Mr. Chairperson, Ladies and Gentlemen:
The Personnel Committee, having reviewed Miscellaneous Resolution
#82057, reports with the recommendation that the resolution be adopted
with the following amendments necessary to its implementation:
1. A new unit, Southfield Satellite, be established in the
Animal Control Division;
2. One (1) budgeted Animal Control Officer position and
3. One (1) budgeted Animal Shelter Attendant position be
created within that unit.

Pursuant to Rule XI-C of this Board, the Finance Committee has reviewed
Miscellaneous Resolution #82057 and finds:
1) That one additional animal control officer position and one
additional animal shelter attendant position be established in
the Southfield Satellite Unit,
2) That this Contract shall be effective April 15, 1982 through
April 14, 1987, a period of five years, and renewable thereafter
at rates established by this Board consistent with terms of the
attached agreement which would recover 100% of costs incurred in
rendering services to the City of Southfield,
3) That the 1982 Animal Control Revenue Budget, for the period April

IN RE: TAKE OVER OF CITY OF SOUTHFIELD ANIMAL CONTROL
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS the Oakland County Animal Control Division administers the
provisions of P.A. 339 of 1919 as amended (the Dog Law), and
WHEREAS the City of Southfield is seeking animal control services on a five-
year agreement basis, and
WHEREAS the Oakland County Animal Control Division and the Department
of Management and Budget through a financial analysis have found that the Oakland
County Animal Control Division is in a position to accommodate the City of Southfield's
request, and
WHEREAS County and City officials have reached agreement with respect to
scope of services and compensation, and
WHEREAS the government of Oakland County would recover 100% of its costs
incurred in rendering services to the City of Southfield.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners approves the attached agreement for animal control services between the
County and the City of Southfield.
BE IT FURTHER RESOLVED that the County Executive and Chairman of the
Board are herewith authorized to sign the agreement on behalf of the County,
Mr. Chairperson, on behalf of the Public Services Committee, I move the
adoption of the foregoing resolution.
PUBLIC SERVICES COMMITTEE
AGREEMENT TO PROVIDE SERVICES
THIS AGREEMENT made and entered into this 10th day of may
1982, by and between the COUNTY OF OAKLAND, a Michigan Constitutional
Corporation, whose principal address is 1200 North Telegraph Road, Pontiac, Michigan
48053, hereinafter referred to as "COUNTY", and the CITY OF SOUTHFIELD, a Michigan
Municipal Corporation, whose principal address is 26000 Evergreen Road, Southfield,
Michigan 48076, hereinafter referred to as "CITY".
WHEREAS, it appears that it would be of mutual advantage to the CITY and
the COUNTY for the COUNTY to assume certain responsibilities under this Agreement to
assist in the enforcement of the animal laws and regulations of the State of Michigan,
those being P.A. 339 of 1919, as amended, and the selected provisions of the Ordinance of
the City of Southfield (refer to I.,E., pp. 2);
NOW THEREFORE, in consideration of the mutual covenants hereinafter set
forth, the parties agree as follows:
1. DUTIES ASSUMED BY THE COUNTY. The COUNTY agrees that it will,
during the term of this Agreement and any extensions thereof, perform the following
duties:
A. Provide animal control services within the corporate limits of the
City of Southfield consistent with the provisions of the laws of the State of Michigan,
specifically P.A. 339 of 1919, as amended, and consistent with the terms of the "Service
Profile", attached hereto as Exhibit A.
B. Provide proper food, water, shelter and humane care for all stray
animals impounded and such small animals as are brought to the CITY'S Animal Shelter by
residents of the CITY, until they are placed or otherwise humanely disposed of in
accordance with applicable laws consistent with the terms of this Agreement. Any
animals captured within the City of Southfield shall be held in the Southfield facility for
the full duration of the statutory holding period.
C. Write tickets for dogs and livestock running at large, impound stray
dogs and livestock, and remove dead animals from public highways.
D. Conduct bite investigations of persons bitten by small animals within
the City limits and provide proper food, water, shelter and humane care for any small
animal which is suspected of infection with rabies, quarantined or isolated for such period
of time as may be required by applicable law, attached hereto as Exhibit B.
E. Administer selective provisions of the CITY'S Animal Ordinance in
effect as of the date of execution of this Agreement, as attached hereto as Exhibit C.
F. Operate the CITY OF SOUTHFIELD'S Animal Shelter located at
25501 Clara Lane, Southfield, Michigan 48076, and maintain suitable office hours at that
Shelter for the convenience of the residents of the CITY and for the purpose of
transacting business in connection with the duties under this Agreement, and for the
purpose of receiving small animals and, consistent with the provisions of the ordinances of
the CITY for the redemption of impounded animals. The COUNTY will make every
reasonable effort to notify owners of identifiable impounded animals, by telephone or
mail, pursuant to the policies, practices and procedures of Oakland County's Animal
Control Division, attached hereto as Exhibit D.
G. Upon completion of the required holding period, stray small animals
become the property of the COUNTY and may be placed or disposed of according to law,
attached hereto as Exhibit E.
H. All dogs of required vaccination age, prior to release by the COUNTY
to residents of the CITY, shall have been vaccinated against rabies or have proof shown of
vaccination against rabies within the legally required time prior to being released. No dog
shall be released to a resident of the CITY until a County dog license has been obtained.
I. Provide for the sale of COUNTY dog licenses at the Shelter and issue
such licenses to the CITY'S designated officials which shall be deputized by the Oakland
County Treasurer. Sale of such licenses shall be consistent with the policies, practices
and procedures of the Oakland County Treasurer. Said license fees shall be those
established by the COUNTY pursuant to the Board of Commissioners Resolutions.
(Exhibit K).
3. Provide for the sale of COUNTY dog kennel licenses at the CITY
Animal Shelter and COUNTY Animal Care Center. Sale of such licenses shall be
consistent with the policies, practices and procedures of the Oakland County Treasurer.
Said kennel license fees shall be those established by the COUNTY pursuant to the Board
of Commissioners Resolutions.
K. Collect pick-up fees and impounding fees. Said fee schedules for
dogs within the corporate City limits shall be those established by the COUNTY pursuant
to the Board of Commissioners Resolutions.
L, Revenue from enforcement of the CITY'S Ordinances as set forth
above, together with license fees, kennel fees, impounding fees, vaccination fees,
veterinarian fees and the adoption of animals shall accrue to the COUNTY, whether
collected by the CITY or the COUNTY.
M. Accept and dispose of all small dead animals picked up by a resident
of the CITY and turned over to the COUNTY.

