IN RE: ACCEPTANCE OAKLAND COUNTY ARSON PLAN GRANT
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS Miscellaneous Resolution #8145 requires the Liaison Committee
to review acceptance of all grants that vary more than ten (10%) percent
from the grant as applied for; and
WHEREAS by Miscellaneous Resolution #9026 the Oakland County Board of
Commissioners authorized the application for the Oakland County Sheriff Arson
Plan Grant in the amount of $180,511; and
WHEREAS said program as approved by the State Office of Criminal Justice
Programs is for $150,132, a decrease of $30,379 or 16.83%, as detailed in the
attached schedule; and
WHEREAS the County share of this grant is $7,507, or 5%; and
WHEREAS this grant contains provisions for the addition of two (2) arson
investigator positions, which must be reviewed by the Personnel Committee of
this Board.
NOW THEREFORE BE IT RESOLVED that the Sheriff Department Arson Plan Grant
in the amount of $150 3 132 be accepted.
The Public Services Committee by Henry W. Hoot, Chairman, moves the adoption
of the foregoing resolution.

Subgrantee understands and agrees that this subgrant contract shall be subject to
and incorporate the following conditions of the Lay Enforcement Assistance Achtin-
istration and the Michigan Office of Crf ,rInal Justice.
Assurance of Compliance with Federal. Civil Rights Act of 1964, Subgrantee
agrees to comply with and insure compliance by its contractors with Title
VI of the Civil Rights Act of 1974, and all requirements imposed by or pur-
suant to regulations of the Department of Justice (28 CFR Part 42) issued
pursuant to that title, to the end that no person shall, on the groeuds of
race, color, creed, or national origin, be excluded from participation in,
be denied the benefits of, or be otherwise subjected to discrimination under
any program or activity for which the applicant receives Federal financial
assistance from the Department of Justice. The subgrantee further will comply
with and Incurs compliance by Its contractors with Justice Department equal
employment regulation In Federally assisted progra,. (28 CFR Part 42, sub-
part D) to the end that employment discrimination in such programs on the
grounds of race, color, creed, or national origin, shall be eliminated. The
subgrantee recognizes the right of the United States to seek judicial enforce-
ment of the foregoing covenants against discrimination, and will include a
similar covenant assuring the right of the United States to seek judicial
enforcement in its contracts. As required by Section 518 (b) of P.L. 90-351,
thia grant condition shall not be Interpreted to require the imposition of
any percentage ratio, quota system, or other program to achieve racial balance
or eliminate racial imbalance in a law enforcement agency.
(2) Assurance of Compliance with the Michigan State Fair Employment Practices
Act. The subgrantee and any of his contractors agree not to diactim4nate
against any employee or applicant for employment, to he employed in the
performance of the contract, with respect to his hire, tenure, terms,
conditions or privileges of employment, or any matter directly or indirectly
related to employment, because of race, color, religion, national origin,
age, or sex. Act No. 251, Public Acts of 1955, being 8 423.304 C.L. 1948;
Act No. 344, Public Acts of 1965, being S L 423.304a C.L. 1948, as amended,
The subgrantee recognizes the right of the State of Michigan to seek admin-
istrative or judicial enforcement of the foregoing convenants against
discrimination, and will include a similar covenant assuring the right of
the State of Michigan to seek administrative or judicial enforcement of its
contracts.
(3) Accounting Requirements. Subgrantee agrees to maintain accounting records
following generally accepted accounting procedures and expend subgrant funds
for purposes identified in the approved subgrant application and in compliance
with the Michigan Guideline Manual for Financial Mausgeoent. All revenue and
expenditures must be recorded in a fund or account separate from the sub
grantee's other or general revenue and expenditures. Continuation subgrants
wust be separated from any previous subgrant. All charges must be direct costs
(actual) unless an alternative costing method receives prior OCJ approval.
Adequate expenditure documentation, approved by the subgrant project director,
oust be maintained for all subgrant costs which includes the following:
The subgrantee agrees that OCJ may disallow any expenditure which is not
adequately documented or in not in accordance with the approved application
and the Michigan Guideline Manual for Financial Management.

(5) Implementation of Project Within Sixty Days, Subgrankeo agrees to implement
this project within sixty days following the grant award effective date or
be subject to automatic cancellation of the grant. Evidence of project imple-
mentation must be reported on the authorized forms and by submission of the
signed subgrant contract to this office within the first sixty days. An
extension may be requested. No funds viii be released until the Notice of
Implementation and the signed subgrant contract are received by OCJ.

