IN RE: HEALTH DIVISION COST SHARING AGREEMENT - 1983
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr, Chairperson, Ladies and Gentlemen:
WHEREAS under the cost sharing agreement between the State of
Michigan and the County of Oakland, the State is to share in the cost of providing
certain required and allowable public health services; and
WHEREAS such cost sharing agreement is specified by the Public Health
Code and has been in effect for four (4) years; and
WHEREAS due to ongoing financial pressures on the State of Michigan,
the agreement has not been funded at the level called for by the code for the
last several years; and
WHEREAS the agreement for 1983 specifies an amount of $1,911,307 or
15% of total allowable cost; and
WHEREAS estimated revenues from the cost sharing agreement have
been included in the 1983 adopted budget.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners authorize the Board Chairperson to sign cost sharing agreements and
amendments covering the period of January 1, 1983 through December 31, 1533 on
behalf of the local governing ent
BE IT FURTHER RESOLVED that the signing of this agreement does not
waive any rights of the County of Oakland as to its rights and remedies under
the Headlee Amendment and Public Health Code,

I. 'PURPOSE:.'
To prescribe the responsibilities of the state an d Oakland County -
Board of Health (the Local Governing 'Entity") to provide and pay for
- required and allowable health services for the .people of this state in
- accordance with Public Act 363 of 1973, as amended. -(ale "Code).)
: II_ OBJECTIVES: •
• The objectives to be accomplished under this agreement are: • •
1. To establish the authority and responsibility of Oakland County
• itpith nop lr tmpnt, the "Localjiealth Department", and the Michigan
Department of Public Health7.(MDPH) relative to the delivery and provision
of required and allowable health services.
2. To move toward the provision of agreed upon elements of health
services so that with full implementation of Sections 2471-2493 of the
Code ("Cost Sharing"), a uniform foundation of services for all Michigan
residents will be achieved.
• 3- To establish methods and sources of financing the. required and
allowable health services.
111. PROGRAM BUDGET AND AGREEMENT AMOUNT:
-
The total Local Health Department AnnUal Budget for the period
covered by this agreement shall be S 12,742,043 . The budget shall -
consist of a maximum of $ 1 911,307s -tate provided funds and. 10,830,736
local funding. State funds represent '':::"154 of the total allowable cost (total
cost less specified exclusions) for requi7ed and allowable service
provided by or through the local health department_ Local f.inding must not
be less than 85 of total allowable cost arld is subject to the local :
maintenance 6f-effort requirements of $ p 111,222__Lz
The Annual Budget reflecting all the health services to be offered by or
through the Local Health Department, regardless of funding source, shall
be attached and shall identify the-state and local shares under Cost-Sharing.
. Funding for the state share of911307 will be provided from 1982-83 and
1983-84 state appropriations, subject to the,ayailability of funds. The state
provided funds from 1982-83 shall be j ,433-Troug.h September 30, 1933 with
a final adjustment based upon a statewide ratio of available. 1982-83 funds to
actual allowable local expenditures for January 1 through September 30, 1933.
The balance of state funding is anticipated to come from 1983-84 appropriations.
The state share funding from 1983-84 appropriations shall be at a variable
rate which when combined with funding from the 1982-83 state appropriations
shall be equal to a state cost•share rate of15 % for the agreement period_
The total combined .state share shall not exceed $1,c)11,307 for the agreement.

