Gosling, Chairperson RE: SUDDEN INFANT DEATH SYNDROME (SIDS) REIMBURSEMENT AGREEMENT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, the Oakland County Health Division has in the past been contracted by the State Department of Health to compile data on Sudden infant Death Syndrome (SIDS); and WHEREAS, the State Department of Health wishes to continue this contracting; and WHEREAS, said contracting does not require additional staff or resources beyond that provided in the budget; and WHEREAS, reimbursement from said contracting is included in the budget; and WHEREAS, minor changes in services contracted which do not alter resources required or program levels significantly may be requested by the state during the life of the contract. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners does hereby authorize the County Executive to enter into the Sudden Infant Death Syndrome contract with the State in the amount of $8,500, per the attached agreement Mr. Chairperson, on behalf of the Health and Human Resources Committee, I move the adoption of the foregoing resolution. HEALTH & HUMAN RESOURCES COMMITTEE Marilynn ,L-'"Gosling, Chairperson , AGREEMENT BETWEEN MICHIGAN DEPARTMENT OF PUBLIC HEALTH AND THE OAKLAND COUNTY HEALTH DEPARTMENT PURPOSE To facilitate the establishment of the Sudden Infant Death Syndrome four (4) point program in the outstate areas of Michigan for the provision of counseling and auxiliary services to affected families in accordance with this agreement. OBJECTIVES The primary objectives of the SIDS program are: 1. To promote the prompt notification to parents of the results of autopsy when a sudden and unexpected death occurs in an infant. 2. To provide information and counseling to families and relatives of SIDS infants. 3. To promote supportive . groups and services for families of SIDS infants. METHODOLOGY AND PROGRAM CONTENT The program will be implemented by: 1. The provision of counseling visits by trained counselors to all SIDS families when desired by the family. 2. The establishment and maintenance with the local medical examiner to identify SIDS infants as early as possible. 3. The providing of information to parents and medical examiners regarding the availability of autopsy under Act 350. 4. The prompt notification of parents of the results of autopsy on the SIDS infant. RESPONSIBILITIES - LOCAL HEALTH DEPARTMENT The local health department, in accordance with the purpose, objectives and methodology to be employed in this agreement will: 1. Submit a plan which outlines the procedures to be followed to carry out the SIDS program. 2. Provide counselors trained in SIDS counseling to counsel SIDS families. 3. Provide the necessary administrative,professional, and technical assistance to assist in the local SIDS program. AGT•T,',1-NT CEThEEN MDPH AND OAKLAND COUNTY HEALTH DEPARTMENT Page 2 4. Provide reports regarding the SIDS program as requested by the Department. 5. Submit copies of all subcontracts negotiated relating to SIDS for approval. 6.- Provide information and education to health and health related professionals and the general public regarding SIDS within the area of jurisdiction. . 7. Assure that all terms of the agreement will be appropriately adhered to; . and that records and detailed documentation for the project or program identified in this agreement will be maintained for a period of not less than three (3) years from the date of the submission of the final expenditure • report or until audit findings have been resolved. . RESPONSIBILITIES - MICHIGAN DEPARTMENT OF PUBLIC HEALTH The Michigan Department of Public Health, hereafter referred to as the Department under the terms of this- agreement will: 1. PrOvide payment in accordance with this agreement in an amount not to - exceed $8,500 based upon appropriate records,-reports and documentation requested by the Michigan Department of Public Health, 2. Assist.rin the development of local programs including provision of . • necessary administrative, professional, and technical staff assistance.' .3. Outline data required for evaluation and operation of the program and assist in identifying and securing data. 4. Provide any special reporting formats required of MPDH .for operation of the program. ASSURANCES In compliance with Title VI of the Civil Rights Act of 1964 and the Regulations of the U.S. Department of Health and Human Services issued thereunder, and Section 504 of the Rehabilitation Act of 1973, and the Rules of Michigan Civil Rights Commission: The agency assures that in carrying out this program no person shall be excluded from participation, denied any benefits, or subjected to discrimination on the basis of race, creed, age, color, national origin or anceStry, religion, sex, or marital status (except where bonafide occupational qualification exists). This policy of nondiscrimination shall also apply to otherwise qualified handicapped individuals. - 4 At7i7 L77NT EETW 77 N • MDPH AND OAKLAND COUNTY HEALTH DEPARTMENT Page 3 REPORTING PROCEDURES A program report will be required not later than thirty (30). days after the end of six (6) Months of the agreement (see attached sample) and no ° later than thirty (30) days after the termination of the agree ment.' PAYMENT Payment procedures subject to the availability of funds will be as follows: - 1. Fifty percent (50%) of the total agreement will be paid within thirty (30) days after the agreement is signed by both parties. 2. Twenty-five percent (25%) of the total amount will be paid at the end of six (6) months. 3. Twenty-five percent (25%) of the total amount will be paid upon successful completion of services specified in the agreement. AGREEMENT PERIOD This agreement is in full force and effect from October, 1, 1982 through September.30, 1983. This agreement may be terminated by either party by giving sixty (60) days written notice to the other party stating the reasons for termination and effective date or, upon the failure, of either party to carry out the terms of the agreement, by giving ten (10) days written notice stating cause and effective date. The Department may also terminate this agreement if the agency, or a subcontractor, manufacturer, or supplier or the agency is subsequently found to engage in unfair labor - practices. The Michigan Department of Labor pursuant to section 2 of Public Act 278 of 1980 shall determine those employers who are engaging in unfair labor practices.