N. Indemnity and hold the CITY harmless and defend it against all
demands, claims, causes of action or judgements and from all expenses that may be
incurred in investigating or defending against the same, arising from any act, neglect or
omission on the part of the COUNTY, its agents or employees or agents are under the
control of the Oakland County Animal Division or its designated representative, pursuant
to the duties and terms of this Agreement.
O. Assume the responsibility for the direct payment of salaries, wages
or other compensation for County employees performing services as set forth in this
Agreement, except as otherwise specified.
P. The COUNTY shall be free to enter into similar contractual
agreements with other municipalities without obtaining approval from the CITY, so long
as such agreements do not impair performance of this Agreement by the COUNTY. In the
event the County or other municipalities, as a result of such other contractual
agreements, utilizes the Southfield Animal Shelter, the percentage cost of said utilization
shall be accounted for and applied so as to defray the costs of operation to the City. In
such event, the City must provide the County with quarterly statements detailing its
overhead costs for the Southfield Animal Shelter,
Q. The COUNTY may provide an Adoption program for all small animals
impounded at the Southfield Animal Shelter from the City of Southfield but not limited to
the City of Southfield.
II. DUTIES ASSUMED BY THE CITY. The CITY agrees that during the term
of this Agreement they will perform the following duties:
A. To provide in its entirety the present Southfield Animal Control
building rent free to the COUNTY for the period of this Agreement. The legal description
of said facility is attached hereto as Exhibit F. Included with the building, the CITY
agrees to provide the following:
1. Security for the building.
2. Keys for all locks.
3. Liability insurance to cover the building and any injury to citizens
while in the building. Said insurance is not to cover COUNTY employees.
4. Maintenance of said facility which includes, but is not limited to, the
office interior cleaning, maintenance of the exterior of the building, snow
removal, and grounds care.
5. Building repairs when necessary, both to the interior and exterior;
however, COUNTY has the right, at its own expense, to remodel the interior
without limitations and to remove, if necessary, the existing cages and replace

