IN RE: ACCEPTANCE OF MODIFIED JURY SYSTEM GRANT
TO THE OAKLAND COUNTY BOARD OF COKMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS the Oakland County Board of Commissioners, by Miscellaneous
Resolution No. 9127 authorized the application for the Modified Jury System
Grant; and
WHEREAS the grant procedures adopted by Miscellaneous Resolution No. 8145
calls for the liaison committee review of all grants that vary more than 10%
from that applied for; and
WHEREAS the office of Federal and State Aid has reviewed the Modified
Jury System Grant and finds the grant award for $70,683 is more than 10%
greater than the $53,867 grant applied for; and
WHEREAS the additional funding will permit purchase of the needed
equipment;
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners
accept the Modified Jury System Grant.
BE IT FURTHER RESOLVED that written quarterly progress reports be presented
to the Public Services Committee and to the balance of the members of the Board
of Commissioners.
The Public Services Committee, by Henry William Hoot, Chairman, moves the
adoption of the foregoing resolution.

Pursuant to Rule XI-C of this Board, the Finance Committee has reviewed
Miscellaneous Resolution #9296 and finds $3,534 is the County share necessary
for this program.
The Finance Committee finds $3,534 available in the 1980 Federal Project
Match line item; said funds to be transferred to the 1980 Circuit Court Admini-
strative Division grant match line-item.

Subgrantee understands and agrees that this subgrant contract shall be subject to
and incorporate the following conditions of the Law Enforcement Assistance Admin-
istration and the Michigan Office of Criminal Justice.
(1) Assurance of Compliance with Federal Civil Rights Act of 1964. Subgrantee
agrees to comply with and insure compliance by its contractors with Title
VI of the Civil Rights Act of 1974, and all requirements imposed by or pur-
suant to regulations of the Department of Justice (28 CFR Fart 42) issued
pursuant to that title, to the end that no person shall, on the grounds of
race, color, creed, or national origin, be excluded from participation in,
be denied the benefits of, or be otherwise subjected to discrimination under
any program or activity for which the applicant receives Federal financial
assistance from the Department of Justice. The subgrantee further will comply
with and insure compliance by its contractors with Justice Department equal
employment regulation in Federally assisted programs (28 CUR Fart 42, sub-
part D) to the end that employment discrimination in such programs on the
grounds of race, color, creed, or national origin, shall be eliminated. The
subgrantee recognizes the right of the United States to seek judicial enforce-
ment of the foregoing covenants against discrimination, and will include a
similar covenant assuring the right of the United States to seek judicial
enforcement in its contracts. As required by Section 518 (b) of F.L. 90-351, •
this grant condition shall not be interpreted to require the imposition of
any percentage ratio, quota system, or other program to achieve racial balance
or eliminate racial imbalance in a law enforcement agency.
(2) Assurance of Compliance with the Michigan State Fair Employment Practices
Act. The subgrantee and eny of his contractors agree not to discriminate
against any employee or applicant for employment, to be employed in the
performance of the contract, with respect to his hire, tenure, terms,
conditions or privileges of employment, or any matter directly or indirectly
related to employment, because of race, color, religicn, oz,..ional origin,
age, or sex. Act No, 251, Public Acts of 1955, being C.L. .48;
Act No, 344, Public Acts of 1965, being a 425,3042 C.L. as

istrative or judicial enforcement of the foregoing conver,i against
discrimination, and will include a similar covenant assuring the right of
the State of Michigan to seek administrative or judicial enforcement of its
contracts.
(3) Accounting Requirements. Subgrantee agrees to maintain accounting records
following generally accepted accounting procedures and expend subgrant funds
for purposes identified in the approved subgraet application and in compliance
with the Michigan Guideline Manual for Financial Management. All revenue and
expenditures must be recorded in a fund or account separate from the sub-
grantee's other or genera! revenue and expenditures. Ccrei:eation subgrants
must be separated from any previous subgrant. All charges be direct costs
(actual) unless an alternative costing method receives prior 003 approval.

The subgrantee agrees that OCJ may disallow any expenditure which is not
adequately documented or is not in accordance with the approved application
and the Michigan Guideline Manual for Financial Management.