A deviation allowance changing the Cost-Sharing allocation for a service group*
up to $ 375.000 is permissible without the prior written approval of YDPH.
Any increase in the Cost-Sharing allocation for a service group must be offset
by decreases in other service groups. Any request for modification or
deviation in excess of the provisions described above any any adjustment to the
,
total amount of this agreement, must be made in writing and approved in writing
by all parties to this agreement before such changes are implemented.
'IV. RESPONSIBILITIES - LOCAL HEALTH DEPARTMENT:
The Local . Health Department shall:
1. Prepare a Program Statement and Cost-Sharing Service Proposal (s). as
the basis for this agreement which identifies the current status of the minirm_Lii
elements of all required services, and the required and allcable services proposed•
for cost-sharing during the agreement period.
- 2. Provide those required and allowable services specified in the Prouram
Statement and Cost-Shared Service Proposal(s) attached and made part of this
agreement.
3. Develop and submit to MDPH an Annual Budget as prescribed by this
agreement.
4. Recruit and maintain qualified staff and comply with established
Merit System Standards.
5. Assure the availability and accessibility of all basic (required)
services provided by or through the Local Health Department, respond to inquiries
concerning the availability and accessibility of all basic services and disseminat e
information to the general public regarding the delivery of -all basic services.
6. Provide documentation, utilizing standard reporting forms prescribed
to MOH, to verify that at least health services supported by state Cost-Sharing
- funds budgeted under this .,agreement meet the objectives described in the Cost-
Shared Service Proposal(s). These proposals are to reflect the minimum standards
of scope, quality and administration established in the State/LOc!al Health Services
Analyses. All health services reflected in this agreement will comply with these
mutually agreed upon standards by the tine Cost-Sharing reaches the 5(3; level.
The bud•etcd service groups are: (I) Agency Support, (II) Environmental
Health Services, (III) Family Health Services, (IV) Other Health Services,
with specified requ;red services budgeted separately within-theaPPlicThle.grmT-
. 7. Assure that its Local Governing Entity approves the Program State- •
ment and Cost-Shared Service Proposal (s) and the Local Health flpartm ,nt
Annual Budget Prescribed by this agreement and Section 2-S3 of the Code.
.• 8. Assure that all terms Of the agreement will be appropriately adhered
to and, that records and detailed documentation for the Cost-Sharing program
be maintained for a period of not less than three (3) years from the date of the
submission of final expenditure report or until audit findings have been resolved.
Fiscal reports and records will he maintained and prepared in accordance with
instructions contained in the Uniformed Accounting Procedures Manual for
Local Health Departments, the Financial Management System for Local Health _
Departments, and applicable instructions for cost sharing.
9. Submit copies of all agreements for reallocated funds (Reallocation
Agreements) for the delivery of required and allowable services to MDPH
within 30 days of execution in accordance with Section 2477(2) of the Code. .
Reallocation agreements must be fully eiecuted prior to the end of this .
cost -shared agreement period. Any reallocation agreements must be •
consistent with MDPH policies established for Cost-Sharing and the terms
and conditions of this agreement. -
• • 10. Provide access during normal_ working hours to authorized
representatives of MDPH and other authorized federal and state officials .
or their duly authorized representatives to all records, files and
documentation related to this agreement.
11. Advise the MDPH, !Office of Finance and General Services of any
audits performed by any agencies or individuals which relate to the local
..health department or any services performed under this aareement_ -Copies
of these audits must be maintained and be available upon request.
T. _RESPONSIBILITIES - MICHIGAN DEPARTMENT OF PUBLIC HEALTH:
•
: MDPH, under the terms of this agreement will:
_
1. Provide payment in accordance with the terms of this agreement not
to exceed $' 1,911,307 , subject to the availability of funds, based
upon appropriate reports, records and documentation developed and maintained
by the Local Health Department. Such payment shall be limited to the
• - appropriate state share of reasonable and allowable costs for the
prescribed required and allowable services. -
2. Provide program, administrative and financial consultation,
assistance and training to the Local Health Department in the development,
implementation and evaluation of required and allowable services.
3. Monitor the services provided under this agreement in accordance
with the Program Statement and Cost-Shared Service Proposal(s) and Annual
Budget.

