McDonald, Chairperson In re: Submission of Changes in Merit System Rule /26 - Legal Holidays TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Lu;dies and Gentlemen: 'WHEREAS Section IV, S ub ection A of the Merit System Resolution requires that all changes in the rules and regulations of the Merit System Shall be submitted to the Board of Commissioners at a regular meeting of the Board and shall become effective thirty (30) days after such meeting unless objection is received in writing by the Chairperson of the Board of Commissioners, in which case the objection shall become a matter of business at the next meeting of the Board; and WHEREAS it has become desirable to make certain changes in the wording of Rule #76 "Legal Holiday" as spelled out in the attachments to this resolution including the current and proposed wording; and WHEREAS your Personnel Committee has reviewed and approved these changes at its meeting of May 26th, ic?E32. NOW THEREFORE BE IT RESOLVED that the reading of this notice and the distribution of this notice and the attached copies of current Rule #26 and proposed changes in Rule #26 to all Commissioners present and absent to be considered at the official submission to the Board of Commissioners of the described changes in Rule #26. MR, CHAIRPERSON, on behalf of the Personnel Committee, I move the adoption of the foregoing resolution. PERSONNEL COMMITTEE C . MERIT RULE 26 PROPOSED MODIFICATION Current holiday pay practices in County institutions which provide 24 hour 7. days per week service result in certain inequities in compensation for holiday time worked. Applying Merit Rule 26 in its present form can result in situations where an employee who works on Christmas Day, for example, could actually earn less for the pay period than the employee who worked the day on which the County officially celebrates the holiday, but not the holiday itself. This situation occurs when New Year's Day, Independence Day, Veterans' Day, or Christmas Day fall on a Saturday or Sunday and which the County officially celebrates on Friday or Monday, respectively. The purpose of this proposed change is to allow designated employees in the 24 hour operations to be compensated for the actual day on which the holiday falls and thus eliminate this inequity. PROPOSED WORDING All County Departments and Institutions shall be closed on these designated Holidays except those departments and institutions which must stay open to provide continuous round-the-clock service: PROPOSED MERIT SYSTEM RULE CHANGE • RU.LE 26 - LEGAL HOLIDAYS Section V EFFECT: OF LEGAL HOLIDAYS CURRENT WORDING A. All County Departments and Institutions shall be closed on . these designated Holidays except - those departments and institu- tions which must stay open to provide continuous round-the- clock service. B. County Employees eligible for B. Fringe Benefits under Rule 22 shall begranted time off with pay. on these days, in accordance . with the provisions of this rule. A. County employees eligible for frinc benefits under Rule 22 shall be granted time off with pay, except otherwise indicated in the provisic of this rule. - C. In those County departments and institutions which provide 24 hour, 7 days a week service, those employees on Seven-day scheduling moy be desig- nated eli;ible for holeday eempen- sation on the actual holiday rather than-the County celebrated hotiday. 1. In those instances when New Year's Day, Independence Day, Veterans' Day, or Christmas Day falls on Saturday or Sunda these designated employees shall be compensated for the actual day on. which the holidaI falls.