Expenditures reported to OCJ should be in agreement with costs reflected
on the subgrantee's expenditure account established to record subgrant
costs. Financial records and supporting documentation must be retained
and available for audit purposes for three years or until a Federally approved
audit is completed. (See paragraph 9, chapter 2 of the Michigan Guideline
Manuel for Financial Management.)
A. Personnel - Documentation must be in accordance with paragraph SlOb of
Appendix I (OMB Circular 74-4, pages Al - ,18 and 19) of the .iichigan
Guideline Manual for Financial Management which states: "en oats rc% .tet
to grant programs for personnel services, regardless o N r 'c.ae:,d as
direct or indirect costs, will be based on payrolls documented and a. roved
in accordance with generally accepted practice of the state or local agency.
Payrolls must be supported by time and attendance or equivalent records for
individual employees." For fringe benefits, the documentation must show a
breakdown of actual cost by fringe benefit item and individual.
B. Contractual Services - Refer to paragraph 24 and 49, chapter 3 of the
Michigan Guideline Manual for Financial Management for documentation and
restrictions applicable to contractual services. Also see Subgrant Condition
Number 17.
Note: A written contractual agreement must be maintained in support of all
contractual service costs (individuals and organizations). For individuals
a letter of agreement may suffice.
C. Travel - Refer to paragraph 28 of Appendix 1 (OMB Circular 71-4, page
A1-22) of the Michigan Guideline Manual for Financial Management, Documen-
tation, payment rates and procedures must be consistent with the travel
regulations of the subgrantee agency, but not to exceed current State of
Michigan travel rates as shown on COI Form 123. See Appendix 3 for fei:oe
limitations.
D. Supplies and Operating - Documentation must include invoices and payment
documents processed in accordance with the subgrantee agency's normal.

All equipment should be tagged and property records maintained in accordance
with paragraph 5f of'LEAA Guideline G7380.2, Standards for Property Aered
with LEAA Grant Funds. Also see Appendix 9 of the Michigan Guideline
for Financial Management.
Use and disposition of equipment purchased in whole, or in part, with LEAA
funds will be in accordance with LLAA Guideline G7380.2, St ..ends for
Property Acquired with LEAA Grant Funds. Also see Appendix Michigan
Guideline Manual for Financial Management.
F. Construction - Documentation includes bids, where required, purchase orders
and detailed contractor invoices processed in accordance with th: sol -e::antee
agency's normal procedures. All payments should be consistent
contractual agreement, Refer to paragraph 49, chaye.sr 3 of an

(4) Continuation Funding. Subgrantee understands that the awarding of this grant
in no way assures or implies ce -tinuation of funding beyond the project
duration indicated on the seber .ot contract.

(5) Implementation of Project Within Sixty Days, Snbgrantee .•:--s to imples:ent
this project within sixty days following the grant awal.i e .iective data or
be subject to automatic cancellation of the grant. Evidence of project imple-
mentation must be reported on the authorized forms and by suimission of the
signed subgrant contract to this office within the first sixty days. An
extension may be requested. No funds will be released until :he Notice of
Implementation and the signed subgt:ant contract are received by 001.
(6) Report Requirements. Subgrantee agrees to Submit reports as specified in the
subgrant contract conditions. A Final Expenditure Summary with Detailed
Schedules is due 90 days following the termination of the subgrant. Unused
Federal and State monies shall be returned to the State of Michigan - 003
with the Final Expenditure Summary with Detailed Schedules.
(7) Obligation of Funds and Final Expenditure Summary. All obligations for this
subgrant must be made prior to the subgrant termination date and liquidated
within 60 days from the termination date of the subgrant, The Final Expendi-
ture Summary is due at OCJ within 90 days after the subtrant termination
date.
(8) Project Income. Income earned by the subgrahtee with respect to subgrant funds
or as a result of conduct of the project (sale of public tions, registration
fees, service charges on fees, etc.) must be accounted -,r in accordance with
chapter 4, paragraph 17B, C, and D of the Michigan i.-.'-,- Manual for
Financial Management.
(9) Termination of Aid, This subgrant may be terminated or fund payments discon-
tinued by OCJ wh ere it finds a substantial failure to comply with the provisions
of the Crime Control Act of 1976 or regulations promulgated, including these
subgrant conditions or application obligations, but only after notice and
hearing and pursuant to all procedures set forth in Sections 510 and 511 of
the Crime Control. Act of 1976.
(10) Inspection and Audit. The State Office of Administrative Services, OCJ, LY
and the State Auditor General, or any of their duly authorized represer -oc,
shall have access for purpose of audit and examinations to any books, d
papers, and records of the suhgrantee and contractors, as provided in Secticn
521 of the Crime Control Act of 1976.
(11) Expenses not Allowable. Subgrant funds may net be xper.,'.ed for (a) items not
generally a part of the approved budget or separately ...;Tdeed by OCJ: (b)
purchase of land.; (c) purchase of buildings_ or improvemcnrs thereon, or
payment of real estate mortgages, or taxes, unless speciiically provided for
in the approved application; (d) dues to organizations or federations; (e)
entertainment; (f) purchase of automobiles or other automotive vehicles
unless provided for in the approved application; or (g) indirect costs.
Expenditure of funds in excess of the approved budget detail for any budget
category will be permitted only with OCJ approval. Funds should not be used
for items not included in the application without documentation of subgrant
approval from OCJ.
(12) Subgrant Adjustments - Project Change. Subgrantee must obtain written approval
from OCJ for major project changes.
(13) Copyrights. Where activities supported by this ,nbirant prc.. riginal books,
films, or other copyrightable material, the subgran:ie such,
however, LEAA and OCJ reserve a royalty-free, non-eilusive and irrevocable
license to reproduce, publish, and use such materia:,i,, and to anti-Jeri:7e ethers
to do so.
(14) Patents. If any discovery or invention arises or is developed in the course of
or as the result of work performed under the th , shall

