HomeMy WebLinkAboutResolutions - 1979.07.12 - 12340Miscellaneous Resolution # 9046 July 12, 1979 _ I Pa, A I 'en ""Ytt ia Hoot, Chairman PUBLIC SERVICES COMMITTEE APPROVE THE FC)PEGOING RESOWINDPIP BY PUBLIC SERVICES COMMITEE - Henry William Hoot, Chairman IN RE: ANIMAL CONTROL SERVICE AGREEMENT WITH OAKLAND TOWNSHIP TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Oakland Township citizens, particularly those who own farm animals, have experienced personal distress and financial loss by dogs running at large; and WHEREAS, many Oakland Township citizens have expressed their grave concern over the safety of their children with dogs running at large; and WHEREAS, Oakland Township Administrative Offices have received numerous telephone calls in regard to this problem; and WHEREAS, Oakland Township has requested the Oakland County Animal Control Division to provide additional service at township expense to its corporate townsnip limits. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners does hereby approve the supplemental Animal Control Services agreement with Oakland Township, as per the attached agreement and letter of understanding and that the Chairman of the Board be authorized to execute such agreement. The Public Services Committee, by Henry William Hoot, Chairman, moves the adoption of the foregoing resolution. AGREEMENT FOR ANIMAL CONTROL SERVICES THIS AGREEMENT made and entered into this by and between the COUNTY OF OAKLAND, through its Board of Commissioners and the Oakland County Animal Control Division, hereinafter referred to as "COUNTY", and the TOWNSHIP OF OAKLAND, hereinafter referred to as "TOWNSHIP". WITNESSETH: WHEREAS, the Township is desirous of contracting with the County for the performance of Animal Control functions within its corporate limits by the County; and WHEREAS, the County is agreeable to rendering such services on the terms and conditions as hereinafter set forth; NOW THEREFORE, IT IS AGREED AS FOLLOWS: 1. The County agrees to provide Animal Control protection within the corporate limits of the Township, said protection to consist of the enforcement of State statutes, including the writing of tickets therefore; for the purpose of performing such functions, the County shall furnish and supply one (REGULAR) Animal Control Officer, their supervision, equipment, communication facilities and other necessary supplies needed in order to perform such services, including all insurances, liability insurance and other protection or benefits of whatever nature. Notwithstanding anything heretofore contained, it is agreed that in all instances where special supplies, such as stationery, notices, forms, appearance tickets, and the like, needed to be executed in the name of the Township shall be required, they shall be supplied by the Township at its cost and expense. The County agrees to hold the Township harmless and defend it against any suit, claim, cause of action, etc., as the result of any act, and/or omission to act, on the part of the County or its Animal Control officer employees (Animal Control Officers) and/or agents while such Animal control officer employees and/or agents are under the control of the Oakland County Animal Control Division or its designated representative. ' 2. The standards of performance, the discipline of the Animal Control Officer(s) and other matters incident to the performance of such services and the control of the Animal Control officer(s) so, assigned to provide such service shall remain in the County; however, the standards of performance shall not be lower than that furnished another township of Oakland County, nor shall the caliber and the ability of the Animal Control Officer(s) supplied be lower than that furnished other townships in Oakland County. 3. The Township shall not be required to assume any liability for the direct payment of salaries, wages or other compensation to the County for any county personnel performing the services set forth in this document except as herein otherwise specified. 4. The Animal Control service to be provided by the County shall consist of furnishing one (1) (REGULAR) Animal Control officer(s) for one two-hour overtime shift each day for five (5) days or 10 hours per week. The commencement time of the shift is to be determined by the Township Supervisor as per letter of understanding. 5. The Township agrees to pay for such Animal Control services at a hourly rate of $16.37 per Animal Control officer for a total daily contract price of $32.74 totalling $163.70 per week. Billing shall commence on the date Animal Control officer(s) is assigned to the Township. 6. This agreement shall be effective July 16, 1979 and shall terminate August 10, 1979 per letter of understanding from Township Supervisor. 7. The service herein provided for shall be limited to the corporate limits of the Township. WITNESSES: OAKLAND COUNTY EXECUTIVE By: Daniel T. Animal Control Division Oakland County 1200 North Telegraph Road Pontiac, Michigan 48053 Attention: Mr. Carl Anderson Manager Subject: Exclusive Animal Patrol For Oakland Township Gentlemen: LETTER OF UNDERSTANDING As we have previously stated, we support your new graduated pick-up and impoundment fees for dogs caught running at large. We also recognize the difficulty of apprehending the offending animals when it is done in response to a telephone call. We believe that the adoption of this new graduated fee scale in the first of two important steps in resolving the problem of dogs running at large. The second step, is of course, the implementation of a concentrated and meaningful patrol by animal control officers. To this end, please accept this "Letter of Understanding" as our formal request that members of your staff be assigned to patrol specific areas of our Township on a regular basis for a four week period. Per our conversation, this exclusive extra effort would necessarily be on an overtime basis at a total hourly cost of $16.37 (covering all county costs). Initially, this extra effort should be limited to Township patrols from 6-8 A.M. (two hours prior to regular starting time) and 4:30-6:30 P.M. (two hours after regular stopping time) Monday through Friday for two consecutive weeks. This two week effort would then stop for two weeks, to obtain feedback, followed by a second two week effort, at the end of which this trial program would terminate. 101 5_19.78 Page 2 of 2 July 3, 1979 Mr. Carl Anderson Manager Since feedback is critical in evaluating the success of this trial program, please request that your officers document all animal pick-ups in addition to providing other significant information that will guide us in future efforts to discourage our dogs running at large problem. Please proceed with the implementation of this program as soon as possible using this 'Letter of Understanding" as your authority.
