Olsen, Chairperson RE: OPPOSITION TO SENATE BILLS 4 and 5 - Jailing for Contempt of Court TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Senate Bills 4 and 5 have been introduced as a package with the enactment of either one contingent upon the enactment of the other; and WHEREAS, Senate Bill 4 would provide that a person convicted of a crime or contempt of court and sentenced to imprisonment for a term of between one and two years may be sent to a jail rather than to a state penal institution; and WHEREAS, under existing law a person convicted of contempt of court with a sentence of one year or less shall be confined to a jail rather than a state institution; and WHEREAS, by permitting the placement in jails of people sentenced to two years, rather than the present one year, Senate Bill 4 would be shifting the state's prison overcrowding problem to local governmental units; and WHEREAS, the related bill, Senate Bill 5, provides for state reimbursement to counties for the cost of housing prisoners who have been convict,ed of a felony; and WHEREAS, while Senate Bill 5 seems at first glance to be beneficial to counties, the amount of reimbursement to counties shall be determined by the office of criminal justice; and WHEREAS, in addition to interjecting the state's judgement on what is fair cost, Senate Bill 5 also provides that reimbursement to counties is contingent an many factors including compliance with state statutes and rules which could be a debatable issue that would be difficult, if not impossible, to resolve. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners opposes both Senate Bill 14 and Senate Bill 5. BE IT FURTHER RESOLVED that copies of this resolution be sent to all legislators representing Oakland County and to the legislative agent.
