Department of Natural Resources; and WHEREAS, this -Board, with the adoption of Miscellaneous Resolution. #82228 on August 5, 1982, adortcd a county solid waste management plan.; and WHEREAS, this Board, with the adootjon of Mis c ellaneous Resolution. #82229 on August; F, 1982, employed the law firm of Dicl7inson, Wright, Moon, VanDusen and Freeman for the period. August 6, 1982 to December 31, 1982 for legal services required by the plan; and. WHEREAS, this Board, with the adoption of Miscellaneous Resolution 483079, on March 31, 1983, emrloyed the law firm of Dickinson, Wright, Moon, VanDusPn and Freeman for the period of January 1, 1983 up to and including March 31, 1983; and WHEREAS, the Office of Corporation Counsel has requested and received four (4) proposals to furnish legal services for the period beginning January 1, 1983 to December 31, 1983; and WHEREAS, Corporation Counsel has reviewed these rr000sals and recommends the selection of Dickinson, Wright, Noon, VanDusen and Freeman; and WHEREAS, the Planning and Building Committee concurs with Corporatidn Counsel's recommendation. NOW THEREFORE BE IT RESOLVED that the Chaiiroerson. of the Oakland County B oard . of Commissioners be and is hereby authorized and directed to execute an agreement for legal services by and -P between. the County of Oakland and Dickinson, Wright, Moon, Vannusen and Freeman, r..)ursuant to the letter proposal dated March 21, 1983, attached. hereto. BE IT FUFTHER R7SOLVED that the effective date of the agree- ment shall be April 1, 1983 BE IT wURTFER RESOLVED that the maximum fee for 1e.7a1 services for the period covered by Miscellaneous Resolution ft83979, ado -Dted March 31, 1923 and this Resolution, commening April 1, 1983 and ending Dece7ber 31, 1983, shall not exceed the sum of *50,000,00. C In connection with our discussions concerning the employment of our Firm for Bond Counsel Services and other legal services for the County of Oakland Solid Waste Disposal Facilities, System and Act 641 County Plan, this will confirm our representation to you that for services rendered in 1983 our charges will be computed on an hourly basis at the rate set forth in the lowest proposal received by you in 1982, which we understand to be $75 per hour, This rate applies, as we understand, to consultations, research and preparation of memoranda, contracts and correspon- dence pertaining to the processing of the Act 641 County Plan to obtain approvals required of units of local government and of the Michigan Department of Natural Resources and also applies to services rendered to the Solid Waste Planning Committee in- cluding attending committee meetings and hearings as requested. The solid waste matters in litigation for which we are special counsel will continue to be handled by us as sepa- rate matters with fees to be negotiated, in consultation with you, as the litigation progresses. By reason of our involvement in refuse and solid waste disposal studies, plans and projects in Oakland County for about 15 years and because of our substantial investment of time, our DICKINSON, WRIGHT, MOON, VAN DLISEN & FREEMAN Jack C. Page Two March 21, 1983 extensive files and our acquisition of knowledge in these areas, we prefer to continue our legal activity on the solid waste• disposal sytsem at whatever rate of compensation is competitive from time to time. We believe it is in the mutual interest of Oakland County and of our Firm that we do so continue to carry this work to a conclusion. It also appears to us that by reason of our many years of involvement in solid waste study and plan- ning in Oakland County, we •can provide services at a minimum expenditure of hours in 1983 and thereafter as compared to a new law firm for 1983 and possibly a different firm for each year thereafter.
