HomeMy WebLinkAboutResolutions - 1982.07.01 - 13865Miscellaneous Resolution 82198 July 1, 1982 6-4„ BY: PLANNING AND BUILDING COMMITTEE IN RE: FAITH FOR MIRACLES MINISTRY RENTAL AGREEMENT - PARCEL #14-15-276-001 TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the Faith for Miracles Ministry has requested that the County of Oakland rent space to them at the Old 4-H Fair Grounds site for a tent revival meeting, being the southerly 350 feet of said parcel; and WHEREAS the space is available for this type of use and will generate income from said property; and WHEREAS an agreement has been prepared stating the rental fees, insurance coverages and the city ordinances that must be complied with together with other obligations of the licensee. NOW THEREFORE BE IT RESOLVED that the County of Oakland agrees to rent said property to the Faith for Miracles Ministry for the period of time and fees stated in the attached rental agrement. BE IT FURTHER RESOLVED that the Chairperson of the Oakland County Board of Commissioners be and is authorized to sign the rental agreement on behalf of Oakland County. Mr. Chairperson, on behalf of the Planning and Building Committee, I move the adoption of the foregoing resolution. 1 1-1ERFY APPROVE THE FOREGC ,,NG RESOLIJ RENTAL AGREEMENT This Agreement made this day of 1982, by and between, Faith For Miracles Ministry, whose address is 2900 East Grand Boulevard, Detroit, Michigan, 48202, and the County of Oakland, a Michigan Constitutional Corporation, whose address is 1200 North Telegraph Road, Pontiac, Michigan, 48053. WHEREAS, the Faith for Miracles Ministry is desirous of renting from the County of Oakland a certain parcel of real estate described as; the South 350, of Parcel #14-15-276- 001, T.3.N., R.10E., Section 15, Pontiac Township, that part of the East V2 of the Northeast V4 lying Easterly of the Easterly right-of-way line of M-24 Highway as now established. WHEREAS, the County of Oakland agrees to rent said property to the Faith for Miracles Ministry. NOW, THEREFORE, IT IS AGREED THAT: 1. The Faith for Miracles Ministry shall have the right to occupy said real estate for the period of August 6, 1982 through September 6, 1982. 2. The Faith for Miracles Ministry shall, as consideration, pay the County of Oakland a rental of one hundred ($100.00) Dollars per day, or a total for 32 days of three thousand two hundred ($3,200.00) dollars, paid 30 days in advance, by certified check, cash or bank money order. 3. The Faith for Miracles Ministry shall comply with all City of Pontiac Ordinances, taking special note of Section 422.D. 4. The Faith for Miracles Ministry shall provide their own security, and provide daily clean-up. 5. The Faith for Miracles Ministry shall provide for their own metered electricity from the local power company. 6. The Faith for Miracles Ministry agrees to save and hold harmless the County of Oakland and offer the defense of said County for any claims made against the County pursuant to the Faith of Miracles use of said property. 7. The Faith for Miracles Ministry shall provide comfort stations for persons attending this Ministry. 8. It is agreed between the parties that the entrance road is to be kept clear at all times for other necessary traffic. INSURANCE REQUIREMENTS It is expressly understood and agreed that the above described property is not leased to the Faith for Miracles, that no legal title or leasehold interest in the above-described premises or appurtenances thereto shall be deemed to, or construed to have been created or -1- vested in Faith for Miracles by anything contained herein; and that this agreement is conferred upon Faith for Miracles subject to and conditioned upon the fpilowing provisions: 1. INSURANCE REQUIREMENTS: The LICENSEE shall purchase, maintain and provide proof of insurance protection, from companies authorized to do business in Michigan, for claims set forth below in subparagraphs a. through f. which may arise out of or result from the Faith for Miracles Ministry operations on the aforementioned described property whether such operations be by the Faith for Miracles Ministry or any of its agents, employees, invitees or guests or by anyone for whose acts any of them may be liable. a. Worker's Compensation Insurance for claims under Michigan's Workers' Compensation Act or other similar employee benefit act of any other state applicable to an employee, along with Employer's Liability Insurance for claims for damages because of bodily injury, occupational sickness or disease or death of an employee when workers' compensation may not be an exclusive remedy, subject to a limit of liability of not less than $100,000 each accident b. Automobile Insurance as required by law for claims arising from ownership, maintenance or use of a motor vehicle. c. General Liability Insurance for claims of damages because of bodily injury or death of any person, other than the Licensee's employees, or damage to tangible property of others, including loss of use resulting therefrom, to the extent that such kinds of liability are ordinarily insurable under general liability insurance. Subject to bodily injury limits not less than $1,000,000 each occurrence and annual aggregate and property damage limit not less than $100,000 each occurrence, or combined bodily injury/property damage limits not less than $1,000,000 each occurrence and aggregate, including as additional insureds — County of Oakland. d. Contractual Liability Insurance for defense and settlement expenses that may arise from the LICENSEE'S assumption of liability on behalf of the LICENSOR under paragraph 2, to the extent that such kinds of contractual liability are insurable in connection with the subject to limits of liability not less than for general liability insurance set forth in subparagraph c, above. e. Medical Payments Insures, in conjunction with General Liability Insurance, to pay to or for any person, other than the LICENSEE'S employees, all reasonable medical expenses incurred within one year from the date of accidental bodily injury arising out of a condition in the LICENSEE'S premises or operations with respect to which the LICENSEE has general bodily injury liability insurance, and with limits not less than $200 per each person and $5,000 per each accident. 1. Food Products Liability Insurance for claims for damages because of bodily injury or death of any person on or off the property and other than the Faith for Miracles employees, from food products or other.