them with cages belonging to the COUNTY, and make any necessary alterations
to kennel areas including drains, etc.
6. The CITY will provide, free of charge, to the COUNTY the following
utilities for said facility: Heat, Lights, Gas, Water and Sewer. Further the
CITY will provide one (I) local telephone line.
7. The CITY will provide, free of charge, all cages and equipment
presently contained in the facility. An inventory list of all equipment and the
code or identification numbers for that equipment is attached hereto as Exhibit
G.
8, The CITY will provide, free of charge, the existing radio and
communications system which includes (I) base station and (2) mobile units.
B. Transfer, at no cost to the COUNTY, two (2) Animal Control vehicles, the
description of which is attached hereto as Exhibit H. The COUNTY has the right upon
transfer to alter said vehicles in any manner deemed necessary, which may include
changing identification logos which are currently on said vehicles, In regard to these
vehicles, and other Animal Control vehicles stationed at said facility, the CITY
additionally promises to:
1. Provide access to CITY-owned gas Dumps on a 24 hour per day, 7 day
per week basis, including holidays, to COUNTY Animal Control personnel.
2. Provide gasoline to COUNTY Animal Control vehicles at the same
fee per gallon basis as is uniformly charged to other city governmental
divisions.
3. Provide maintenance service for COUNTY Animal Control vehicles
stationed at said facility at the same rate basis as is charged to other city
governmental divisions.
C. Maintain its Animal Ordinance for the period of this Agreement and,
further, to consult with the COUNTY prior to initiating any changes in said Ordinance.
The CITY will provide adequate copies of its Ordinance to the COUNTY and to promptly
furnish the COUNTY with copies of all new ordinances, amendments or regulations.
D. Authorize for the limited purpose of enforcing the Animal Ordinance of
the CITY OF SOUTHFIELD, designated Animal Control Officers stationed to the
Southfield Animal Shelter,
E. Agree that this service Agreement shall be governed by the policies,
practices, fee schedules and operational procedures established by the Oakland County
Board of Commissioners and the Oakland County Division of Animal Control, as indicated
in the "Service Profile" attached hereto as Exhibit A.
F. The CITY understands that the provision of service above and beyond the
"Service Profile" provided by the COUNTY (attached hereto) and contained elsewhere in
this Agreement shall be at the option and expense of the CITY.
G. The Southfield Police Department shall be responsible for "after hours"
activities as specifically set forth in Exhibit! attached hereto.
H. Prior to and during the term of this Agreement, the CITY shall take
appropriate measures to publicize and inform its residents of this change in the service
provided, as well as changes in the levels of service.
I. The CITY shall provide the COUNTY with a complete list of its 1981 dog
census, including, but not limited to, the following information:
1. Owner's name and address.
2. License status: Date of issue and duration of license.
3. License number.
The CITY shall be responsible for a yearly dog census as per State Law
P.A. 339 of 1919 and have a goal of 70% licensed dogs by 1986. The information from the
yearly census shall be provided to the COUNTY.
3. The CITY shall agree that the COUNTY shall not be limited to use of the
shelter for the CITY animals but shall be able to use same as needed by the COUNTY for
animals impounded in its service area.
TERM OF AGREEMENT AND CONSIDERATION.
A. It is mutually agreed that the term of this Agreement shall be five (5)
years, said period commencing with the date of execution of this Agreement. Upon
completion of the term of this Agreement, the provisions thereof shall be subject to
review and renewal by written agreement of the parties, Failure by either party to
comply with the material provisions of this Agreement shall be deemed sufficient cause
for termination. Such notice of termination for failure to comply with the material
provisions of this Agreement shall be given in writing at least sixty (60) days prior to the
effective date of the termination. Either party may unilaterally terminate this
Agreement without cause or reason provided notice of such intended termination is given
in writing at least one-hundred twenty (120) days prior to the effective date of
termination.
B. It is mutually agreed that the revenue generated with respect to this
Agreement shall be distributed as follows:

