all records, data, and knowledge relating to the professional review
functions of quality assurance which are collected by the COUNTY and the
OAKEMS Quality Assurance Committee as confidential and will resist the
release of same and disclosure of any and all information related thereto to the
fullest extent permissible within the law and will conduct professional review
only in closed session.

S. That all records, data and knowledge relating to the professional review
functions of quality assurance which are collected for or by the OAKEMS Quality
Assurance Committee or for or by any of its personnel, employees, agents, or
designees shall be used only for professional review functions of quality
assurance by the professional review entity of each hospital. All records, data
and knowledge so collected shall be subject to MCLA g333.20175(5) and, as such,
shall not be public records and shall not be subject to court subpoena.
9. That all records, data, reports and knowledge derived from and/or developed as a
result of the application of OAKEMS Quality Assurance/Audit Program or
derived from and/or developed as a result of the adoption of the subject
Resolution are hereby deemed to be confidential and that the unauthorized
access, acquisition, duplication, and/or dissemination of such confidential
information shall subject such individual(s) to penalties up to and including
discharge from employment and/or all other available sanctions,
10. Each of the parties personnel, employees, agents, or designees who receive,
process, review, store, or otherwise have access to the records, data, reports,
and knowledge execute a written acknowledgement of confidentiality.
11. To fully indemnify and hold harmless the other signators hereto, their officers,
employees and contractors from all claims, demands, losses, obligations, costs,
expenses, liabilities, debts or damages resulting from its own acts or omissions
including the acts or omissions of their officers, employees and contractors in
the transmission and disclosure of information, except that Pontiac General
Hospital shall be bound by this provision only to the extent allowed by law.
12. By execution of this Agreement, the parties hereto do hereby acknowledge,
agree and intend this Agreement, by its terms and conditions shall be binding
upon, in whole and in part, OAKEMS Quality Assurance Committee and any and
all members thereof.
13. This agreement shall remain in full force and effect for a term of two years
from its effective date and shall be automatically renewed thereafter for terms
of one year each. Notice of termination shall be given in writing not less than
ninety (90) days prior to the expiration of any such term.
14. All parties thereto retain all rights, privileges, or duties entitled to them by law
which are not modified herein.

OAKEMS RESOLUTION
OAKLAND COUNTY COUNCIL FOR EMERGENCY MEDICAL SERVICES
QUALITY ASSURANCE COMMITTEE
WHEREAS, according to Michigan Statute "Medical Control"
is an Organization of Authority approved by the Department of
Public Health that is responsible to assure medical account-
ability within an Emergency Medical Services system through the
promulgation of minimum standards of medical care, protocol, and
operating procedures approved by the Department of Public Health;
administered by a licensed hospital or system of hospitals under
the direction of a licensed physician designated as Project Medi-
cal Director (PMD) by a licensed hospital or a system of licensed
hospitals (MCLA 333.20705 (2), and
WHEREAS, by miscellaneous Resolution 82347 the Oakland
County Board of Commissioners on November 4, 1982 determined that
"Medical Control be provided by the nine participating Oakland
County Hospitals and the Oakland County Council for Emergency
Medical Services...," and
WHEREAS, on November 18, 1982 OAKEMS unanimously adopted
a Resolution to Approve the "Medical Control Authority" as pre-
sented and as contained in three manuals: OAKEMS Organizational
and General Policies Manual (with supplements), Paramedic Stand-
ard Operating Procedures (SOP) Manual, and the "0" COM Communica-
tions Manual; and
WHEREAS, by letter dated March 9, 1983, the Department of
Public Health approved the OAKEMS Medical Control Authority, and
WHEREAS, in order for the nine participating hospitals
and OAKEMS to provide "Medical Control" as required by the Statute
the hospitals have requested that the OAKEMS Quality Assurance
Committee (comprised solely of licensed physicians) be employed as
a "Committee assigned a Professional Review Function" within the
meaning of MCLA 333,20175 (5), MCLA 333„2i513 (c)(d), and 333.21515
wherefore
RESOLVED THAT the request of the nine participating hos-
pitals that the OAKEMS Quality Assurance COMFIlitte% (comprised
solely of licensed physicians from the nine participating hospi-
tals) be employed as a "Committee assigned a Professional Review
Function for purposes of providing "Medical Control" under State
Statute, is hereby granted, and
FURTHER RESOLVED THAT each advanced and basic emergency
care service responding unit shall provide the Quality Assurance
Committee with all reports and information the Committee requests
for the purpose of fulfilling its responsibility as a "Committee
Assigned a Professional Review Function" for purposes of providing
"Medical Control," and
FURTHER RESOLVED THAT each advanced and basic emergency
care service responding unit that provides the Quality Assurance

A. DESCRIPTION
GENERAL SUMMARY
Under general supervision, conducts the development, implementation, and
coordination of design studies and evaluations on confidential EMS medical
data to assure the provision of quality emergency medical care. Provides the
OAKEMS Quality Assurance Committee, representing the nine participating
Oakland County hospitals, with assistance in data management, education, and
quality assurance review activities. Assists in the development and
implementation of a quality assurance plan containing policy and procedures to
conduct the OAKEMS Quality Assurance Program. Assists in the computerization
of collected data.

TYPICAL DUTIES AND RESPONSIBILITIES
Develops, implements, and maintains, in conjunction with the OAKEMS Quality
Assurance Committee, an EMS quality assurance plan and manual with appropriate
policies, procedures, and guidelines on quality assurance activities.
Performs the appropriate methodology needed to provide for the continual
review and evaluation of emergency medical health care rendered within the
emergency medical services system.
Coordinates, monitors and supervises the collection and maintains
confidential EMS medical data from participating agencies to ensure
appropriate confidentiality, and timely reviews and evaluations of the records.
Acts as a liaison with the Computer Services Department to develop and
implement a computerized EMS data evaluation management information system.
Presents, on a regular basis, reports and information developed from analyzed
data on emergency medical service system activities.
Assists the OAKEMS Quality Assurance Committee, and other appropriate
committees, in the identification of problems and determines an appropriate
course of action to solve those problems.
Provides assistance and training in quality assessment techniques to personnel
within the emergency medical services system.
Recommends to persons who conduct continuing education and training programs
areas that require additional training emphasis.
Recommends to the manager-EMS and Disaster Control policies, procedures, and
improvements on the emergency medical services system.
Submits quarterly and annual reports to the Manager-EMS and Disaster Control

Pursuant to Rule XI-C of this Board, the Finance Committee has reviewed
Miscellaneous Resolution #8519I and finds:
• 1) The EMS/Disaster Control Division requests authorization to conduct
an Oakland County Council for Emergency Medical Services (OAKEMS)
Quality Assurance Program through contractual partnership between
nine participating County hospitals and the County,
2) The proposed contract states each hospital will provide an emergency
department physician director, and medical report information for
evaluation purposes,
3) The County is requested to establish one (1) EMS Quality Assurance
• • . Coordinator position responsible for day-to-day operations of the
program, at a cost of $12,538 for the period August 1, through
December 31, 1985, and an estimated annual cost of $29,750 for
salary and fringe benefits, •
4) $12,538 is available in the 2985 Budget to fund one (1) EMS Quality
Assurance Coordinator position for the balance of 2985 (see attached
schedule), said funds to be transferred as follows:
