Mr. Chairman, Ladies and Gentlemen:
The Finance Committee has reviewed the 1978 Cooperative Reimbursement
Program Application-Prosecutor for the period of January 1, 1978 through
December 31, 1978. This is the sixth (6) year of a continuing grant for
the purpose of establishing paternity for children receiving ADC and
investigating cases of fraud directly related to child support.
The 1978 program of $395,551 is $162,956 or 70% greater than the 1977
program. Included in the $162,956 increase is $64,975 which represents
anticipated personnel classification changes and anticipated salary
increase for the current thirteen (13) positions. The second major
component of the cost increase is $39,834 for three (3) new positions in
this Program. It should be noted that the processing of this application
does not authorize the subject personnel classification changes, salary
increases or personnel increases, Each of these changes are subject to
review by the Board of Commissioners. The remaining increases in cost
are mainly due to the fact that the 1977 program was based on eleven (11)
months and the 1978 program request is based on twelve (12) months and
normal cost increases. A detailed cost breakdown is provided in the
attached schedule.
The County cash portion is $200 which is recommended in the 1978
Prosecutor Budget.
The Finance Committee recommends acceptance of the foregoing report
and referral of the information contained therein to the Public Services
Committee in accordance with Miscellaneous Resolution #8145, revised
Federal and State Grant Application Procedure,

Mr. Chairman , Ladies and Gentlemen:
WHEREAS; the Public Services Committee has reviewed the Cooperative
Reimbursement Grant-Prosecutors Grant Application for 1978; and
WHEREAS, this is the sixth year of a continuing grant; and
WHEREAS, total funding for the 1978 grant is $395,551 of which
$9,050 (2%) would be the County portion consisting of $8,850 soft match and
$2nn cash, and $386,501 (98%) would be State funded, consistent with the
attached schedule; and
WHEREAS, the Public Services Committee recommends filing of said
application.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board. of
Commissioners approves the filing of the Cooperative Reimbursement-Prosecutors
Grant Application.
The Public Services Committee, by Henry W. Hoot, Chairman, moves the
adoption of the foregoing resolution.

A) PROGRAM SUPERVISOR (List official title and address of the person who will set
personnel policies, appoint new employees and will, otherwise exercise supervisory
powers and duties.)

Employment Prerequisites: All Assistant Prosecuting Attorneys
in the Family Support Division must be persons with a law degree from
an accredited law school who have passed the State Bar Examination
and who are active members of the State Bar of Michigan.

PROGRAM PERSONNEL (List title, responsibilities, duties and employment
prerequisites such as education, experience, etc.)
(I) Chief of the Family Support Division
Duties and Responsibilities: The Chief of the Family- Support
Division shall be an Assistant Vrosecuting Attorney - and shall be the
supervisor of all legal, investigative, secretarial and clerical staff
of the Family Support Division. He shall report directly to the Chief
Assistant Prosecutor. He shall devote his full time to the Family
Support Division, which has the responsibility of processing all
complaints under the Family Support, URESA, Paternity -, Emancipation
of Minors Act, Criminal Non-.Support Statutes and Federal Law P.L. 93-
647. The Family Support Division also has the responsibility of proc-
essing all Welfare Fraud cases. He shall assign, direct, coordinate
and review the •work of division personnel. • Under the general directiol
of the Prosecuting Attorney and Chief Assistant Prosecutor, he. is• .•
expected to assume considerable responsibility and iniative in the
performance of assigned duties, and within established department
policies is responsible for work methods and procedures, being
accountable generally only for results. This position shall be fully
funded by the State.
(1) Assistant Prosecutor II (APA II)
(1) Assistant Prosecutor III (APA
Duties and Responsibilities: The Assistant Prosecutor3II and III
will be assigned to the Family Support Division on a full-time basis.
They will assist the Division Chief in proceSsing . all 'cases which.
come within the jurisdiction of the Family Support Division. They
shall be responsible for the bulk of Court appearances, case prepara-
tion, legal research, and related duties as assigned by the Division
Chief.
B. PROGRAM PERSONNEL (Continued)
(1) Executive Assistant
Duties and Responsibilities: The Executive Assistant
shall act as office manager for the Family Support Division
and shall have administrative responsibilities for the deve-
lopment, improvement and maintenance of office operations and
procedures. Under the supervision of the Chief Assistant
Prosecutor and the Chief of the Family Support Division, she
shall assign, direct, coordinate and review the work of the
clerical staff. She shall supervise the procurement of
necessary office equipment and supplies, and perform supportive
duties relative to non-legal matters. She shall train, super-
vise and direct any persons working with the data processing
system procured by the Family Support Division, This position
will be fully funded by the State.
(3) Prosecutor's Investigators
Duties and Responsibilities: Three Prosecutor's investi-
gators are required to assist the Family Support Division of
the Prosecuting Attorney's Office in performing the duties
assigned to it. They will be responsible for service of process
in all Family Support, URESA, Paternity and Emancipation of Minors
actions when the defendant is in Oakland County. They will con-
duct fraud investigations on "father in the home" cases where
child support and/or paternity is involved including, but not
limited to, surveillance and execution of search and arrest
warrants. Prosecutor's Investigators perform related duties as assigned
such as interviewing and transporting of parties for interviews,
blood tests or court appearances in all support matters, These
three positions will be fully funded by the State,
(1) Para-Legal
'Duties and Responsibilities: The Para-Legal shall conduct
initial screening of parties who desire to initiate child support
action. Under the direction of the Division Chief, he shall
interview parties and witnesses, conduct legal research and
evaluate evidence. He shall assist in the development of cases
for trial, negotiate settlement of child support. matters within
established departmental guidelines and make recommendations to
the Assistant Prosecuting Attorneys regarding case disposition.
The Para-Legal shall perform related duties as assigned. This
position shall be fully funded by the State.
Employment Prerequisites: The Para.-Legal shall possess a
certificate from an accredited college or universitys