1. Oakland County dog licenses and kennel licenses sold exclusively
within the corporate limits of the CITY and the revenue realized therefrom shall
accrue to the Oakland County Treasurer through the Oakland County Animal
Control Division, whether said license fees are collected by the COUNTY or the
CITY.
2. Revenue realized from veterinarian fees, vaccination fees, or
kennel fees shall accrue to the COUNTY.
3. Revenue generated from the adoption of animals shall accrue to
the COUNTY.
4. Revenue realized from District Court fines resulting from the
enforcement of selected provisions of Southfieid's Animal Ordinance by the
COUNTY shall be collected by the CITY and made payable to the COUNTY,
5. The CITY shall, on a quarterly basis, reimburse the COUNTY for
any operational losses incurred in rendering service to the CITY, based on
County standard billing procedures and support documentation, provided however
that receipts by the County of sums in excess of that amount necessary to make
the County whole shall be returned to the City by the County (See Exhibit J).

DEFINITIONS
"County" refers to the County of Oakland, a Michigan Constitutional Corporation.
"City" refers to the City of Southfield, a Michigan Municipal Corporation.
"Impounded Small Animals" means all dogs, cats, wildlife, rodents and all other animals
commonly kept as domestic pets which are impounded (strays) and confined at the
Southfield Animal Shelter by: (1) agents of animal control programs and/or (2) action of
residents of municipality under contract.
"Bite investigation" means any stray or owned animals from the City of Southfield"
service area requiring quarantine or observation by order of the Oakland County
Department of Health or his authorized representative,.
"Required holding period" shall be in accordance with the provisions of P.A., 1969, and any
subsequent amendments thereto, and P.A. 187, 1969.
"License fees" means those charges to the owner of a dog which are claimed at the
Animal Shelter in accordance with provisions of this contract.
"Impounding fees" means pick-up fees charges rendered to an owner upon his application
to reclaim an animal which, by action of a municipality, has been impounded. Such fees
shall be determined consistent with provisions of this contract.
"Veterinarian fees" include all revenue collected by medical duties performed by the
Oakland County consulting veterinarian.
"Pick-up fees" means impoundment fees charges rendered to an owner upon his application
to reclaim an animals which, by action of a municipality, has been picked up and
impounded. Such fees shall be determined consistent with provisions of this contract.
"Public Highways" means a main road or thoroughfare open to the use of the public or
community.

EXHIBIT A
SERVICES PROFILE
If Oakland County Animal Control assumes the responsibility of the City of Southfield
Animal Control, the following services will be provided in accordance with the State Dog
Law of 1919, Public Act 339, MCLA 287.261, et seq; MSA 12,511, et seq; as amended.
No additional ordinances will be enforced other than those so stated in the State Law PA
339,

