September 9, 1982 BY: JAMES EDWARD LANNI, COUNTY COMMISSIONER, DISTRICT #11 RE: ADOPTION OF JAIL STUDY SUB-COMMITTEE PROGRAM OF IMPLEMENTATION TO REDUCE JAIL OVERCROWDING AND REQUEST FOR A SIX MONTH EXTENSION FROM FEDERAL COURT TO: THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, the County of Oakland is under Court Order to reduce the Jail inmate population; and WHEREAS, the Jail Study Sub-committee has established a Program of Implementation to Reduce the Jail Overcrowding so as to be in compliance with the inmate population aS established in the Federal Court Order; and WHEREAS, it is apparent from the Report of the Jail Study Sub- committee that additional time will be necessary in order to im- plement reduction of the inmate population at the Jail; and NOW THEREFORE BE IT RESOLVED, that the Beard of Commissioners adopt the Jail Study Sub-committee's Program of Implementation to Reduce Jail Overcrowding; and - BE IT FURTHER RESOLVED, that the Oakland County Board of Commissioners request from the Federal District Judge an additional six months in which to reduce inmate population at the Oakland County Jail so as to comply with the Federal Court Order. ITTEE AGENCIES District Court Circuit Court Prosecutor's Office Sheriff's Department District Court Circuit Court Reduce the length .of waiting time for Forensic Current average waiting time is 41.45 Center exams to no more than 30 days from the days; approximately 15 inmates per date of order. month or 7,452 jail days per year. (4) Transport state sentenced inmates upon sentencing to Jackson and related facilities within two (2) days, as required by MCL 800.48. Current average waiting time between sentencing and transport to Jackson is seven (7) days; approximately ten (10) inmates per week or 3,640 jail days per year. Return state sentenced writ inmates to . Jackson during the lour (4) week waiting period between end of trial and sentencing. (Following interview by probation officer in the County jail.) Writ inmates now wait an average of four (4) weeks in the County jail for sentencing before being returned to state facilities; an average of six (6) inmates per week or 9,360 jail days per year. waLOMMENDATIONS TO REDUCE JAIL OVERCROWDING - CELLBLOCKS JAIL STUDY SUBCOMMITTEE RECOMMENDATION CURRENT POLICY OR PROGRAM REDUCTION IN TERMS OF JAIL DAYS IF RECOMMENDATION WAS IMPLEMENTED/ADHERED TO (I) Reduce the length of time waiting time between bindover from District Court to Circuit Court, from an average of 14 days to within 2 to 8 days. (2) Identity and target low bond amount (under $500.00) inmates who have not met bond for bond review and/or to determine an acceptable payment alternative. Process now takes 14 days on average; approximately 30 jail inmates per week or 21,840 jail days per year. This program was begun in the Sheriff's Department in December, 1981 on a pilot basis but discontinued in March, 1982 when the student intern assigned to the project left; concerns approximately 10 inmates per week whose average stay is 13.5 days, or 7,020 jail days per year. Should an eight (8) clay average be attained the number of jail days would be reduced to 12,480 for this step of the process. Savings: 9,360 jail days per year. Should five (5) low bond amount inmates be identified per week and bonded out within an average of five (5) days the number of jail days would be reduced to 4,810. Savings: 2,210 jail days per year Should waiting -time be- reduced- to 30 days Forensic Center (State- the number of jail days would be reduced Department of Mental Health) to 5,400 for this step of the process. Sheriff's Department Savings: 2,052 jail days per year Should waiting time be reduced to two (2) Circuit Court clays the number of jail days would be Sheriff's Department reduced to 1,040 for this step of the process. Savings: 2,600 jail days per year Should writ inmates be interviewed by Probation and then moved back to Jackson Sheriff's Department or related facility within one (1) week, three (3) weeks waiting time in the County jail per writ inmate would be saved. A reduction in the number of jail days to 2,184 for this step of the process. :Savings: 7,176 jail days per year Probation Department JAIL STUDY SUBCOMMITTEE RECOMMENDATION AGENCIES Office of Substance Abuse Sheriff's Department RECOMMENDATIONS TO REDUCE JAIL OVERCROWDING - CELLBLOCKS CURRENT POLICY OR PROGRAM REDUCTION IN TERMS OF JAIL DAYS IF RECOMMENDATION WAS IMPLEMENTED/ADHERED TO ,.6) County participation in the Treatment Alternatives to Street Crime (TASC) grant - al ternative treatment placement for inmates with alcohol and related substance abuse offenses. Offenders with underlying alcohol and substance abuse problems for the most part are now sentenced to and treated in the jail; conservatively there are five (5) inmates per month who would be eligible for alternative treatment placement, or 5,100 jail days per year Should five (5) inmates per month be identified and placed in the TASC program within five (5) days of booking into the jail, the number of jail days would be reduced to 300 jail days per year for this group ' of inmates.
