RE: STATE OF MICHIGAN YOUTH PROGRAM SUB-CONTRACTING SERVICES TO
SOUTHFIELD COMMUNITY PLACEMENT AND TROY VOCATIONAL INSTRUCTION
AND PLACEMENT
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS:
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, the Oakland County Board of Commissioners by
Miscellaneous Resolutions No. 6546 and No. 8883 applied for and was
granted the designation as Prime Sponsor by the U.S. Department of
Labor to administer the provisions of the Comprehensive Employment
and Training Act of 1973 and the Comprehensive Employment and
Training Act Amendments of 1978; and
WHEREAS, the Employment and Training Division of Oakland County
was authorized by Miscellaneous Resolution No. 9186 to apply to the
Michigan Department of Labor for funds available for the FY1980
Michigan Youth Program (Attachment A); and
WHEREAS, this program is designed to place youth into On-The-
Job Training programs, which leads to unsubsidized employment; and
WHEREAS, the Employment and Training Division of Oakland County
has been granted total funding of $150,000 for the FY80 Michigan
Youth Program (MYP) (Attachment B); and
WHEREAS, the Employment and Training Division will sub-contract
with Southfield Community Placement and Troy Vocational Instruction
and Placement (VIP) for the performance of program objectives
(Attachment C); and
WHEREAS, a total budget of $30,000 has been allocated for
administration of the Michigan Youth Program by said agencies; and
WHEREAS, the formats suggested for these contracts have been
derived from the State of Michigan and must be further reviewed by
Civil Counsel for agreement within County contracting procedures.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners approve the performance contracts and attached budgets
for Southfield Community Placement and Troy VIP as contained in
Attachments B and C.
BE IT FURTHER RESOLVED that a quarterly written report for
review of performance objectives will be submitted to the Public
Services Committee of the Oakland County Board of Commissioners.
BE IT FURTHER RESOLVED that the Chairperson of the Board of
Commissioners be and is hereby authorized to execute said contracts.
The Public Services Committee by Henry William Hoot, Chairman,
moves the adoption of the foregoing resolution.

ATTACHMENT A
MICHIGAN YOUTH PROGRAM
FY 1980
The Michigan Youth Program is a state funded project
designed to provide on-the-job training in private
industry to out of school youth, ages 16 through 24
inclusive, who are from low income families. For the
purpose of this program, low income is defined as 125%
of the Poverty Level or less. The grant is for the
period from January 1, 1980 through September 30, 1980.
The OJT positions are selected based on long term
labor market demand and compatibility with participants'
interests and abilities. All positions pay a minimum
of $3.50 per hour, and average a 4 1/2 month training
period. The ultimate goal of this OJT program is to
obtain unsubsidized, permanent employment in private
or public sector for program participants.

. STATEMENT OF PURPOSE
A. General
1. This contract, made and entered into by and between
THE COUNTY OF OAKLAND, a constitutional corporation,
hereinafter referred to as the RECIPIENT, and
SOUTHFIELD COMMUNITY PLACEMENT of the
CITY of SOUTHFIELD in the SOUTHFIELD
SCHOOL DISTRICT
Referred to as the SUBRECIPIENT
2, The RECIPIENT has entered into an agreement, said
agreement designated as Contract Number 420-109, with
the Bureau of Employment and Training, Michigan Depart-
ment of Labor to provide for the planning and delivery
of manpower services under its authority as a Prime
Sponsor under the Comprehensive Employment and Training
Act of 1974 for the jurisdiction of OAKLAND COUNTY: and
3. It has been determined that the delivery of activities
authorized in the Prime Sponsor's grant requires the
competent performance of the manpower services of:
Subrecipient, as an integral activity under the Recipient's
manpower system, and which the Subrecipient understand, is
well-qualified to provide, and desires to provide; NOW,
THEREFORE,
4. IT IS AGREED by and between the parties as follows:
Whereas the Recipient desires to provide manpower
services within its jurisdiction according to goals and
purposes as set forth in the Recipient's approved plan,
the purpose of this contract is to engage the professional
services of the Subrecipient for the provision of manpower
services and to define the terms and conditions of this
undertaking.
B. Contract Specifications
1. STATEMENT OF PURPOSE: The Recipient's objective is to
provide employment and training services to eligible youth
which will lead to maximum employment opportunities and
enhance self-sufficiency. This agreement between Recipient
and Subrecipient is entered into for provision of said
services.
2. STATEMENT OF WORK: The Subrecipient agrees to perform
the functions and reach the objectives outlined in Exhibit A 1.
3. PERIOD OF PERFORMANCE: The Subrecipient shall commence
performance of this agreement on the 1 st day of February
1980 ; and shall complete said performance not later than the
30thday of September , 1980.
