IN RE: JAIL STUDY GRANT
The Finance Committee has reviewed said subject Jail Study Grant
and finds:
1) This is a grant, in coordination with the Jail Study Committee,
to gather statistics on the Jail population in order to identify specific
problem areas, define them and develop potential solutions to our jail
population,
2) This grant covers the period December 1, 1980 through November
30, 1981,
3) Total funding for this project is $30,989 of which $27,890 or
ninety percent (90%) is Federally funded through the American Justice
Institute and $3,099 or ten percent (10%) is County match funds (consistent
with the attached budget),
4) It is anticipated that this is a one time non-renewable grant that
will recommend changes to the current Jail operations. Such changes will
be examined upon completion of this study to determine any additional costs
or cost reductions. The County is under no obligation to institute any
changes developed by this study.
Mr. Chairperson, on behalf of the Finance Committee, I move the
acceptance of the foregoing report and the referral of the information
contained therein to the Public Services Committee in accordance with
Miscellaneous Resolution #8145, Revised Federal and State Grant Appli-
cation Procedures.

RE: JAIL STUDY GRANT

MR. CHAIRPERSON, LADIES AND GENTLEMEN:
WHEREAS, the Board of Commissioners, through its Public Services Committee,
established the Jail Study Sub-Committee to examine problems at the Jail; and
WHEREAS, precise definition of the Jail population in terms of charge,
sentence disposition, sex, length of stay, type of offense, etc., is essential to
:1 nation of potential problems at the Jail and resolution of those problems; and
WHEREAS, the American Justice Institute with LEAA funding has indicated financial
assistance may be available to aid in defining problems and suggesting solutions at
the Jail; and
WHEREAS, a grant in the amount of $30,989, covering the period from December 1,
1980, through November 30, 1981, has been developed to take advantage of potential
funding; and
WHEREAS, application for said funding would not obligate the County to iture
funding.
NOW THEREFORE BE IT RESOLVED the Board of Commissioners authorize the Jail Study
Grant application.
Mr. Chairperson, on behalf of the Public Services Committee, I move the adoption
of the foregoing resolution.

JAIL OVERCROWDING AND PRETRIAL DETAINEE PROGRAM
CONTRACT
THIS CONTRACT is made and entered into on the day of
1978, by and between AMERICAN JUSTICE INSTITUTE, THE NATIONAL PROGRAM COORDINATOR
County of Oakland
a governmental agency, herein referred to as "Contractor".
WITNESSET H:
WHEREAS, the LAW ENFORCEMENT ASSISTANCE ADMINISTRATION has established a project
to be known as the JAIL OVERCROWDING AND PRETRIAL DETAIiqEE PROGRAM, which has
as its objective to demonstrate that system-wide planning and policy makillgt
supported by an effective information system, can ease jail overcrowding and
excessive pretrial custody time; and
_WHEREAS, LEAA will select some twenty (20) communities in the United States
to participate in Phase I (Planning) of such a program; and
• WHEREAS, AMERICAN JUSTICE INSTITUTE has been selected by LELA to act as the
National Program Coordinator (NPC) of said program for the purposes of dire
supplying necessary and required guidance for planning, program implementation,
and information system development or modification, as required in each of the
selected twenty communities, and providing leadership to local jurisdictions
in analyzing their programs, considering alternative solutions, and determining
the course of action to follow in seeking to contain jail population, while
'improving the level of criminal justice services; and
herein referred to as "NPC", and
WHEREAS, County of Oakland , a selected guy-
ernmental agency, has agreed to participate in this program.

NOW, THEREFORE, the parties hereto, in consideration of the promises each to
the other herein set forth, agree as follows:
I- PURPOSE OF CONTRACT
It is the purpose of this Contract to cause local criminal justice officials
- - to enter into the task of analyzing the causes of loCal -jail overcr(7wding and
criminal case processing delays and to devise remedial plans and
which will reduce the incidence of such Jail Overcrowding and Court delay.
TO this end, NPC will act as the administrator and coordinator of such plans
and provide the funds needed by the Contractor to accomplish these objectives.

The term of this contract shall be from the date first written ve to
Novetber 30, 1981 , or such further extension of time as shall be mutually
agreed upon by the parties in writing.
III- PROMISES OF CONTRACTOR
A. To diligently perform in a timely manner, on behalf of its governmental
jurisdiction, the tasks outlined and described in:
1) the NPC Project Narrative and,
2) thoe'e tasks set forth in Contractor's Statement of Work submitted to

LEAA and attached hereto and marked as "Exhibit B".
The said Project Narrative and the Contractor's Statement of Work are attached
hereto and incorporated herein as though fully set_forth.
B. To-provide matching funds, in cash, in an amount equal to ten per cent
• (10%) Of the portion of funds actually expehded of the total budget herein
authorized in Section-IV, and to prepare a budget of all costs for the tasks

