TO THE OAKLAND COUNTY BOARD OF CCISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, the County of Oakland is under a court order to reduce the inmate
population at the Oakland County Jail; and
WHEREAS, the inmate population continues to remain consistently above limits
authorized in the U.S. District Court consent agreement; and
WHEREAS, the Oakland County Board of Commissioners, Pursuant . to Miscellaneous
Resolution #82266, dated September 9, 1982, authorized funds to be expended for
housing of Oakland County jail inmates . at other facilities in order to reduce the -
County jail population; and
WHEREAS, the Offender Aid and Restoration MAW Prooram is an alternative,
residential treatment program located in Pontiac, Michigan that Provides counseling,
employment assistance and related rehabilitation programs to residents, as recommended
by the court and/or probation department on a referral basis; and
WHEREAS, OAR has proposed to contract with the County for a maximum of ten •(10)
adult male probationers at a rate of $35.00 per day; and
WHEREAS, the OAR program provides an. additionalalternatiw to reducing the Count.
jail inmate population in compliance with court order; and
WHEREAS, the proposed per diem rate is consistent with rates currently paid . to
house inmates in out-County facilities.
ORE BE IT RESOLVED that the Chairman of the Oakland County Board of
Corradssioners is hereby authorized to enter into a contract (attached Ekhibit A) with
the Offender Aid and Restoration Program, 210 North . Perry, Pontiac, Michigan 48058 1
for a maximum of ten (10) adult males at $35.00 per diem, said funds currently
available in the Sheriff's Department 1985 Budget - Ouside Prisoner Housing line item.

AID AND RESTORATION (OAR) PROGRAM ALTERNATIVE TO JAIL FACEMENT -
MISCFLTANEOUS RESOLUTION #85193
TO THE OAKIAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
Pursuant to Rule XI-C of the Board, the FinanceComittee has reviewed Miscellaneous
Resolution #85193 and finds that:
1) $63,700 will be necessary to fund this program for the period July 1, 1985 through
December 31,1985,
2) Said funds are not available in the Sheriff's Department 1985 Budget-Outside Prisoner
Housing Tine-item,
3) Further, the Board of Commissioners appropriates $63,700 from Contingency to the
Sheriff's Department Budget as follows:

This agreement is made and entered into by and between the County of Oakland and the
Offender Aid and Restoration Program/Oakland County, 210 North Perry, Pontiac, MI 48058.
Sec. 1 - Authority
This contract is entered into under direction and approval by the
Oakland County Board of Commissioners for community alternative placement-beds for the
purpose of jail diversion.
Sec. 2 - Amount of Funding
The County of Oakland shall pay $35.00 per diem (room, board and
program) per client to a maximum of 10 adult male probationers averaged over monthly
billing period.
Sec. 3 - Method of Payment
Payments will be made on a reimbursement basis. For payment purposes,
a client day is defined as starting with the first date of program admission and
continuing through the last day of program enrollment. In the event of unplanned
absences, such as hospitalization, AWOL, or escape from the program, per diem payments
will be suspended the day following the client's absence from the program.
OAR shall invoice the Department as of the 15th and last day of the
month or for an entire month as the last calendar day of the month.
OAR agrees to make available for inspection by the County financial
records and reports related to this program.
OAR shall provide liability insurance in an amount not less than
$500,000 and the County shall be a named insured on the contract.
Sec. 4 - Financial and Accounting Procedures
OAR shall comply with generally accepted accounting and financial
procednres.

Sec. 5 - Services by OAR
The OAR agrees:
a. To rake available for inspection by the County, all records
pertaining to the resident.
b. To allow free access to the physical facilities to authorized
representatives of the court and designated representatives of
the County.
c. To maintain a facility to be utilized as a probation residential
center.
d. To provide 24-hour, seven-day-a-week, security coverage by
program staff of the facility, including evening room checks.
e. To immediately notify the designated liaison from the County
whenever a resident absents him/herself from the program without
authorization, or whenever the OAR's staff become aware of a
client's arrest or violation of his/her order of probation.
f. To provide progress summaries for each client on a quarterly
basis and at termination from the program. A copy of the
progress report shall be sent to the liaison agent of the County.
To provide counseling, programs for rehabilitation and assistance
to residents as recommended by the court and/or probation depart-
ment by in-house staff or on a referral basis.
Sec. 6 - County agrees:
a. TO appoint a probation agent (s) to act as liaison with OAR. The
liaison agent(s) will execute their role by direct interaction
with the facility program director or his/her designee. The
liaison agent(s) is responsible for referrals, initiating action
for program violation(s) by residents, as well as terminations
and extensions.

b. To encourage the courts to include as a condition of probation
for each resident referred to the facility the following
conditions:
You must remain in residence at (specify
name and location of facility) and comply
with program rules until approved for
release by the probation department.
c. To share with OAR records and related information which is
typically and routinely available to the probation agents.
Sec. 7 - Cancellation Clause
This agreement shall become effective immediately and continue in
effect until December 30, 1986 unless either party elects to terminate this agreement.
Such termination may be accomplished at any time through written notification of such
intent to the other party at least 30 days in advance of proposed termination date.