R 325.40 RABIES ACT 146 - P.A. 1919
Reporting and placarding
Cases of rabies in humans and animals shall be reported.
Dog bites shall be reported.
No placard is required.
• All laboratories in Michigan making examinations of dogs or other animals for rabies
shall report the following data to the State Health Commissioner on the first day of
the month following the examination: kind of dog, name and address of owner of
dog, name and address of person submitting specimen, and date and results of
examination.
Cases and suspected cases
Whenever the body of a person having died of rabies, or a disease suspected of being
rabies, is autopsied, or whenever a body is autopsied following death which may be
attributed to administration of prophylactic rabies vaccine, the person making the
autopsy shall be responsible for immediately transferring a portion of the
hippocampus major and spinal cord to the Michigan Department of Health
Laboratories in Lansing for pathological examination and animal inoculation. A
history of the case shall accompany the specimen.
Dogs and other animals
Any dog, or other animal that has bitten a person shall be held in confinement for a
period of at least ten days from the date the person was bitten. If the animal dies
during the period of confinement, the head shall be sent to a laboratory for
examination for evidence of rabies.

ORDINANCES - CHAPTER 113 - ANIMALS
9.61 Cruelty to Animals. No person shall cruelly treat or abuse any animal or
bird. (Act 70 of 1877)
9.62 Poisoning Animals. No person shall throw or deposit any poisonous substance
on any exposed public or private place where it endangers, or is likely to endanger, any
animal or bird. (Act 70 of 1877)
9.68 Sick or Dead Animals. It shall be unlawful for any person to deposit, throw or
place any dead or fatally sick or injured animal, or part thereof, on any public or private
place, or into or on the banks of any stream, lake, pond, sewer or other body of water. All
vehicles or trucks conveying dead animals shall be properly enclosed or covered with
suitable tarpaulin. (Act 339 of P.A. 1919)
ORDINANCES - CHAPTER 113- DOGS
9.81 Definitions. The following terms when used in this Chapter shall have the
meanings set forth in this section:
(1) "Dog" shall mean any dog, whether male, female, or unsexed.
(2) The work "owner" when applied to the proprietorship of a dog shall include
every person having a right of property in such dog, and every person who
keeps or harbors such dog or has it in his care, and every person who permits
such dog to remain in or about any premises occupied by him for a period of
five (5) or more days. (Act 339 of P.A. 1919)
* (3) "Reasonable control". For the purpose of this Chapter, a dog shall be deemed
to be under "reasonable control" when said dog is on leash, in an enclosed vehicle or
container, or with the owner, or some member of the owner's family, or some other
person with the permission of the owner, provided said dog is amenable to orders and
commands of the person in charge thereof. (Act 339 of P.A. 1919)
9.82 License Required. It shall be unlawful for any person to own, possess or
harbor any dog six (6) months old or over in the City of Southfield unless said dog is
licensed as hereinafter provided, or to own, harbor or possess any dog six (6) months old or
over that does not, at all times, wear a collar or harness with suitable tag attached as
hereinafter provided. Every person in possession of any dog who shall suffer such dog to
remain about his premises for the space of five (5) days, shall be deemed the owner
thereof. All dogs shall be immunized against rabies, prior to issuance of a license under
this Section. (Act 339 of P.A. 1919)
9.83 Kennel License. No person shall own or operate any dog kennel in the City of
Southfield without first having secured a license therefor. For purposes of this Chapter, a
kennel shall be construed as an establishment wherein or whereon three (3) or more dogs
are confined and kept for sale, boarding, breeding or training purposes, for remuneration,
and a kennel facility shall be so constructed as to prevent the public or stray dogs from
obtaining entrance thereto and gaining contact with dogs lodged in the kennel. Nothing in
this Chapter shall be deemed to permit the operation of a kennel in any district where
such use is not permitted under Chapter 45 (Zoning). (Act 339 of P.A. 1919)

* 9.85 Application. It shall be the duty of the owner of any dog, to file with the
City Clerk or designated agency on or before March first, an application for license,
setting forth the full name and address of the applicant, and such other information as is
required. A dog license shall not be issued unless the valid certificate of vaccination for
rabies indicates that rabies immunity is conferred to and including the date for which the
license is purchased. (Act 339 of P.A. 1919)

