As indicated therein, the Charter Amendment was approved with 3,329 votes for and 1,331 votes against. Said results were canvassed and certified as accurate by the Auburn Hills Board of Canvassers on Wednesday, the 6 th day of November, 2002. So as to provide you with a complete file for reference and recordkeeping, please find a copy of the Charter Amendment language, as well as the letters of approval from Governor Engler and George Elworth of the Attorney General's Office. I submit the above to you and the Secretary of State via Certified Mail and, pursuant to MCLA 117.24, will consider the subject Charter Amendment effective upon the receipted date of this submission. Taylor Legal Counsel to the Governor Dear Governor Engler: Re: City of Auburn Hills- charter amendment — section 4.8 (provides that city council vacancies shall be filled by council appointing that person who was the highest vote getter running for city council in last regular election that was not elected to council if the person can serve) You have referred to us for examination the above-indicated charter amendment adopted • by resolution of the Auburn Hills City Council at its meeting held on July 15, 2002. We have examined the proposed amendment in light of the Home Rule Cities Act, 1909 PA 279, MCL 117.1 et seq, and other applicable law, and recommend that you approve the same. We have examined the ballot language for the proposed amendment, and approve the same. It is noted that the proposed section 4.8 would not apply to vacancies created by recall elections. Vacancies created by recall elections are to be filled, according to section 3.15 of the city charter, in the manner prescribed by state law. The requirements for an election to fill a vacancy in a city office created by a recall election are set forth in section 971 of the Michigan Election Code, MCL 168.971.
