IN RE: P.S.E. WAIVER REQUEST PROCEDURE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, the Oakland County Board of Commissioners by Miscellaneous
Resolution No. 6546 applied for and was granted the designation as Prime Sponsor by
the U.S. Department of Labor to administer the provisions of the Comprehensive Employment
and Training Act of 1973; and
WHEREAS, section 676.30 of the CETA Regulations allows Prime Sponsors to apply
to the Department of Labor for a temporary waiver of the 78 week limitation of participation
by P.S. E. participants in cases where severe hardship has been encountered in transitioning
these participants into unsubsidized employment; and
WHEREAS, tne Prime Sponsor needs to have a standardized procedure and timetable
to follow when requesting waivers from the U. S. Department of Labor; and
WHEREAS, the attacned procedure and timetable contains all of tne U.S. Department
of Labor's mandated criteria included in CETA Letter No. 79-62, their waiver application
package.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners
approve the attached waiver application procedure and timetable to be used when applying
for a waiver of the P.S. E. time limitations.
BE IT FURTHER RESOLVED tnat the Prime Sponsor solicit waiver request applications
from all P.S.E. subrecipients who desire waivers for those participants scheduled to be
terminated September 30, 1979 or during the first quarter of fiscal year 1980.
BE IT FURTHER RESOLVED that the Employment and Training Division compile a
waiver application package which takes into consideration the recommendations of the
subrecipients and present such application to tne Public Services Committee and the
Oakland County Board of Commissioners for approval prior to August 15, 1979.
The Public Services Committee, by Henry William Hoot, Chairman, moves the
adoption of the foregoing resolution.
TIMETABLE FOR PSE WAIVER PLAN
Day I Solicit all subrecipients to determine which subrecipients want to
apply for a waiver. The Prime Sponsor will compile a waiver applica-
tion package which will take into consideration the recommedations
of the subrecipients.
Day 10 Submit waiver application to all affected unions for their recom=-
mendations.
Day 10 Advertise in the newspaper that the waiver application is available
for public inspection and review.
Day 10 Present waiver application to the Planning Council for their recom-
mendations.
Day 20 Submit completed waiver application to the Public Service Committee
and Oakland County Board of Commissioners for their approval.
Day 30 Submit waiver application to the U.S. Department of Labor 60-90 days
prior to the first day of the quarter during which the participants
are expected to reach their 78 week limit of participation in P.S.E.
Day 60 The U.S. Department of Labor will notify the Prime Sponsor as to
waiver approval or disapproval.
Day 80 The Prime Sponsor will submit a list of participant names, job titles
and participant termination dates to the U.S. Department of Labor.
During each quarter a certain percentage of PSE participants for whom
waivers have been granted will have to be terminated from CETA. At
the end of the third quarter no more than 35% of those PSE participants
granted a waiver can remain on the CETA payroll. At the end of one
year all PSE participants granted a waiver must be terminated from CETA.
The Prime Sponsor will be submitting two (2) Waiver Request
Proposals to the Chicago Regional Office of the Department of
Labor. One will cover participants scheduled for termination
on September 30, 1979. The second Waiver Request Proposal will
cover those PSE Participants scheduled to be laid off between
October 1, 1979 and December 31, 1979.
Each Waiver Request Proposal will consist of:
A. a cover letter
B. the demonstration of need for a waiver
C. the transitional schedule
D. the recommendations of the Manpower Planning
Council and appropriate labor organizations.
The following pages delineate what information is necessary
in demonstrating the need for a waiver. Also included is the
suggested format for the transition schedule.