4. Whenever MDPH delivers direct services within the Local Health
Department area, it shall provide summary reports . of those activities to
the Local Health Department upon the request of the. local health officer
pursuant to Section 2235(4) of the Code.
• VI. ASSURANCES: . -
•
• 1. This agreement shall be carried out in compliance with:
a) Title VI of the Civil Rights Act of 1964, and theL
. Regulations of the U.S. Department of Health &
. Human Services issued thereunder,
b) Section 504 of the Rehabilitation Act of 1973, and
• c) the Rules of the Michigan Civil Rights Commission.
. The Agency assures that, in carrying out this program, no person
shall be excluded for participation, denied any benefits, or
subjected to discrimination on the basis of race, creed, age,
• color, national origin orancestry, religion, sex or marital
status (except where a bona fide occupational qualification •
. exists). This policy of non-discrimination shall also apply
to otherwise qualified handicapped individuals.
2. The Local Health Department shall assure that all procurement
- transactions whether negotiated or advertised shall be conducted
. in a manner so as to provide maximum open and free competition_
•
- 3. MDPH and the Local . Health Department shall take appropriate
.--
affirmative action to promote equal employment opportunity and
- promote equal access to governmental financed health services to
-
all individuals in the state in need of service.
VII. PAYMENT AND REPORTING PROCEDURES: .
•
• MDPH will reimburse the Local Health Department, subject to the
- availability of funds, for the state share of reason a ble and allowable
• costs for required and allowable services in accordance with procedures
of the MDPH.
- Financial reports shall be prepared and Submitted to MOPN's Office of
Finance and General Services on a quarterly basis not later than 20 days.
after the close of each calendar quarter. This report must reflect total .
actual expendituresfor all health programs regardless of the source of
funds. .
- • Monthly payments will be based upon a proration of the state's share
of this agreement_ If actual reported expenditures reflect amounts
significantly below budget levels, MDPH may proportionately adjust the
monthly payments as quarterly expenditure reports are received_ Payment
modifications can be made if special needs arise based upon a justified
request by the Local Health Department.
In the event that funds outstanding at the end of the agreement period
are less than the state share of costs, NDPil will provide final payment
for, the remaining state share balance - due the Local Health Department up to
the maximum amount of this agreemcmt. Any amount repre senting funds or
payments in excess of the state share of costs, .on hand at thp Local Health
Department at th end of the agreement period, will be returned to mom or
tru, ed in a,zorcance witn the instructions provided by NDPH.

• - Cost sharing reimbursements shall be suspended, pending •,7 flflCl
determination:whenever it appears that the Local Health Department is not
providing an adequate level.of.quality of service or whenever the Local
Health Department has failed to comply with the program performancr , or
reporting requirements, or if the Local Health Departent is not meeting
the maintenance of effort requirement. Any such suspensions resulting
from a final determination of non-combliance shall be subject to appeal
processes (as provided by Section 2497 and 2498 of the Code).
VIII. AGREEMENT PERIOD:.
This agreement is in full force and affective - from 1-1-83
through 12-31-83 • This agreement may be terminated by either
•. party by giving sixty (60) days written notice to the other party stating the
reasons for termination and effective date or, upon the failure of either party
• to carry out the terms of the agreemen, by giving ten (10.) days written notice
• • Stating cause and effective date,: The Department may also terminate this -
agreement if the agency, or subcontractor, manufacturer, or supplier of the
agency is subsequently found to engpce in unfair labor practices. The
-ilichigan Department of Labor pursuant to Section 2 of Public Act 278 of 1980
hall determine. those employers who -are engaging in unfair labor practices.
Upon any such termination ) • any funds not authorized for use shall be
returned.to the Department. •
- • Any changes to this agreementwill be' valid only if made in writing and
- accepted- by all parties to this agreement. • •

- - The individuals or officers signing this agreement certify by their
signatures that they are authorized to sign the agreement on behalf of the
responsible Local Governing Entity; that all provisions of Sections 2471
throunh 2493 of Public Act 363 of 1978, as amended, and all terms of this agree-
. ment will be adhered to. - .
