Miscellaneous Resolution 9125 Date September 13, 1979

RE : P.S.E. Waiver Request - C.E.T.A. Titles II-D and VI
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS the Oakland County Board of Commissioners by Miscellaneous
Resolution NO. 6546 applied for and was granted the designation as Prime Sponsor
by the U.S. Department of Labor to administer the provisions of the Comprehensive
EMployment and Training Act of 1973; and
WHEREAS on August 9, 1979 the Oakland County Board of Commissioners by
Resolution No. 9097 approved the Prime Sponsor to submit a waiver application for P.S.E
participants in C.E.T.A. Titles II-D and VI to the U.S. Department of Labor for its
review and consideration for approval; and
WHEREAS the waiver request procedures were subsequently changed according
to C.E.T.A. Letter 79-88 which was received by the Prime Sponsor on August 20, 1979
(Attachment A); and
WHEREAS any modifications to the original request had to be received by
the Department of Labor no later than August 31, 1979 according to C.E.T.A. Letter
79-88; and
WHEREAS the City of POntiac requested that the portions of the original
waiver request that related to the City of Pbntiac be rewritten to correspond to the
new procedures (Attachment B); and
WHEREAS the time frame mandated by the U.S. Department of Labor did not
allow sufficient time for the modified waiver request to be reviewed by the Public
Services Committee and the Oakland County Board of Cbmmissioners before it was
submitted to the U.S. Department of Labor.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners
approve the modified waiver request as submitted to the U.S. Department of Labor.
RE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners
be and is hereby authorized to execute said application.
The Public Services Committee, by Henry William Hoot, Chairman, moves
the adoption of the foregoing resolution.
Attachment A
Original Waiver Procedures
No more than 35% of the participants covered by a waiver request may
remain employed after 9 months.
Revised Waiver Procedures
No more than 35% of the participants covered by a waiver request may
remain employed after 9 months except when:
A. The unemployment rate of an area exceeds 12%, the employment
growth rate for that area is generally lower than the
national average, and the Prime Sponsor can demonstrate that
it is experiencing severe difficulty in transitioning these
participants into unsubsidized employment. If all of these
conditions are met, up to 80% of the participants covered
by the waiver request of that area may remain employed for
9 months.
The City of Pontiac has an unemployment rate of 13.7%, an employment growth
rate below that of the national average, and is experiencing severe difficulty
in transit ioning its PSE participants into unsubsidized employment. Therefore,
the City of Pontiac meets the mandated requirements to retain up to 80% of its
total waiver population for up to 9 months.
Pontiac's initial waiver request indicated that approximately 35% of the
participants covered by the waiver would still be employed under CETA up to
9 months. The revised waiver request of the City of Pontiac indicates that
approximately 78% of its participants covered by the waiver request will still
be employed after 9 months.
