RE: RETENTION OF OUTSIDE COUNSEL FOR
INTERPRETATION OF OPEN MEETINGS ACT
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, on March 17, 1983, the Republican Caucus of the Oakland
County Board of Commissioners held a closed caucus; and
WHEREAS, the Prosecuting Attorney did rule on April 19, 1983
that there is an ambiguity in the Open Meetings Act, Act 297 of 1976, ,
as to the right of the Republican Caucus to hold a closed meeting; and
WHEREAS, the Attorney General on May 2, 1978 did rule (Opinion #5298)
that partisan caucuses of a county board of commissioners are "public bodies"
and are within the meaning of the Open Meetings Act; and
WHEREAS, good public policy and protection of the rights of the
minority require a definitive ruling.
NOW THEREFORE BE IT RESOLVED that the Beard of Commissioners
authorizes the retention of outside counsel selected by the aggrieved to seek
summary judgment on this issue with said counsel to be selected in ot dance
with the rules of this Board of Commissioners.
Mr. Chairperson, I move the adoption of the foregoing resolution.
