Hobart, Chairperson IN RE: CITY OF TROY EASEMENT AGREEMENT AT OAKLAND/TROY AIRPORT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the County of Oakland has property in Troy, Michigan, known as the Oakland/Troy Airport; and WHEREAS the County is constructing T-hangars as part of the airport development; and WHEREAS the City of Troy requires an easement in order to supply water as part of this development; and WHEREAS the Airport Committee has reviewed and approved the easement request. NOW THEREFORE BE IT RESOLVED that the County of Oakland Board of Commissioners authorizes the Chairperson of the Board of Commissioners to execute an easement agreement with the City of Troy in consideration of One Dollar ($1.00) for an easement for the purpose of supplying water to a portion • of the Oakland/Troy Airport. Mr. Chairperson, on behalf of the Planning and Building Committee, I move the adoption of the foregoing resolution. OAKLAND/TROY AIRPORT TROY, MICHIGAN EASEMENT FOR WATERMAIN EXTENSION A 12-foot wide easement for a watermain, described as follows: Land in the North 1 of Section 32, town 2 north, range 11 east, City of Troy, Oakland County, Michigan, described as: Commencing at the North i corner of 7r-ct 32; thence along the section line South 89 degrees 53 minutes 40 seconds East 1333.55 feet; thence South 0 degrees 11 minutes 30 seconds West 2274.16 feet to the easterly extension of the North line of Birmingham Airport Subdivision No. 2 (liber 117, page 34 of Plats, Oakland County Records); thence along said line and the north line of Birmingham Airport Subdivision No. 1, (liber 112, page 38 of Plats, Oakland County Records), North 88 degrees 10 minutes 50 seconds West 1734.61 feet; to the point of beginning; thence North 88 degrees 10 minutes 50 seconds West 711.00 feet; thence North 0 degrees 01 minutes 00 seconds east 12 feet; thence South 88 degrees 10 minutes 50 seconds east 711.00 feet; thence south 0 degrees 01 minute 00 seconds west 12 feet to the point of beginning. CONTRACT FOR INSTALLATION OF MUNICIPAL IMPROVEMENTS ---KNOW-ALL-ME11-BY THESE PRESENTS: That the CITY OF TROY, a Michigan Municipal Corporation, of The County of Oakland, State of Michigan, hereinafter referred to as "CITY"' and __whose address-is- . . . and, whose telephone number is hereinafter referred to as "OWNERS". Said funds shall be placed on deposit with the CITY upon the execution of this contract and shall be disbursed to the contractor by the CITY only upon presentation of duly executed Waivers of Lien and sworn statements satisfactory to the CITY and after final inspection and approval by the Engineering Department for the CITY. In addition, the OWNERS agree to contribute the following cash fees: -.---- Plan Review and Construction Inspection fee $ _ Water Main Testing Fee - --- Total Cash Fees THIRD: " The OWNERS may contract for construction of said improvement or may have the CITY advertise for bids. In the event OWNERS select their own contractor,. such contractor shall be subject to prior-written approval by CITY and completed contract documents shall be submitted to the CITY. OWNERS agree to arrange for a PRE-CONSTRUCTION MEETING with the City Engineer and the contractor prior to start of work. All municipal improvements must be completely STAKED in the field under the direct supervision of a Registered Civil Engineer or Registered Land Surveyor according to the approved plans. # 82377 December 2, 1982 Moved by Hobart supported by Patterson the resolution be adopted.
