Hobart, Chairperson RE: CORPORATION COUNSEL, REAL ESTATE SECTION - EASEMENT FOR STORM WATER DRAINAGE TO THE CITY OF NOVI TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the County of Oakland is the owner of a parcel of property in the City of Novi described as: The Southerly 300 feet of the easterly 400 feet of the W 1/2 of the E 1/2 of the NE 1/4 of the NW 1/4 of Section 35, T1N, R8E, City of Novi, Oakland County, Michigan, otherwise known as Tax Sidwell No. 22-35-176-006; and WHEREAS said parcel is utilized by the County as the Oakland County Department of Public Works Sanitary Sewer Retention Tank Area for the Huron- Rouge Sewage Disposal System - Novi Extension No. 1; and WHEREAS the City of Novi has requested an Easement across said parcel for the purpose of constructing and maintaining off-site storm water drainage for the proposed Novi Industrial Subdivision; and WHEREAS Donald W. Ringler, Manager of the Sewer, Water and Solid Waste Division of the Department of Public Works, recommends the granting of the Easement described as: The southerly 20.00 feet of the westerly 300.00 feet of the above-described parcel. NOW THEREFORE BE IT RESOLVED that the Board of Commissioners approves the granting of a permanent Easement to the City of Novi for the purpose of con- structing and maintaining an off-site storm water drainage system for the proposed Novi Industrial Subdivision. BE IT FURTHER RESOLVED that the Board of Commissioners directs its Chairperson to execute said Easement. Telegraph, Pontiac, Michigan 48053, hereinafter called the Grantor, for and in consideration of ($1.00) One Dollar, received from the City of Novi, a Michigan Municipal Corporation, hereinafter called the City, whose address is 45225 West ,48050, does. easement to ths City of Novi for the purpose of constructing, 7:crating, maintaining, repairing and/or replacing a drainage .ditch across and through the following described land situated in the City of Novi, -"!- a Oakla County, Michigan, to wit: The southerly 300 feet of the easterly 400 feet of the W 1/2 of the E 1/2 of the NE 1/4 of the NW 1/4 of Section 35, T1N, R8E, City of Novi, Oakland County, Michigan, otherwise known as Tax Sidwell No. 22-35-176-006 on the City of Novi Tax rolls. A permanent easement described as follows: The southerly 20.00 feet of the westerly 300.00 ,feet of the above-described parcel. As further consideration for the granting of this Easement, the City of Novi shall indemnify and save harmless, the Grantor, from and against any and all detriments, damages, losses, claims, demand suits, costs, or other expenses which the Grantor may suffer, sustain, or be subject to caused either wholly or in part, directly or indirectly, by reason of the use of the above premises pursuant to the rights granted herein.
