McDonald, Chairperson IN RE: 1981 LABOR AGREEMENT FOR EMPLOYEES REPRESENTED BY THE OAKLAND COUNTY COURT REPORTERS ASSOCIATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS a labor agreement covering the Court Reporter III's of the Oakland County Circuit Court has been negotiated with the Oakland County Court Reporters Association; and WHEREAS a one (1) year agreement has been reached with the Association for the period January 1, 1981 through December 31, 1981, and said agreement has been reduced to writing; and WHEREAS your Personnel Committee has reviewed the agreement covering employees represented by the Association and recommends approval of the agreement; NOW THEREFORE BE IT RESOLVED that the agreement between the Oakland County Circuit Court, the County of Oakland, and the Oakland County Court Reporters Association be and the same is hereby approved, and that the Chairperson of this Board, on behalf of the County of Oakland, be and is hereby authorized to execute said agreement, a copy of which is attached hereto. AGREEMENT This Agreement is entered into between the Circuit Court for the Sixth Judicial Circuit of Michigan (hereinafter referred to as Employer) and the Oakland County Reporters Association (hereinafter referred to as Association). 1) PURPC7e7 - The general purpose of this Agreement is to set forth certain terms and conditions of employment. 2) RECOGNITION. - Pursuant to and in accordance with all applicable provisions of Act 379 of the Public Act of 1965, the Employer recognizes the Association as the sole and exclusive collective bargaining representative for all Circuit Court Stenographers. 3) RULES - During the period of this Agreement the members of the Association shall continue to enjoy the economic fringe benefits received by all County employees, including but not limited to annual leave, sick leave, death leave, hospitalization insurance, dental insurance, retirement pension, group life insurance, service increments, social security, and workman's compensation supplemantal pay and shall, throughout the term of this contract receive all other new fringe benefits, excluding general salary increases received by other County employees. 4) SALARY - For the duration of the Agreement the Circuit Court Reporter III's shall he paid a maximum flat annual salary of $24,450, and are not eligible for overtime compensation. At all times relevant hereto under this Agreement the members of the Association are subject to and shall be required to perform on, under, and subject to the instruction, direction, and control of the particular Judge employing the particular member. The members of the Association shall be available for work seven days a week, twenty-four hours a day, at the direction of the Judge by whom the particular member is employed. The Chief Judge shall have the right to hire and terminate the employment of the swing reporter. The swing reporter shall be assigned by - the Chief Judge to a particular Judge from time to time and once assigned, shall be under the direction and control of the Judge to whom he or she has been assigned as if employed by that Judge. 6)• LENGTH OF AGREEMENT - This Agreement is to be effective from January 1, 1981 to December 31, 1931. . FISCAL NOTE BY: FINANCE COMMITTEE, DENNIS MURPHY, CHAIRPERSON IN RE: MISCELLANEOUS RESOLUTION #81017 - 1981 LABOR AGREEMENT ON EMPLOYEES REPRESENTED BY THE OAKLAND COUNTY COURT REPORTERS ASSOCIATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: Pursuant to Rule XI-C of this Board, the Finance Committee has reviewed Miscellaneous Resolution 4E81017 and finds the proposed contract agreement covers a one year period-January 1, 1981 through December 31, 1981 at a total cost of $37,220, which covers fifteen (15) Court Recerter Positions. Further, the Finance Committee finds: 1) The amount of $29,760 is necessary to cover the 1981 nt and $7,460 for associated fringe benefits, 2) That the Finance Committee finds the amount of $29,760 available in the 1981 Salary Adjustment Account and $7,460 available in the 1981 Fringe Benefit Adjustment Account, 3) That the Board of Commissioners appropriates $29,760 from the 1981 Salary Adjustment Account and $7,460 from the 1981 Fringe Benefit Adjut ent Account and transfers said amounts to the appropriate unit within the 1981 Circuit Court budget as follows: Division Name Reserve Reserve Circuit Court Admin.
