Olsen, Chairperson RE: OPPOSITION TO ATTEMPT BY THE STATE TO AVOID ITS CONSTITUTIONAL OBLIGATION TO RETURN STATE REVENUES TO LOCAL GOVERNMENTS IN THE SAME PROPORTION AS — EXISTED IN 1978-79. TO: THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Section 30 of Article IX of the State Constitution requires that state revenues be returned to local governments in the same proportion as existed in 1978-79. WHEREAS, the state has not met this constitutional requirement thereby forcing local governments to bear a disproportionately large share of state budget problems; and WHEREAS, Senate Bill 476 would permit the cost of financing a function on behalf of a local unit of government to be counted as state spending paid to local units of government; and WHEREAS, the intent of this legislation is to eliminate an estimated $160 million shortfall in state payments to local governments; and WHEREAS, the language of the bill as introduced is broad enough to have a negative impact on all county-state programs. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners opposes Senate Bill 476. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners opposes any accounting move which would allow the state to avoid its constitutional obligations to return state revenues to local governments in the same proportion as existed in 1978-79. BE IT FURTHER RESOLVED that copies of this resolution be sent to all legislators from Oakland County and to the County's legislative agent.
