HomeMy WebLinkAboutResolutions - 1978.11.30 - 12902November 30, 1978 Miscellaneous Resolution 8716 Nov BY: PUBLIC SERVICES COMMITTEE - Henry William Hoot, Chairman IN RE: Approval of Pontiac Business Institute Budget Content and Performance Criteria for CETA Title III, HIRE II Program TO THE OAKLAND COUNTY BOARD GE COMISSICNERS: Mr. Chairman, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners by Miscellaneous Resolu- tion #6546 applied for and was granted the designation as Prime Sponsor by the U. S. Department of Labor to administer the provisions of the Comprehensive Employ- ment and Training Act of 1973; and WHEREAS the Employment and Training Division of Oakland County applied for and was granted total funding of $782,888 for the CETA Title III HIRE II Program for FY79; and WHEREAS this program is directed toward the placement of veterans into On-the-Job training programs within the private business sector; and WHEREAS the bidding announcement (Attachment A) was placed in the Oakland Press to solicit training institutions for the administration of said program; and WHEREAS Pontiac Business Institute was the only licensed training insti- tution to apply for and submit a bid (Attachment B); and WHEREAS Pontiac Business Institute, a private institution offering post secondary education for the past 85 years (Attachment C) would be awarded $59,068.67 for the administration of the HIRE II Program; and WHEREAS Pontiac Business Institute has submitted a budget (Attachment D); and WHEREAS the Employment and Training Division of Oakland County would sub- contract with Pontiac Business Institute for the following performance objectives during FY79 in accordance with HIRE II regulations: (1) Development of 185 training contracts with private sector business (2) Enrollment of 278 HIRE II eligible participants into those training contracts (Attachment E). NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approve awarding to Pontiac Business Institute the HIRE II contract administrative budget and the performance criteria as contained in Attachments B, C, D and E. The concentrated educational programs are geared to prepare students for gainful employment in the business community. PBI has served as a training site for Title I Classroom Training programs from 1976 through present day -. During that period, PBI has conducted approximately fifteen intensive training programs for CETA participants, ranging from General clerical skills to accountant trainees. As a result, these graduates have the necessary skills to secure employment, and therefore, become a productive member of the business community. STATEMENT OF PURPOSE - A. General 1. THIS contract, made and entered into by and between THE COUNTY OF OAKLAND, a constitutional corporation, hereinafter referred to as the CONTRACTOR, and PONTIAC BUSINESS 18 West Lawrence Pontiac, MI 48053 referred to as the SUBCONTRACTOR. 2. The Contractor has entered into a contract, said contract designated as Contract No 26 -7 -315 , with the Ur"- ' States Department of Labor to provide for the planning and delivery of -a , o, -ear services under its authority as a Prime Sponsor under the Comprehensive 'n loyment and Training Act of 1974 for the jurisdiction of OAKLAND COUNTY: and 3. COMPENSATION: That for the performance of functions or servicee rre'cr this agreement, and for the settlement of termination claims, the Centraatc ,r will reimburse the Sub-Contractor for the identifiable costs of Supportive ervices which are in addition to the basic services, if any, already provided under other arrangements in an amount not to exceed $59,068.67 contlent upon. receipt by the Contractor of the U.S. Department of Labor C.E.T.A. i .ends, set forth in the budget in Exhibit B to this contract. Costs incurred by the Soh- Contractor before October31, 1978 or after September 30, 1979 are not allowable. That Contractor, in accordance with the aforementioned, will be reimbursed for identifiable direct and indirect costs for services provided. That payment under this contract shall be made monthly to the Sub-Contractor by the Contractor upon receipt of the Sub-Contractor 's Peimhursement Request ryi d Cummulative Cost Categories as set forth in Exhibit D. II. GENERAL PROVISIONS A. Sub-contractor's compliance with applicable requirements 1. That the Subcontractor will abide by all applicable laws, ordinances, codes of Federal, State, or Local Governments and conditions imposed and required by any such contract between the Contractor and the United States Deper 4 of Labor, to be known as the prime c ntract, and further will abide by aL subse- quent revisions and modifications of the prime eentract, as publishee, to set forth administrative and statntorychanges impood on or by the United States Department of Labor. The Subcontractor agrees to perform as a Subcontractor and acknowledges that the Contractor is not free to divest responsibility for the performance or the quality of services called for by the prime contract That all powers not explicitly vested in the Subcontractor, by this contract, remain with the Contractor. B. Modifications- 1. All modificaions to this contract shall be in writing, Thac request from the Sub-Contractor for interpretations, modifications, or changes must be made in writing to the Contractor. 2. That the Sub-Contractor agrees to idemnify, defend and save harmless the Contractor, its officers, agents and employees from any and all claims and losses accruing, or resulting to the Sub-Contractor, as a result of the Sub- Contractor's actions in connection with the performance of this -; the Sub-Contractor's premises; and from any and all claims and losses zoc -re'.23or resulting to any person; firm or corporation who may be impaired or '----ed by the Sub-Contractor's actions in connection with the performance of thin contract on the Sub-Contractor's permises. Such indemnity shall include, but not neces- sarily be limited to, attorney fees and administrative costs. D. Equal Employment Opportunity Policy Statement 1. No person shall on the grounds of race, creed, color, handicap,nat'unal origin, sex, age, political affiliation, or beliefs, be discriminated -rain -- in regard to recruitment, enrollment, hiring, promotion, training, Loo - benefits, lay-offs, terminations, or other personnel actions relating te Prime Sponsor's programs or staff. All actions relating to the aforemen:i-- will be based only on individual qualifications. Failure of the Sub-Contractor to comply with the Prime Sponsor's EEO policy statement shall jeopardize future or continual funding under the CETA Act. All hiring and recruitment efforts for staff and CETA participants should encourage the achievement of the Contractor's target group objectives. E. Personnel Qualifications and Rates of Pay 1. That no employee under this subcont ract will be paid an amount in excess of per year under sub-agreement unless otherwise authorized in writing by the Contractor and all personnel assigned by the Sub-Contractor to work under this contract shall be qualified to perform the tasks as indicated in Exhibit C. 2. Notification of any termination or changes in personnel hired by the Sub- Contractor to work under this contractor shall be in writing. to. the Contractor. :re E. TERMINATIONS 1. General Assistance 1. The applicant assures and certifies that: (a) It will comply with the requirements of the Comprehensive Employment and Training Act (CETA) as amended, hereinafter referred to as the Act, and with the regulations and policies promulgated thereunder, and (b) It will comply with OMB Circular Numhar A-95 and Federal Management Circulars (FMC) 74-4 and 74-7 9 as applicable. 2. "Contracts Completed" - When an eligible trainee has been identified for a HIRE opening and is acceptable to the employer, and the Contract Pkg. has been assembled, submitted and approved, the Contract is considered Complete and then may be considered toward the performance goal levels. Indirect Placements: All participants who following HIRE II training and as a result of this, are able to secure unsubsidized full-time employment in the community. Entered Employment - All participants who, having been a participant in the HIRE Program, secure unsubsidized employment. This may be a result of HIRE training, but it is not a requirement. The employment can result directly from CETA services, indirectly from CETA services, or through the participant's own effort.