4. COMPENSATION: The Recipient agrees to reimburse the
Subrecipient for the identifiable costs of Client Services
provided under this contract in an amount not to exceed
$15,000. Costs incurred by the Subrecipient prior to
February 1,1980 or after September 30, 1980 are not
allowable. Payment under this contract shall be made monthly
to the Subrecipient upon receipt of the reimbursement request
(Exhibit A5 )-
5. EVALUATION: The contractual objectives outlined in
Exhibit A 1 represents what the Recipient has determined the
Subrecipient will accomplish under the terms of the contract.
Evaluation of a Subrecipient's performance will be
determined by means of monitoring reports, field reports
and Prime Sponsor staff subjective analyses. This
evaluation will be compiled on an informal basis within
two weeks of the end of the second and third quarters. In
addition, an overall program evaluation will be compiled
at the termination of the program. This formal evaluation
will address a Subrecipient's performance in a) objective
results (enrollments, expenditures and terminations) and
b) subjective results (quality of training sites, success-
ful program completion, client follow-up). The final
evaluation will include recommendations for future categor-
ical grant involvement based on program performance.
II. GENERAL PROVISIONS
A, Subrecipient's Compliance with Applicable Requirements
I. The Subrecipient will abide by all applicable laws,
ordinances, and codes of Federal, State or Local government
imposed and required by any such contract between the
Recipient and the Michigan Department of Labor. Further-
more, the Subrecipient agrees to abide by all subsequent
revisions and modifications of said contract, as published
to set forth administrative and statutory changes imposed
on or by the Michigan Department of Labor.
2. The Subrecipient shall comply with the Equal Employment
Opportunity requirements expressed in Executive Directive
1975-6 issued by the Governor December 2, 1975 and/or in
Executive Directive 1975-3 issued by the Governor June 20,
1975 and Executive Directive 1979-4 issued by the Governor
September 7, 1979.
3. The Subrecipient will comply with the Michigan Civil
Rights Act, P.A. 453 of 1976 and the Michigan Handicappers'
Civil Rights Act, P.A. 220 of 1976.
B. Modifications
1. All requests for interpretations, modifications or
changes must be made in writing by either Recipient or
Subrecipient, whichever may be the initiating party.
2. All requests must be made by means of certified mail.
3. A response must occur within a 14 day period from date
of receipt by certified mail.
4. All modifications are to be finalized in written form
with, authorized signatures, following normal approval
procedures, and will then be incorporated into the contract
document.
C. Recipient Held Harmless
1. That the Subrecipient agrees to idemnify, defend and
save harmless the Recipient, its officers, agents and
employees from any and all claims and losses accruing, or
resulting to the Subrecipient, as a result of the Sub-
recipient's actions in connection with the performance of
this contract on the Subrecipient's premises; and from
any and all claims and losses accruing or resulting to any
person, Firm or Corporation who may be impaired or damaged
by the Subrecipient's actions in connection with the
performance of this contract on the Subrecipient's
premises. Such indemnity shall include, but not necessarily
be limited to, attorney fees and administrative costs.
D. Stipulations
1. All powers not explicitly vested in Subrecipient
remain with the Recipient.
(as identified in Exhibit A-1) with due compensation for
said services as specialized in Section I. B-3. This •
contract in no way affects performance objectives contained
in any other contractual agreements between Recipient and
Subrecipient.
3. The Subrecipient is bound to maintain Workmen's
Compensation insurance for staff funded under this agree-
ment.
III. RECORDS AND REPORTS
A. Financial Reporting Requirements
I. The Subrecipient must maintain such records as are
required by the Recipient to insure the integrity of
financial transactions, to evaluate the effectiveness of
program activities and to meet state requirements.
2. The Subrecipient shall record all costs incurred in
the discharge of this agreement on a monthly basis, on or
before the fifth business day of the subsequent month, in
the manner and format prescribed by the Recipient.
3. Upon termination of this agreement, the Subrecipient
will provide to the Recipient a Close-Out Package within
calendar days of the termination date.
4. The Subrecipient shall preserve and make available for
audit its records for a period of (3) years following the
date designated as the final accounting.
B. Program Reporting Requirements
1. The Subrecipient agrees to file appropriate program
reports with the Recipient on a timely basis. The time
frames to be adhered to are as follows:
a) Monthly reports are to be received by the program
supervisor by the fifth day of subsequent month;
Weekly reports are to be received by the program
supervisor by Tuesday of the subsequent week;
2. If a reporting discrepancy occurs, it is the responsibility
of the Subrecipient to provide adequate documentation to the
Recipient before a change will be affected. If this is not
done, the Recipient's statistics will be considered final.