(6) Report Requirements. Subgrantee agrees to submit reports as specified in the
subgrant contract conditions. A Final Expenditure Summary with Detailed
Schedules is due 90 days following the termination of the subgrant. Unused
Federal and State monies shall be returned to the State of Michigan - OC.1
with the Final Expenditure Summary with Detailed Schedules.
(7) Obligation of Funds and Final Expenditure Summary. All obligations for this
subgrant must be made prior to the subgrant termination date and Liquidated
within 60 days from the termination date of the subgrant. The Final Expendi-
ture SI ,,v,.kry is due at OCJ within 99 days after the subgrant terminatioo
date.
(8) Project Income. Income earned by the subgrantes with respect to subgrent funds
or as a result of conduct of the project (sale of publications, registration
fees, service charges on fees, etc.) must be accounted for iz accordance with
chapter 4, paragraph 178, C, and of the Michigan Guideline manual for
Financial Management.
(9) Termination of Aid. This subgrant may be terminated or fund payments discon-
tinued by OCj where it finds a substantial failure to comply with the provisions
of the Crime Control Act of 1975 or regulations promulgated, including there
subgrant condition's or application obligations, but only after notice and
hearing and pursuant to all procedures set forth in Sections 510 and 511 of
the Crime Control Act of 1976.
(10) Inspection and Audit. The State Office of edministrative Services, OCJ, LEAA,
and the State Auditor General, or any of their duly authorized representative,
shall have access for purpose of audit and examinations to any books, documants,
papers, and records of the subgrantee and contractors, as provided in Section -
521 of the Crime Control Act of 1976.
(11) Expenses not Allowable. Sabgrant funds may not be expended for (a) iteies eet
generally a part of the approved budget or separately approved by OCJ: (b)
purchase of land; (c) purchase of buildings or improvements thereon, or
payment of real estate mortgages, or taxes, unless specifically provided for
In the approved application; (d) dues to orgenizatione or federations; (e)
entertainment; (f) purchase of automobiles or other automotive vehicles
unless provided for in the approved application; or (g) indirect costs.
Expenditure of funds in excess of the approved budget detail for any budget
category will be permitted only with OC.3 approval. Funds should not be used
for items not included in the application without docuisontation of sobgramt
approval from OCJ.
(12) Subgraut Adjustments - Project Change. Subgrantes must obtain written approval
from OC,1 for major project changes.
(13) Copyrights. Where activities supported by this suberant produce original books,
films, or other copyrightable material, the subgreatee nay copyright such,
however, LEAA and OC..1 reserve a royalty-free, non-exclusive and irrevocable
license to reproduce, publish, and use such materials, and to authorize others
to do so.
(14) Patents. If any discovery or invention arises or is developed in the course of
or as the result of work performed under the subgranti, the subgrantee shall
refer the discovery or invention to LEAA and OCJ, which will determine whether
or not patent protection will be sought, how M3TV, rights therein, including
patent rights, will be disposed of and administered and the nscessiey of other
action required to protect the public interest in vath supported with Faders/

(22) Clean Air Act and Federal Water Pollution Control Act. Subgrantee is
advised that grants, subgrants, or contracts cannot he entered into
reviewed or extended with parties convicted of offenses under the Clean
Air Act and the Federal Pater Pollution Control Act
(23) National Historic Preservation Act of 1966. Sagrantee agrees before the
construction, renovation, purchasing, or leasing of facilities, he shall
consult with the State Liaison Officer for historic preservation to
detemine if the undertaking mny have an effect on properties listed in
the National Register of Historic Places or properties eligible for the
National Register, If the undertaking may or may not have an effect, the
Office of Crialinal Justice must be notified in writing prior to entering

and sixteen hours of basic arson detection training for 150 fire fighters. Further,
the number of qualified expert arson witnesses will be increased from six to twelve.
A common arson reporting and data system will be implemented. Cooperation and
coordination between fire agencies and law enforcement will be improved.
Two arson investigators will be employed to accomplish, in concert with the two
current investigators, the above goals and objectives. The arson investigators
will perform on-the-scene and follow up investigations of arson incidents; collect,
analyze and validate evidence; prepare sketches and diagram details of arson and
suspicious fires; and, make determinations concerning the possibility of arson;
preserve and process evidence; and present expert testimony, Arson detection/
investigation training will be provided for unit personnel, fire fighters and
other arson investigators within Oakland County.
Evaluation proposed by the subgrantee and the OCJ standard minimum evaluation will
be used.

Mileage expenses are also paid to the Oakland County Department of Central Services for the

Clothing costs of $900.00 include fatigue uniforms and coveralls to be worn by the arson in -.,
igators at fire srenes based on $450.00 per man.
Cleaning costs of $210.00 are for the cleaning of fatigue uniforms and coveralls over a one
ear period.
Radio Rental of $1,200.00 is the fee that the Oakland County Sheriff's Department must pay
he Oakland County Department of Central Services for the rental of a two (2) channel radio to
nstalled in police cars for communications from car to base. The fee includes installation Si

Two (2) pairs of rubber boots with steel shank will be purchased. One (1) pair will he
assigned to each investigator. The boots will provide the investigator with protection from h.
and water while investigation of fire scenes.
TWo (2) fire coats with insulators will be purchased and one (I) assigned to each investiga-
tor. The coat is also safety equipment and protects the investigator from heat and water whilo
investigating fire scenes.
Two (2) OSHA approved helmets with eye protectors will be purcIlased And one (1) assigned to
each investigator. The equipment will be utilized as head and eye protection for the inves-
tigator's while investigating fire scenes.
One (1) dozen rubber Gloves with wool inserts will be purchased to be stored in the crime
unit at a cost of $44.00. The gloves will provide the investigators with protection from heat
,vater as well as protect their hands while handling fire debris at fire scenes. The gloves we.,
put easily due to the type of debris handled, thus the quantity.
One (1) twenty foot aluminum extension ladder will be purchaSed for the crime scene unit at
:post of $290.00. The ladder will be utilized to reach the upper portion of dwellings in those

Pursuant to Rule XI-C of this Board, the Finance Committee has
reviewed Miscellaneous Resolution #9267 and finds $7,507 is the County
share necessary for this program.
The Finance Committee finds $7,507 available in the 1980 Federal Project
Match line-item; said funds to be transferred to the 1980 Sheriff Department
Technical Services Division - Operations Unit grant match line-item
Furthermore this program includes the addition of two (2) arson
investigator positions and will require the review and approval of the
