IN RE: 52nd DISTRICT COURT, 1st DIVISION AMENDMENT TO LEASE AGREEMENT WITH
THE CITY OF WALLED LAKE, MICHIGAN
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS by Miscellaneous Resolution 7177 dated July 10, 1975 and
Miscellaneous Resolution 8790 dated February 15, 1979, the County of Oakland
entered into lease agreements with the City of Wailed Lake for the purpose
of furnishing facilities for the 52nd District Court, 1st Division; and
WHEREAS said leases expired on June 30, 1980; and
WHEREAS the City of Walled Lake has notified the County of Oakland
they are not interested in continuing to furnish facilities for the District
Court; and
WHEREAS the County of Oakland is in the process of obtaining new
facilities for the District Court which is scheduled to be available for
March of 1981; and
WHEREAS the City of Walled Lake desires to amend the terms and conditions
of the lease ending on June 30, 1980 on a month-to-month basis at a cost of
$2,132.48.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners
hereby authorizes the Chairperson of the Oakland County Board of Commissioners
to execute the necessary documents to amend the lease agreements between the
County of Oakland and the City of Walled Lake for the 52nd District Court,
1st Division facilities on a month-to-month basis at a cost of $2,132.48 per
month.
BE IT FURTHER RESOLVED if no concrete action has been taken by the
County to assure a timely move of the Court from the City facilities by
October 1, 1980, the County and the City will enter into negotiating a new
rental figure based on the situation then prevailing.
Mr. Chairperson, on behalf of the Planning and Building Committee, I
move the adoption of the foregoing resolution.
