HOOT, CHAIRMAN IN RE: 1980 COOPERATIVE REIMBURSEMENT GRANT APPLICATION - PROSECUTOR TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairman, Ladies and Gentlemen: WHEREAS, the Public Services Committee has reviewed the Cooperative Reimbursement Grant Application - Prosecutors for 1980; and WHEREAS, this is the eighth year of a continuing grant; and WHEREAS, total funding for the 1980 grant is $540,323 of which $67,511 (12%) would be the County portion and $472,812 (88%) would be State funded, consistent with the attached schedule; and WHEREAS, the Public Services Committee recommends filing of said application. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the filing of the Cooperative Reimbursement Grant Application - Prosecutors. Hoot, Chairman, moves the adoption of the foregoing resolution. llenry W:\4,00t, Chairlian HERESY APPROVE THE FrIPEGOING RESOLUIrm REPORT TO THE PUBLIC SERVICES COMMITTEE BY: FINANCE COMMITTEE, DENNIS MURPHY, CHAIRPERSON IN RE: 1980 COOPERATIVE REIMBURSEMENT PROGRAM APPLICATION-PROSECUTOR'S OFFICE TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: The Finance Committee has reviewed the 1980 Cooperative Reimbursement Program Application - Prosecutor's Office and finds: 1) This is the eighth year of a continuing grant for the purpose of establishing paternity for children receiving ADC, and investiga- ting and prosecuting cases of fraud directly related to child support, 2) This grant covers the period January 1, 1980 through December 31, 1980, 3) The total program request is $540,323, which is $108,058 or 25% greater than the 1979 program. Included in the $108,058 increase is $52,797 in salary adjustments for current positions, $33,189 in indirect costs, $15,840 in increased fringe benefit costs and $6,232 in increased operating costs, 4) Of the $540,323 requested, $472,812 or 88% would be State funds and $67,511 or 12% will be County funds; consisting of $48,265 in salaries, $8,850 in operating costs funded in the Prosecutor's 1980 Budget and $10,396 in indirect costs for the County funded positions. A complete cost breakdown is provided in the attached schedule. The Finance Committee, by Dennis Murphy, Chairperson, recommends acceptance of the foregoing report and referral of the information contained therein to the Public Services Committee in accordance with Miscellaneous Resolution #8145, revised Federal and State Grant Application Procedures. (2) These positions are currently Assistant Prosecutor Ilts but a request is pending to reclassify them as A.P.A. Ill's. (3) The Clerk III classification replaces the prior Technical Support Clerk classification. The application includes funds to reclassify a Typist II to a Clerk III. This request is pending with the Personnel Department. (4) The Counter Clerk was reclassified as a Clerk III. (5) Includes IBM Computer Terminal rental beginning in 1980, for $3,732. Telegraph Road Pontiac, Michigan 48053 PROG" PERSONNEL (List title, responsibilities, duties and employment prerequisites such as education, experience, etc.) (1) Chief of the Family Support Division Duties and Responsibilities: The Chief of the Family Support Division shall be an Assistant Prosecuting Attorney and shall be the supervisor of all legal, investigative, secretarial and clerical staff of the Family Support Division. He shall report directly to the Chief Assistant Prosecutor. He shall devote his full time to the Family Support Division, which has the responsibility of processing all complaints under the Family Support, URESA, Paternity, Emancipation of Minors Act, Criminal Non-Support Statutes and Federal Law P.L. 93-647. The Family Support Division also has the responsibility of processing all Welfare Fraud cases. He shall assign, direct, coordinate and review the work of division personnel. Under the general direction of the Prosecuting Attorney and Chief Assistant Prosecutor, he is expected to assume considerable responsibility and initiative in the performance of assigned duties, and within established department policies is responsible for work methods and procedures, being accountable generally only for results. This position shall be fully funded by the State. (2) Assistant Prosecutor HI Duties and Responsibilities: The Assistant Prosecutors III will be assigned to the Family Support Division on a full-time basis. They will assist the Division Chief in processing all cases which come within the jurisdiction of the Family Support Division. They shall be responsible for the bulk of Court appearances, case preparation, legal research and related duties as assigned by the Division Chief. Employment Prerequisites: All Assistant Prosecuting Attorneys in the Family Support Division must be persons with a law degree from an accredited law school who have passed the State Bar Examination and who are active members of the State Bar of Michigan. 5-319 (Rev 3 -73) Previous edition obsolete Page 2 of 7 ' PROGRAM PERSONNEL (Continued) (1) Executive Assistant Duties and Responsibilities: The Executive Assistant shall act as office manager for the Family Support Division and shall have administrative responsibilities for the development, improvement and maintenance of office operations and procedures. Under the supervision of the Chief Assistant Prosecutor and the Chief of the Family Support Division, she shall assign, direct, coordinate and review the work of the clerical staff. She shall supervise the procurement of necessary office equipment and supplies, and perform supportive duties relative to non-legal matters. She shall train, supervise and direct any persons working with the data processing system procured by the Family Support Division. This position will be fully funded by the County. (3) Prosecutor's Investigators Duties and Responsibilities: Three Prosecutor's Investigators are required to assist the Family Support Division of the Prosecuting Attorney's Office in performing the duties assigned to it. They will be responsible for service of process in all Family Support, URESA, Paternity and Emancipation of Minors actions when the