9.87 Applications After March First. Any person becoming the owner after the
first day of March of any year hereafter, of any dog six (6) months old or over which has
not already been licensed or any person owning a dog which becomes six (6) months old
after the first day of January of any year hereafter, shall forthwith apply for and secure a
license for such dog, which license shall be issued without penalty, in the event the
application be made within thirty (30) days after applicant has acquired such dog, or after
such dog has reached the age of six (6) months. (Act 339 of P.A. 1919)
* 9.88 Issuance of Dog License. Upon receipt of such application, together with the
certificate of immunization, and the license fees above provided, the clerk shall issue to
the applicant, a license for such dog for the calendar year and at the same time, shall
deliver to the applicant a suitable tag which shall be dated as to year, and bear a serial
number, together with the word "Oakland County", and such serial number shall be
inscribed upon the license so issued. Such tag shall be attached to the collar or harness
upon the dog for which the same is issued, and shall be worn by such at all times, and no
person shall remove any license tag from any dog without the consent of the owner, or the
person to whom the license was issued. Such tag shall be non-transferable, and shall not
be used on the collar or harness of any dog other than that of the dog for which such tag
was issued. (Act 339 of P.A. 1919)
9.89 Application for Kennel License. Any person who shall keep or operate a
kennel shall, in lieu of the individual license require under this Chapter make application
to the City Clerk or his authorized agent for a kennel license, entitling he applicant to
keep or operate a kennel. Such application shall set forth the name and residence of
thereunder. Said application shall also state the purpose for which the kennel is to be
maintained, and such other information as may be requested by the City Clerk. (Act 339
of P.A. 1919)
* 9.90 License Fees for Kennel License. Established by Oakland County Board of

* 9.91 Issuance of Kennel License. Upon receipt of such application, and the license
fees herein provided, the Clerk or authorized agent shall issue a kennel license, setting
forth the maximum number of dogs which may be kept thereunder, and at the same time,
shall issue to the applicant a number of suitable tags equal to the number of dogs
authorized by such license, such tags to be the same and those herein otherwise provided.
Any dog in such kennel at any time, shall at all times, wear a collar or harness to which
such tags shall be affixed, and such tags shall be used for no dogs other than those in said
kennel.
9.92 Regulation of Kennels. Dogs in kennels shall not be taken therefrom for any
purpose, unless the same have been properly immunized, and have a kennel license
attached to a collar or harness on such dog, the same may be taken outside the limits of
the kennel temporarily, and on leash, or may be transported in enclosed conveyances
temporarily for purpose of breeding, trial, show or sale. (Act 339 of P.A. 1919)
* 9.93 Duty to Keep Control. It shall be unlawful for any owner of any dog to
permit said dog to go beyond the premises of such owner unless said dog is held properly
on leash, or for any owner to allow any dog to stray beyond his premises unless under
reasonable control of some person, or for any owner to allow his dog to leave his premises,
under any conditions, unless properly held by leash. (Act 339 of P.A. 1919)
* 9.94 Responsibility for Damages. Every owner of a dog shall be liable for damages
for any and all injuries to person or property caused by such dog, to be determined and
collected in appropriate civil proceedings, and noting in the Chapter contained shall be
construed to impose any liability upon the City of Southfield, its agents or employees, for
damages caused by such dog.

