RE: SUPPORT OF HOUSE BILL 5799, FILLING OF VACANCY IN THE OFFICE OF COUNTY COMMISSIONER BY: GENERAL GOVERNMENT COMMITTEE - ROBERT W. PAGE, CHAIRMAN TO: OAKLAND COUNTY BOARD OF COMMISSIONERS MR. CHAIRMAN, LADIES AND GENTLEMEN: WHEREAS, House Bill 5799 seeks to amend section 12 of act 261 of the Public Acts of 1966 as follows; Sec. 12. When a vacancy occurs in the office of commissioner by death, resignation, removal from the district, or removal from office, the vacancy shall be filled by appointment within 30 days by the county board of commissioners of a resident and registered voter of that district. THE PERSON APPOINTED TO FILL A VACANCY WHICH OCCURRED IN AN (X)D NUMBERED YEAR SHALL SERVE UNTIL THE VACANCY IS FILLED IN A SPECIAL ELECTION. THAT SPECIAL ELECTION SHALL BE CALLED BY THE COUNTY BOARD OF COMMISSIONERS, THE PERSON APPOINTED TO FILL A VACANCY WHICH OCCURS IN A YEAR WHICH IS AN ELECTION YEAR FOR THE OFFICE OF COUNTY COMMISSIONER SHALL SERVE FOR THE REMAINDER OF THE UNEXPIRED TERM. IF THE COUNTY BOARD OF COMMISSIONERS DOES NOT FILL THE VACANCY BY APPOINTMENT WITHIN 30 DAYS, THAT VACANCY SHALL BE FILLED BY A SPECIAL ELECTION REGARDLESS OF WHETHER THE YEAR IS AN ELECTION YEAR OR AN ODD YEAR. \*:.IAS, the General Government Committee feels that the passage of this resolution is in the best interests of the citizens of Oakland County. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby goes on record urging the state legislature to adopt HB 5799 and directs that certified copies of this resolution be forwarded to the county's state legislator-, and Legislative Agent. The General Government Committee by Robert W. Page, Chairman, moves the adoption of the foregoing resolution. 8338 GENERAL GOV,E.SENT Riobert W. (21) NAYS: Doyon, Fortino, Price, Daly. (4) A sufficient majority having voted therefor, the motion carried. Moved by Page supported by Roth the resolution be adopted. Discussion followed.