defendant is in Oakland County. They will conduct fraud investigations on "father in the home" cases where child support and/or paternity is involved including, but not limited to, surveillance and execution of search and arrest warrants. Prosecutor's Investigators perform related duties as assigned, such as interviewing and transporting of parties for interviews, blood tests or court appearances in all support matters. These three positions will be fully funded by the State. (1) Para-Legal Duties and Responsibilities: The Para-Legal shall conduct initial screening of parties who desire to initiate child support action. Under the direction of the Division Chief, he shall interview parties and witnesses, conduct legal research and evaluate evidence. He shall assist in the development of cases for trial, negotiate settlement of child support matters within established departmental _guidelines and make recommendations to the Assistant Prosecuting Attorneys regarding case disposition. The Para-Legal shall perform related duties as assigned. This position will be fully funded by the State. Employment Prerequisites: The Para-Legal shall possess a certificate from an accredited college or university. (1) Legal Secretary Duties and Responsibilities: The Legal Secretary shall be responsible for the taking and transcribing of dictation from the attorneys employed in the Family Support Division. She shall be responsible for the preparation and processing of all motions, briefs, interrogatories, answers to motions, appeal briefs and other legal papers which are not standard forms, as related to the Family Support Division. She shall be responsible for the scheduling and maintaining of the appointment book for the entire legal staff. This position will be fully funded by the County. Page 3 of 7 PROGRAM PERSONNEL (Continued) (5) Clerk III Duties and Responsibilities: Employees of this classification have substantial contac its with clients, attorneys and other public agencies relative to all family support actions. Clerk III's initiate a variety of legal documents and review them for conformance with departmental regulations and procedures. They assist clients in the preparation of specialized documents and forms and interpret departmental regulations and procedures as they apply to individual support cases. Clerk IIPs also perform general clerical work such as typing correspondence, reports, records; screening telephone calls; maintain general office files; and perform other related duties as assigned. These positions will be fully funded by the State. (1) Typist II Duties and Responsibilities: The person in this classification provides clerical assistance to the Prosecutor's Investigators. Some duties handled by this person are maintenance of all records relating to the service of process, welfare fraud, typing correspondence, screening telephone calls, filing and general clerical duties as assigned. This position will be fully funded by the State. (1) Counter Clerk (Clerk HI) Duties and Responsibilities: The person in this classification acts as the receptionist for the Family Support Division, serving clients in many specialized clerical services. These services require immediate action. Duties include answering inquiries from clients and attorneys, screening telephone calls, verifying application forms, sorting mail, filing and general duties as assigned. This position will be fully funded by the State. Salary Increases That in recognition that the County is bound to pay the salary rates as established by the Board of Commissioners, said rate or rates established for any of the above personnel, therefore, including any raises, cost of living, fringe increases or step-increases which arise or may arise during the period of time covered by this contract are hereby authorized to be paid. Include how these services will be provided, where they will be provided and other pertinent facets of the program, use continuation sheets if necessary. Also refer to particular statutes to be used. The overall purpose of this program is to assist the Department of Social Services in all matters pertaining to welfare assistance. Personnel funded by this grant will be assigned full- time to the Family Support Division of the Prosecutor's Office which is responsible for all of the following types of proceedings: URESA, Family Support, Paternity, Emancipation of Minors, Welfare Fraud Complaints and Criminal Non-Support Cases. The Prosecutor's Office will actively carry out those provisions of P.L. 93-647 concerning the establishment of paternity and securing child support in cooperation with the Department, through the Office of Child Support (IV-D Agency) in an effort to shift the burden for the support of minor children back to those legally liable and financially able to do so. To that end, prompt representation will be given to the ADC recipient/applicant, or to the Department, where applicable, utilizing the various statutes including: Paternity, URESA, Family Support and Emancipation of Minors Act. Further, these same services will be available to the non-ADC recipient upon request, where permitted by law. The investigation and prosecution of fraud shall also be pursued, provided it is directly related to paternity and/or child support. The Prosecutor's Office shall submit reports as requested by the IV-D Agency concerning case activity in order to facilitate an assessment of progress of the program. The Department, through the Office of Child Support (IV-D Agency) shall provide the courts, prosecuting attorneys, and friends of the court with pertinent information needed in locating absent parents, establishing paternity and securing support, including the immediate transfer of information obtained under 45 CFR 235.70, to court or law enforcement officials; to the extent that such information is relevent to the duties to be performed pursuant to the agreement; and the County, through the offices of the Prosecuting Attorney and Friend of the Court, shall provide assistance to the IV-D Agency in carrying out the program.