* 9.97 Confining Dogs for Observation. Any person who shall have in his or her
possession, a dog which has contracted rabies, or which has been subjected to the same, or
which is suspected of having rabies, or which has bitten any person, shall upon the demand
of the Oakland County Health Department or its authorized agent, produce and surrender
up such dog to said agency, to be held in the City Dog Pound for treatment and
observation, for a period of ten (10) days. In lieu of delivering up such dog, as aforesaid,
such person shall have the option of delivering such dog to an accredited veterinarian,
there to be held for treatment and observation for such ten (10) day period, and shall
furnish to the authorized agency, written evidence that said dog has been so delivered.
The owner shalt be liable for the board of said dog as hereinafter provided for impounded
dogs. (Act 146 of 1919)
9.101 Impounding of Dogs. It shall be the duty of the Police Department of the
City of Southfield or its authorized agent, and every person employed by the City
Administrator for that purpose, to take up, seize and place in the Dog Pound, all dogs that
may be found running at large or being kept or harbored in any place, within the City of
Southfield contrary to the provisions of this Chapter, and to make reasonable attempt to
notify the owner of any licensed dog of the dog's presence in the Pound. (Act 139 of 1974)
* 9.102 Release of Dogs. No dog shall be released from the Pound, unless his owner
or authorized agent shall pay to the County of Oakland a fee as set forth by the
Oakland County Board of Commissioners Resolutions.
* 9.103 Unclaimed Dogs. All dogs not claimed and released in four (4) days, after
being impounded, shall be destroyed, or if the animal is deemed valuable, the same may be
adopted out by the County of Oakland, provided the said dog is properly immunized and
licensed at the cost of the purchases. Dogs impounded, having been exposed to rabies, or
any dog that has attached a person, shall be kept until such time and under such condition
as shall be required by the Oakland County Health Department. (Act 139 of 1974 and Act
146 of 1919)

AN ACT to amend section 8 of Act No. 224 of the Public Acts of 1969, entitled "An
act to license and regulate dealers in and research facilities using dogs and cats for
research purposes; and to repeal certain acts and parts of acts," as amended by Act No. 31
of the Public Acts of 1973, being section 287.388 of the Compiled Laws of 1970.
The People of the State of Michigan enact:
Section 1. Section 8 of Act No. 224 of the Public Acts of 1969, as amended by Act
No. 31 of the Public Acts of 1973, being section 287.388 of the Compiled Laws of 1970, is
amended to read as follows:
Sec. S. A dealer, a county, city, village, or township operating a dog pound or
animal shelter shall not sell or otherwise dispose of a dog or cat within 4 days after its
acquisition. If the dog or cat has a collar, license, or other evidence of ownership, the
operator of the pound or shelter shall notify the owner in writing and disposition of the
animal shall not be made within 7 days from the date of mailing the notice. Each
operator of a pound or shelter shall be required to maintain a record on each identifiable
dog or cat acquired, indicating a basic description of the animal, the date it was acquired
and under what circumstances. The record shall also indicate the date of notice sent to
the owner of an animal and subsequent disposition.
This section does not apply to animals which are sick or injured to the extent that
the holding period would cause undue suffering, or to animals whose owners request
immediate disposal.
This act is ordered to take immediate effect.

(I) Animal Control Offices @ one year step
(1) Animal Shelter Attendant
The A.C. Officer and Shelter Attendant are new positions. The
Shelter Attendant will be responsible for cleaning, handling
animals, and clerical tasks. This is a Public Service
Department assumption including city reimbursement for two
full-time positions.
Calculated at hourly OT rate for Animal Shelter Attendant for
cleaning of shelter on Holidays and weekends. Estimated two
and one-half OT hours per day (288 hours).
NOTE: Patrol overtime for Southfield Shelter is not included in
this analysis based on Animal Control Division assumption that
City of Southfield Police will handle all after-hours complaints.
Estimated fringe benefits for A) Regular Salaries, B) Overtime.
Anticipated expense for DVM @ 130 hours per year, one-half
for Southfield animals, one-half for County animals.
Estimated cost of disposing of animals (cats and dogs).
Estimated cost of telephone lines, monthly charges and
installation.
Estimated share of copy expense associated with Southfield

DECREASE Transportation costs will decrease based on capacity of Southfield Shelter
(35 cages) and the estimated number of trips between Southfield and Brown
Road.
INCREASE Results from operating and salary costs associated with Oakland County
operations originating from Southfield Shelter. Anticipate (2) South-
County patrol zones operating from Southfield Shelter. Transportation
costs from supervisory/supply trips from Brown Road to Southfield
partially offset transportation decrease
DESCRIPTION OF REVENUE DECREASE
DECREASE Southfield presently contracts with the County for animal disposal. The
disposal costs are included in the Southfield shelter budget and will be
included as a part of the estimated operational loss. The proposed
agreement will cause a reduction in Oakland County Animal Care Center
revenues.