(15) Publications, The subgrantee may publish, at its ow-n expense, the results
of subgrant activity without prior review by OCJ prov:.:.i that any publica-
tion (written, oral, or visual) contains an ackno...:cmen of LEAA/oci
subgrantee support and follows the format in LE. This
Guideline is available through OCJ. A. copy of such pe',11'-ion ry7t be
furnished to CCJ. Publication of documents or reports w7i• funds
beyond quantities required to meet standard report recuirc -?,, be
provided for in approved project plans or budgets or otherwise :.--roved by
OCJ and, for large quantity publications, manuscripts must be surmitted in
advance to OCJ.
(16) Third Party Participation. No contract or agreement may be entered into by
the subgrantee for execution of project activities or provision of services
to a subgrant project (other than purchase of supplies or standcrd cl.mmorcial
or maintenance services) which is not incorporated in the appro.-•d
Any such arrangerts nhall provide that the subgrantee will retain
ultimate control and r,,ponsl .dlity for the project and that the contractor
shall be bound by these conditions as well as the subgrantee.
(17) Competitive Bid Process. Major items of equipment must be purchased according
to standard purchasing procedures. A formal bid process must be followed in
acquiring items of equipment exceeding $2,500 gross cost. (Refer to Chapter
3, paragraph 49 and 50 of the Michigan Guidella Mc nc. fe: Financial
Management) Consulting services and other outside se ,ces must be controlled
by a formal contract procedure. Contractual agreements must specify service
to be performed, negotiated rate, and payment time schedule. Contracts
exceeding 52,500 must also be derived by following a formal bid process. In
all cases, the subgrantee must justify the final decision in chosint one
distributor over another or one contractor over another. Contractors must
submit billings in accordance with specifications of the contract.
(18) Relocation Assistance. The subgrantee assures that for those projects which
displace individuals from homes, business or farms, resources are available
to pay moving expenses and relocation costs, and to assist the displaced
individuals in relocating. The subgrentee should include the relocation costs
in the budget.
(19) Public Availability of Information. The subgrantee and contractors agree to
make available to the public identifiable records cr other documents that are
pertinent to the receipt or expenditure of subg ,ant funds, Public announce-
ments, requests for bids, or press releases resulting from the subgrant or
project activity shall identify the Office of Criminal Justice as the State
agency responsible for administering the Federal funds made available by the
Law Enforcement Assistance Administration of the Federal Department of Justice.
(20) Uniform Crime Reports. Any failure on the part of the subgrantoe to comply
with the provisions of Public. Act 319, Public Acts of Michigan, 1901,, shall
be grounds for termination of the sub:grant contract. Further, the sutgrantee
will not knowingly provide benefits to any unit of general local government
which is failing to comply with Public Act 319.
(21) National Environmental Policy Act of 1969. Any application for subgrants
involving (1) new construction projects, (2) the renovation 7 modification
of a facility which leads to an increased occupancy of more tn 25 persons,
(3) the implementation of programs involving the use of pe!..:...de.s other
harmful chemicals, (4) the implementation of prograu .s- cf
microwaves or radiation, (5) research and technology whose ant:.,•
intended future applications could be expected to have a potential -T7ect on
the environment, and (6) other acti -ns which TeCTE. .he substantial commit-
ment of resources or trigger such a substantial c - t - ::-.7i.ent by another as
determined by the responsible LE::: efical .0 (e.- a significant