specified in subparagraph A above, which will delineate expenditures by
• category. The expenditures by Contractor shall be in accordance with said
budget. Prior written authorization of NPC will be required for transfer of
project funds between direct cost categories which, cumulatively, exceed 5% of
total project funds. The said budget shall be attached to this Contract,-
marked Exhibit "A",-and incorporated herein as though fully set forth, and
. subject to LEA and NPC approval..
C. Contractor certifies that it has read and is familiar with the provisions
and terms of the Project Narrative, dated the 15th day Of May, 1978, and en-
titled, "A Proposal Re: Jail Overcrowding and Pretrial Detainee Assistance",
and further, that it has read and is familiar with the Grant Manager Procurement
manual issued by the Law Enforcement Assistance Administration, under date of .
February 7th, 1973, including changes as of January 25th, 1974; and that it will
be bound by all of the terms and conditions of the said Project Narrative and
the said Grant Manager Procurement Manual, the same as if they were fully
set forth herein.
• D. Contractor will maintain a record in accordance with established N7C pro-
cedures, of all services rendered under the provisions of this Contract, as
- well as all expenditures. Monthly vouchers, on a form provided by NPC, will
be prepared and a copy thereof forwarded to NPC at the time of Contractor's
request for reimbursement. The said vouchers shall delineate by category as
set forth in the budget marked "Exhibit A", the expenditures incurred to achieve
the purposes of this Contract during the preceding thirty (30) day period of
operations, and be certified to by supervisory Personnel. Special designation
will be given to the expenditures for matched funds during the period.

All records described in the preceding paragraph will be retained by
Contractor and, if requested, made available for monitoring or audit by
representatives of IAA, the Comptroller General of the United States, N7C,
or any of its duly authorized representatives, for the nurpese of examining,
auditing, excerpting, and transcribing any directly pertine .t books, docu-

mehts, papers, and records of Contractor, involving transactions relating
to this contract. Such material and records shall be maintained by Contractor
for a period of three (3) years after the termination of this contract, or until
an audit is completed by the governing organizations, or any of them, and
questions arising therefrom are resolved, whichever is sooner.
F. To Prepare, in writing, monthly progress reports, and to forwarc7 the
to NPC, together with the monthly request for reimbursement. The report shall
be duly signed by the designated liaison officer of Contractor, and shall contain
the following items:
1 - = - A narrative report comParting the- task schedule as set fo-..;:th in b
Contractor's Statement of Work ("Exhibit") referenced in Section III,
Subparacraoh A, above, with the actual progress attained during the reporting _ _ _
period.
2. A narrative stateMent of problems encountered and plans proposed to
remedy these. n.n
IV- PROMISES OF NPC
UPon receipt of the proper monthly vouchers, submitted in accordance with Section
ITI, Subparagraph E herein, NPC will reimburse Cont -actor within thirty(30) days
. from receipt of voucher for expenditures up to $ 30.989 , less 10%.
V-- GENERAL CONDITIONS
A. Independent Contractor

It is agreed between the parties hereto that Contractor, and any agents or
employees thereof, in the performance of the terms of this Contract, are
acting in the capacity of independ'ent contractor, and that while Contractor
may have agents and employees in its performance of this contract, said
agents and employees are not the agents or employees of NBC.
B. Termination
This Contract may be terminated at any time, by American Justice Institute
(NPC) by the giving of thirty (30) days' written notice, in advance, of intention
to do so, to the other party. In the event of its termination, Contractor
shall be reimbursed for all work performed and all obligations incurred, in
accordance with the provisions of this ColILLacL, throla911 the effective date
of said termination, being thirty (30) days from the date of receipt of said notice.
C. Equal Opportunity
During the performance of this contract, contractor will comply with Executive Order
11246, entitled, "Equal Employment Opportunity", as amended by Executive Order
1137.5, and as supplemented in Department of Labor Regulations (41 CFR, Part 60),
and will not discriminate against any employee or applicant for employment
because of race, religion, color, sex or national origin. The contractor will take
• affirmative action to ensure that applicants are employed, and that employees are
treated, during employment, without regard to their race, religion, color, sex
or national origin. Such•action shall include, but not be limited to, the following:
employment upgrading, demOtion or transfer; recruitment or recruitment advertising;
layoff or termination; rates of pay of other forms of compensation; and selection
for training including apprenticeship.

D. Arbitration
Any controversy or claim by Contractor arising out of .or relating to this Contract,
or the breach thereof, shall be setled by arbitration in accordance with the -rules
of the American Arbitration Association, through its San Francisco Office, and
judgement upon the award rendered by the Arbitrator_may be entered in any
Court having jurisdiction thereof. It is understood that the Courts of the
State of California and the laws of the State of California shall govern the

interpretation of this Contract.
E. Assignment
It is agreed between the parties hereto that in the event Contractor shall assign
all or part of its obligations and rights hereunder, it shall, as a condition
precedent to the right to assign, include in the agreement of assignment the
-following conditions: _
The Assignee,shall certify that it has read and understands all the _
terms of this agreement and promises to be bound thereby to the-extent that_the
same-is relevant toits performance.-
(b) The Assignee shall certify that it is familiar with all of the provisions
and terms of the Project Narrative dated May 15, 1978, entitled "Jail Overcrowding
and Pretrial Detainee Program", and further that it is familiar with the Grant
Manager Procurement Manual issued by the Law Enforcement Assistance Administration
under date of February 7th, 1973, including changes as of January 25th, 1974,
and that it will be bound by all of the terms and conditions of said Project
Narrative and the said Grant Manager Procurement Manual as the same are relevant
to the Assignee's performance.

F. LEAA Approval
Both parties understand and agree that this Contractis without any force
effect, and totally null and void, until and unless the same has been approved,
as to form and content, by the duly authorized agent of LEAA.