The City of Southfield has agreed to the following Amendment:

A. It is mutually agreed that the term of this Agreement
shall be five (5) years, said period commencing with the date of
execution of this Agreement. Upon completion of the term of this
Agreement, the provisions thereof shall be subject to review and
renewal by written agreement of the parties. Failure by either
party to comply with the material provisions of this Agreement
shall be deemed sufficient cause for termination. Such notice of
termination for failure to comply with the material provisions
of this Agreement shall be given in writing at least sixty (60)
days prior to the effective date of the termination. Either party
may unilaterally terminate this Agreement without cause or reason
provided notice of such intended termination is given in writing
at least one-hundred twenty (120) days prior to the effective date
of termination.

IN RE: INCREASE THE DOG LICENSE FEE AND INCREASE THE AMOUNT RETAINED
BY CITIES AND TOWNSHIPS FOR DOG LICENSES ISSUED
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairman, Ladies and Gentlemen:
WHEREAS, city and township treasurers in Oakland County issued dog licenses and tags
from each December 1 to each March 1, incoopemtion with the County Treasurer and the Oakland
County Division of Animal Control, pursuant to Public Act 339 of 1919; and
WHEREAS, the cost to the county for damages to persons and property caused by dogs has
increased substantially in the past few years; and
WHEREAS, Oakland County has not revised the dog license fee in eight years; and
WHEREAS, the cities and townships retain fifteen cents ($.15) from the sale of each
three-dollar ($3.00) license; and
WHEREAS, this sum does not adequately compensate the city and township treasurers
for the time and effort spent by their offices in issuing said licenses and the Oakland County
Treasurers Association has urged that they be allowed to retain fifty cents ($.50) from the fee
for each license; and
WHEREAS, the Oakland County Treasurer supports that position of the local
treasurers; and
WHEREAS, Public Act 339 of 1919, as amended, allows the Board of Commissioners
in a county to set the amount of the dog license fee and to set the amount of each license
fee retained by cities and townships.
NOW THEREFORE BE IT RESOLVED, that the Oakland County Board of Commissioners
does hereby establish the dog license fee at four dollars ($4.00) effective December 1, 1978; and
BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners does hereby
set the amount to be retained by cities and townships for each dog license issued by cities and
townships at fifty cents ($.50), effect:ve December 1, 1978.

WHEREAS the Oakland County Board of Commissioners by
Miscellaneous Resolution #8698 established the standard County issued
dog license fee at four dollars ($4.00) effective December 1, 1978; and
WHEREAS the Oakland County Board of Commissioners delayed
action on changing the County issued delinquent dog license fee in
order to gather additional infolmation; and
WHEREAS such information has been prepared and the County
issued delinquent dog license fee period extends from March 1st
through November 30th; and
WHEREAS the cost to the County for damages to persons and
property caused by dogs has increased substantially in the past
few years; and
WHEREAS Public Act 339:f 1919, as amended, allows the
Board of Commissioners in a County to set the amount of both the
County issued standard and delinquent dog license fees and to set
the amount of each license fee retained by cities and townships.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board
of Commissioners does hereby establish the County issued delinquent
dog license fee at eight dollars ($8.00) effective March 1, 1979; and
BE IT FURTHER RESOLVED that the Oakland County Board of
Commissioners establish the fee to be retained by the Cities and
Townships authorized to sell such licenses by the County Treasurer
at one dollar ($1.00) from the sale of each eight dollar ($8.00)
County issued delinquent dog license, effective March 1, 1979.
