William Caddell, County Co IN RE: CONTRACT EXECUTION PROCEDURE POLICY To the Oakland County Board of Commissioners Mr. Chairperson, Ladies, and Gentlemen: WHEREAS it has come to the attention of the Oakland County Board of Com- missioners that grants, contracts, and extensions thereof are being entered into and executed by various County employees without the authority of the Board of Com- missioners; and WHEREAS it is not in the best interest of Oakland County for this practice to continue; and WHEREAS Act 139 of the Public Acts of 1973 provides in Sec. 6.(a) that the Board of County Commissioners may "establish policies to be followed by the govern- ment of the county in the conduct of its affairs and exercise all powers and duties vested in the boards of county commissioners not inconsistent with this act."; and (n) "adopt and enforce rules establishing and defining the authority, duties and responsibili- ties of county departments and offices." NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commis- sioners does hereby establish a uniform procedure and guideline for contracting with outside agencies to wit: All contracts, grants, and extensions thereof following approval by the Board of Commissioners shall be signed by the Chairman of the Board, or the Vice Chairman in his absence, unless the Board, by resolution, has designated another signator. Minor amendments to such executed documents which do not require additional county funds shall be signed by the Board Chairman, or the Vice Chairman his absence, following review by Civil Counsel and approval of the appropriate liaison committee. BE IT FURTHER RESOLVED that each grant or contract presented to the appro- priate standing committee of the Board of Commissioners contain a statement indicating that the same has been reviewed and approved as to form by the Office of Civil Counsel. BE IT FURTHER RESOLVED that except as may otherwise be provided by law, this procedure and guideline shall govern all contracts and grants, including any extensions thereof.
