RE: Procedures for Sale of linbuildabla Lots and Parcels
TO: The Oakland County Board of Commissioners
Mr. Chairman, Ladies and Gentlemen:
WHEREAS, during the construction of sanitary sewer systems and/or
water supply systems, the County of Oakland acquired title to certain parcels
of land; and
WHEREAS, the County does not need to have title to these parcels and
feels the properties should be sold for the purpose of placing the properties
hack on the tax rolls, eliminating the County's liability of the parcels and the
continuing maintenance of the parcels; and
WHEREAS, your committee has reviewed the attached memorandum outlinind
the procedure which is to be followed for the sale of unbuildable parcels.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners approve these recommended procedures as part of Rule X-E,
"Rules for Or;kand County Board of Commissioners" and that the Property
Management Division be directed to implement these procedures for the sale of
unbuildable parcels.
Mr. Chairperson, on behalf of the Planning F, Building Committee, I move
the adoption of the .foreaoing resolution.

Recommended Variance to Rules for Oakland County Board of Commissioners
Rule X - Disposal of County Owned Property -Linbuildable Parcels of Land
The rules for the Oakland County Board of Commissioners outlines the function
of the Planning and Building Committee, Rule X-E. (See Attachment A) One of
the rules outlines the procedure which the County Executive and the Board of
Commissioners should follow in the sale of County owned property.
The Property Management Division recommends a variance be made to the rules in
regards to encumbered parcels of land. An encumbered parcel of land is a parcel
purchased by the County for the purpose of the construction of a sewer system and/or
water system. The use of the parcel has been decreased since the majority of the
property has an easement for the infrastructure. Its only real value is to the
adjacent property owners for expanded yard use, gardens, small garage, etc.
Therefore, the Property Management Division would like to make the following
recommendation in regards to the disposal of such properties in the best interest
of the County and the local community. The sale of the property would place it
back on the tax roll, eliminate the need for maintaining the property, cutting
of grass, and eliminate the liability to the County.
The Property Management Division recommends encumbered parcels be made as a private
sale to adjacent property owners. The Planning and Building Committee shall recommend
a resolution which shall contain:
1- Description of parcel
2. Limitation of use of property, easements, soil conditions, etc.
3. Property is an encumbered parcel (non-buildable)
4. Obtain two appraisals of parceirOn small parcels, have Property A/Igmt, do appraisals.
5. Condition of sale of parcel
a. Terms - cash or land contract
b. Maximum period of land contract - five years
c. Maximum interest of land contract of 11-%
d. 10% minimum down payment
e. Date to receive sealed bids f. Establish a minimurn price to cover costs
6. Identify names of adjacent property owners
7. If adjacent property owners are not interested in purchasing of said property,
that Property Management has the authority to advertise the property for public
sale.
The procedure Property Management Division shall follow are:
1. Notify adjacent property owners that the County is proposing to sell said parcel
and that the County is offering the property owners first option to purchase.
2. If the adjacent property owners are interested, Property Management will advise
them of all infoimation that County has in regards to said properties (easements
being retained, etc.)

3. Property Management Division will advise adjacent property owners that
the County will receive sealed bids on a specific date. If no bids are
received, the County will then advertise to the public for sealed bids.
4. Bids shall be opened at a public meeting (Planning and Building Committee).
5. Planning and Building Committee shall review all sealed bids and make their
recommendation for the disposal of the property to the full Oakland County
'Board of Commissioners,
6. The Board of Commissioners shall reject or adopt a resolution for the dis-
posal of the properties.