(22) Clean Air Act and Federal Water Pollution Control Act. Subgrantee is
advised that grants, subgrants, or contracts cannot be entered into,
reviewed or extended with parties convicted of offenses under the Clean
Air Act and the Federal Water Pollution Centrol Act.
(23) National Historic Preservation Act of 1966. Subgrartee e:rees before the
construction, renovation, purchasing, or leasing of is. Los, he shall
consult with the State Liaison Officer for historic preservation to
determine if the undertaking may have an effect on prei.elies listed in
the National Register of Historic Places or properties eligible for the
National Register. If the undertaking may or may not have an effect, the
Office of Criminal Justice must be notified in writing prior to entering

(24) In accordance with LE/ A and OCJ guidelines, the report due dates for this
subgrant are as follows:
A. Subgrant Contract returned with appropriate signatures within 60 days
due by 3/1180 .
B. Notice of Implementation within 60 days due by /1/80.
C. Subgrant Financial Report due 2/ 20/SO for the period ending
1./31/80 . Subsequent reports will be due twenty days following
the end of each 477cmonth 0 quarter.
D. Subgrant Quarterly Progress Report due 4/ 20/80 fer the period
ending 3/ 31/80. Subsequent reports will be due twenty days
following the end of Each calender quarter.

25. Cash Match Required: Effective with 1974 and subsequent years
funds, the matching requirement must be in the form of cash. The
subgrantee must provide $3,534 in cash. This local cash must be newly
appropriated by the subgrantee for the purpose of matching the
federal funds. To document compliance, the subgrantee must submit
a certified copy of the appropriation resolution together with the
signed copy of the subgrant contract. No funds will be released until
the signed subgrant contract and the cash match resolution have been
received by OCJ.
26. Prior to March 1, 1980, Subgrantee shall develop an evaluation format
'designed to measure the effectiveness and results of this project. No
funds will be released until this format is approved by OCj.
27. - Subgrantee acknowledges and agrees that the project supported by
this subgrant will receive federal and state matching funds only
for the period of funding indicated in this subgrant contract. No
federal or state matching funds will be made available to expand
or continue this project or subgrant. Subgrantee agrees to assume
all responsibility for all continuing expenses as a result of this
subgrant.
28. Subgrantee is required to document time and attendance of all
contractual employees on OCJ form 161, Documentation of Contractual
Services.
29. Any change within the equipment category of this subgrant must receive
prier OCJ approval.
30. Subgrantee agrees that all computer services including personnel time
will be documented for audit purposes.
31. Subgrantee agrees that in any procurement involving electronic data
processing (EDP) equipment, competitive procurement action will be utilized
and that any purchase of EDP equipment will be made only after nrior LEAA
approval of a lease vs purchase analysis which proves conclusively the
advantage to the government of purchase.
32. Subgrantee further agrees to provide upon request, system documentation
to the Office of Criminal Justice. Documentation will include, but not
be limited to System Description, Operating Instruction, User Instructions,
Program Maintenance Instruction, Input Forms, File Descriptions, Report
Formats, Program Listings and Flow Charts for the system programs.

APPLICATION SUMMARY
1,7.M: In recognition of the burden of jury service to the public, the State
,..Le -,islature has enacted Public Act 11 of 1978 which requires courts throughout the
state to implement modified jury selection procedures. This legislation was designed
to reduce the inconvenience and hardship of jury service of pariods as long as three
months in Oakland County. However, in Oakland County a two waa'a jury service term
is employed, which means that a large degree of unnecessary inconvenience still
exists. Juries are not scheduled on Wednesdays which are miscellaneous -motion days
and a code-a-phone operated call-in system effectiaely cuts down the average numaer
of days actually spent in service to approximately five.
OSjECTIVES: The general objective is to significantly reduce this five day term
without an inordinate budget increase or an adverse effect on juror days per trial
or the juror usage index. Specific objectives are: a) to increase convenience to
jurors through implementation of an automated system capable of handling a large
number of postponements for a large group of people; b) to increase efficiency by
design and automation; c) to lessen inconvenience to the public by decreasing
the length of service; d) to broaden public participation; e) to develop an
automated system that will operate without significant continuing costs and meet,
future demands without additional expenditures.
1 METHODS: The Court will contract with the Oakland County Computer Services to develop

I. Provide computer draw as required from the Oakland County Voter Registration List.
2. Provide automated questionnaire preparation for jurors selected from the list.
3. Provide processir: capability for ?ostponed jurors.

7. Provide lists of jurors.

A video-tape program for orientation of new jurors each morning of the term
will be developed.
EVALUATION: Evaluation of this project will be responsibility of the Project
Director. Evaluation instruments will be developed capable of increasing
convenience tojurors efficiency and effectiveness of court activity, length of
juror service, and personnel/operating costs resulting from this program. The
evaluation foLuial will be specified by the Office of Criminal Justice.