(1) Legal Secretary
Duties and Responsibilities: The Legal Secretary shall be
responsible for the taking and transcribing of dictation from
the attorneys employed in the Family Support Division. She
shall be responsible for the preparation and processing of all
motions, briefs, interrogatories, answers to motions, appeal •
briefs and other legal papers, which are not standard forms, as
related to the Family Support Division She be responsible,
for the scheduling and maintaining the appointment book for the
entire legal staff. This position will be fully funded by the
State.
(5) Typist II
Duties and Responsibilities: The personnel in this classi-
fication are responsible for the bulk of the typing- that is
necessary in the Family Support This includes typing.
letters, legal documents for court filing and miscellaneous typing
as assigned. Other related duties include.- telephone screening,
processing the necessary paperwork involving Family Support, URESA,
Paternity, Emancipation of Minors, and general clerical duties as
assigned. These five positions will be fully funded by the State.
(2) Clerk II
Duties and Responsibilities: One Clerk II provides clerical
help to the Prosecutor's Investigators. Some duties handled by
this person are maintenance of all records relating to service of
process and welfare fraud as is related to paternity and/or child
support, screening of telephone calls, filing and the typing and
mailing of form letters as necessary.
One Clerk II shall act as receptionist for the Family . Support
Division. Duties include handling incoming clients, screening
telephone- calls, verifying application forms, sorting mail, filing
and. general clerical duties as assigned_
These two positions will be fully funded by the State. •
Salary Increases
That in recognition that the County is bound to pay the salary
rates as established by the Board of Commissioners, said rate or
rates established for any of the above personnel, therefore, includ-
ing any raises, cost of living, fringe increases or step-increases
which arise or may arise during the period of time covered by this
contract are hereby authorized to be paid.

PROGRAM FUNCTION (Describe the nature and extent of the expansion of present
services and the nature and extent of services created pursuant to the program.
Include how these services will be provided, where they will be provided and
other pertinent facets of the program, use continuation sheets if necessary.
Also refer to particular statutes to be used.
The overall purpose of this pro ,3rPill is to assist the Department
of Social Services in all matters pertaining to welfare assistance.
Personnel funded by this grant will be assigned full time to the
Family Support Division of the Prosecutor's Office which is respon-
sible for all of the following types of proceedings: URESA, Family
Support, Paternity, Emancipation of Minors, Welfare Fraud Complaints
and Criminal Non-Support Cases.
The Prosecutor's Office will actively carry out those provisions
of P.L. 93-647 concerning the establishment of paternity and securing
child support in cooperation with the Department, through the Office
of Central Registry (TV-D Agency) in an effort to shift the burden
for the support of minor children back to those legally liable and
financially able to do so.
To that end, prompt repre:sentatIon will be given to the ADC
recipient/applicant, or to the Department where applicable, utilizing
the various statutes including: Paternity, URESA, Family Support, and
Emancipation of Minors Act.
Further, these same services will he available to .the nonADC
recipient upon request, where permitted_by law. •
The investigation and prosecution of fraud shall also be pursued
provided it is directly related to paternity and/or child support.
The Prosecutor's Office shall submit reports as requested by the
IV-D Agency concerning case activity in order to facilitate an assess-
ment of progress of the program.
The Department, through the Office of Central Registry (IV-D
Agency) shall provide the courts, prosecuting attorneys, and friends
of the court with pertinent information needed in locating absent
parents, establishing paternity and securing support, including the
immediate transfer of information obtained under 45 CFR 235.70, to
court or law enforcement officials; to the extent that such informa-
tion is relevant to the duties to be performed pursuant to the agree-
ment; and the County through the offices of the Prosecuting Attorney
and Friend of the Court shall provide assistance to the IV-D Agency -
in carrying out the program.
