RE: OPPOSITION TO ANY NATIONAL CABLE TV LEGISLATIVE MEASURE
WHICH PREEMPTS THE REGULATORY AUTHORITY OF COUNTY
GOVERNMENT
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS:
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, cable television provides an excellent medium for
communications and is a significant innovation in the distribution of information
of local public interest; and
WHEREAS, cable television is transmitted through the use of coaxial
cable which makes use of local rights of way; and
WHEREAS, it is the responsibility of county government to carefully
control the placement of cable to protect the general public from harm; and
WHEREAS, franchising of cable television systems has traditionally
been a responsibility of local government and has been based on market
competition and negotiations between cable companies and local governments; and
WHEREAS, this negotiation process has made considerable progress in
ensuring adequate cable services for the consumer at affordable prices; and
WHEREAS, Congress is presently considering national telecommunication
legislation which greatly restricts the traditional authority counties and cities
have exercised as part of their regulatory responsibilities for the protection
of the public interest.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners opposes any national cable telecommunications legislative measure
which preempts county government's authority to exercise oversight and
regulation of local cable systems.
BE IT FURTHER RESOLVED that copies of this resolution be sent to
the Michigan Congressional Delegation.
Mr. Chairperson, on behalf of the General Government Committee, I
move the adoption of the foregoing resolution.

Moved by Olsen supported by Jackson the resolution be adopted.
Moved by Calandro supported by Susan Kuhn, the resolution be amended as
follows: The 3rd WHEREAS paragraph amended to read "WHEREAS it is the responsi-
bility of the County Government in conjunction with local governments, to carefully
control the placement of cable to protect the general public from harm; and"; and — the NOW THEREFORE BE IT RESOLVED paragraph be amended to read "NOW THEREFORE BE IT
RESOLVED that the Oakland County Board of Commissioners opposes any national cable
telecommunications legislative measure which preempts county and local government's
authority to exercise oversight and regulation of local cable systems".
A sufficient majority having voted therefor, the amendment carried.