IV. TERMINATION OF THE CONTRACT
A. The performance of work under this subagreement may be
terminated by the Recipient in whole or in part, whenever for
any reasons, the Recipient shall determine that such termination
is in the best • interest of the Recipient. Any such termination
shall be instituted by delivery to the Subrecipient a written
"Notice of Termination" specifying the extent to which per-
formance of the work under the Subagreement is terminated And
date on which such termination becomes effective. The sub-
agreement shall be equitably adjusted to compensate for such
termination and modified accordingly.
V. ASSURANCES AND CERTIFICATIONS
A. The SUBRECIPIENT assures and certifies that:
1. It will comply with all applicable terms and conditions
required by Michigan P.A. 100 of 1977 and any subsequent
revisions and amendments of the Act, as published.
2. The activities performed under this contract will not
result in the displacement of currently employed workers
or of laid-off workers Who desire to return to the company
or rruTt in the 7i7lbst',t111 c:mneuLlon
with work which would otherwise be performed or impair•
existing. contractual services.
3. It will comply with Title VI and VII of Civil
Rights Act of 1964 (P.L. 88-352), and, in accordance with
Title VI and VII of that Act, no person in the United
States shall on the grounds of race, color, sex or national
origin be excluded from participation in, be denied the
benefits of, or otherwise subjected to discrimination
under any program or activity for which Federal financial
assistance is received.
4. Funds under this contract shall not be utilized for
political purposes.
5. It shall comply with appropriate standard§ for health
and safety in work and training situations as established
through the Michigan Occupational Safety and Health Act
(MIOSHA)
6. It will provide workmen's compensation protection to
participants in on-the-job training, work experience, or
public service employment programs under the Act at the
same level and to the same extent as other employees of
the employer who are covered by a State or industry, work-
men's compensation statute, and provision of workmen's com-
pensation insurance or medical and accident insurance for
injury or disease resulting from the participation of those
individuals engaged in any program activity under this contract,
i.e. work experience, on-the-job training, public service
employment, classroom training, services to participants, and
other activities, where others similarly engaged are not
covered by an applicable workmen's compensation statute.
7, The program will, to the maximum extent feasible,
contribute to the occupational development and the employment
potential of individual participants.
. 8. The program participants shall be paid at a rate no less
than the highest of the following: 1) the minimum hourly
wage set but in Sec. 6 (a)(1) of the Fair Labor Standards Act
of 1938 as amended; 2) the State or local minimum wage for the
most nearly comparable covered employment; 3) the prevailing
rate of pay for persons employed in similar occupations by
the same employer; or 4) the minimum entrance rate or in-
experienced workers in the same occupation in the establish-
ments, or if the occupation is new to the establishment, the
prevailing entrance rate for the occupation among other
establishments in the community area, or any minimum rate
required by an applicable collective bargaining agreement.
9. A member of the Legislature of the State of Michigan,
an individual employed by the State, or member of their
immediate family shall not be admitted to any share or part
of this contract or to any benefit that may arise therefrom.
Participants may not be members of the immediate family of
program directors or staff or the officers, owners or
directors of organizations contracting under this program.

EXHIBIT A
Program Description
Michigan Youth Program (MYP) is a state-funded On-the-Job Training
activity. It is intended to provide eligible participants with
employment experience and skill development which will ultimately
lead to unsubsidized, permanent employment in the private or public
sector. All participants must be out-of-school, between the ages
of 16-24 inclusive, and of low-income families. The OJT activity is
provided by means of a subsidy to participating employers, involving
a fixed-cost contract, designed to reimburse an employer for the
costs of training.
.Subrecipient Program Responsibilities:
1) To recruit, screen, determine eligibility and enroll 40
participants;
2) To develop 29 OJT training slots;
3) To follow-up on training contracts;
4) To coordinate all program activities (recruitment and job
development) with an MESC staff member, as designated by the
Recipient at the onset of this subagreement.
.5) To make available all supportive services currently provided
by the Sub-Recipient. This includes but not limited to
counseling.

Definitions
-Entered Employment: All terminations in which a participant enters
unsubsidized employment in the public or private sector following MYP
participation. This may be Direct or Indirect Placement.
Other Positive: Terminations in which a participant leaves an MYP
program for any of the following reasons:
1) to enter or return to a full-time academic or vocational
school
2) to enter another employment and training program (i.e. WIN,
Veterans, etc)
3) to enter a CETA-funded program
Other Terminations: All terminations which occur for any reason
other than those stipulated in "Entered Employment" or "Other
Positive." This includes,- but is not limited to the following:
• 1) laid off
2). transportation problems
3) administrative separation, etc.
'OJT: Training slot identified to train a participant in a bona-
fide skill or trade, after being hired by a private sector employer.
A contract is drawn up identifying the training activities, length
of training and extraordinary cost of training. All costs are re-
imbursed to the employer using the standard formula of 50% of
participant's wages. This OJT activity does not preclude a participant
who has been trained by one employer from being ultimately placed with
another employer.
