Only jurisdictions whose elections are certified by the Oakland County Board of Canvassers should deliver envelopes #1 and #2, on Wednesday, November 5, by 9:00 AM to the Election Division. If your local Board of Canvassers is responsible for certification of your election results, forward a copy of the canvass to our office when it is completed. I am enclosing a copy of the memo from the Secretary of State, dated August 15, 2003, regarding the Post-Election Campaign Finance Compliance Statement which must be completed (see exceptions) by city candidates this year. If you have a local canvassing board you are responsible for sending this statement to your elected candidates. If the Oakland County Board of Canvassers canvasses your election, we will forward a copy to the elected candidates. All completed Post-Election Campaign Finance Compliance Statements must be filed with our office. If you have any questions, please contact Kim Noble, Election Specialist or me. The change will immediately impact candidates elected to city offices this year. Complete information on the changes effected under the amendment is provided in this memo. Please read carefully! House Bill 4522 was signed into law with immediate effect on July 29, 2003 (PA 119 of 2003). (The legislation can be accessed through the website maintained by the Michigan Legislature wwvv.michiLanlegislature.org .) The new law modifies the provisions of Michigan election law which govern the Post-Election Campaign Finance Compliance Statement filing requirement. The changes are detailed below: Filing Requirement Extended to Additional Candidates With the amendment, a candidate is now subject to the Post -Election Campaign Finance Compliance Statement filing requirement if he/she (1) is elected to office (2) is subject to the disclosure requirements of the Campaign Finance Act (i.e., required to file a Statement of Organization) and (3) received or expended over $1,000 during the election cycle. Prior to the enactment of the amendment, a candidate was subject to the Post-Election Campaign Finance Compliance Statement filing requirement if he/she (1) was elected to an office certified on the county or state level and (2) received or expended over $1,000 during the election cycle. In effect, this means that candidates elected to offices certified by a local canvassing board (as opposed to a county canvassing board or the Board of State Canvassers) who were formerly exempt from the Post-Election Campaign Finance Compliance Statement filing requirement are now subject to the filing requirement. This will immediately impact candidates elected on November 4, 2003 to city offices certified by city canvassing boards. BUREAU OF ELECTIONS MUTUAL BUILDING • 4TH FLOOR • 208 N.0 APITOL AVENUE • LANSING,M ICHIGAN 48918 www.Mic higan.govisos • (517) 373-2540 As before, the following candidates are exempt from the Post-Election Campaign Finance Compliance Statement filing requirement: (1) a candidate elected to the office of U.S. Senator or U.S. Representative in Congress (2) a candidate elected to a precinct delegate position and (3) a candidate who receives and expends less than $1,000.00 during the election cycle. Filing Official Changed for Certain State Legislative and Judicial Candidates With the amendment, all candidates subject to the Post-Election Campaign Finance Compliance Statement filing requirement are now required to submit the form to the officer responsible for receiving their campaign finance disclosure filings. Prior to the enactment of the amendment, candidates subject to the Post-Election Campaign Finance Compliance Statement filing requirement were required to submit the filing form to the county clerk if the office to which they were elected was certified on the county level. If the office to which they were elected was certified on the state level, the form was filed with the Secretary of State. In effect, this set up a situation where certain candidates were required to submit the Post- Election Campaign Finance Compliance Statement form on the county level despite the fact that they filed their campaign finance disclosure reports on the state level. These candidates included State House and State Senate candidates elected in districts wholly contained within a single county; candidates elected to the office of Probate Court Judge; and candidates elected to the office of Municipal Count Judge. With the amendment in place, the same official who received the candidate's campaign finance disclosure forms will always receive the candidate's Post- Election Campaign Finance Compliance Statement form (assuming that the candidate is not exempt from the Post-Election Campaign Finance Compliance Statement filing requirement.) Revised Form Enclosed A Post-Election Campaign Finance Compliance Statement form which has been revised to reflect the above changes in the governing laws is enclosed for your use. Information on the form changes are also being forwarded to the vendors in the state who market election forms. Please do not hesitate to contact this office if you have any questions. 2 -- POST-ELECTION CAMPAIGN FINANCE COMPLIANCE STATEMENT -- • This form must be filed by any candidate subject to Michigan's Campaign Finance Act who is elected to a state, county, city, township, village or school office. The form must be filed before the candidate assumes office. Exceptions: an elected candidate whose Candidate Committee did not receive or expend more than $1,000.00 during the election cycle is not required to submit this form. In addition, this form does not have to be filed by an individual elected to a U.S. Senate, U.S. House or precinct delegate position. • An elected candidate who is required to file a Post-Election Campaign Finance Compliance Statement must submit this form to the filing official designated to receive the elected candidate's campaign finance disclosure filings. • An elected candidate subject to the Post -Election Campaign Finance Compliance Statement filing requirement who fails to submit this form prior to assuming office is guilty of a misdemeanor. I swear (or affirm) that on this date, all statements, reports, error or omission notice responses, late filing fees and fines required of me or any Candidate Committee organized to support my election to office and registered under Michigan's Campaign Finance Act, PA 388 of 1976, have been filed or paid. I further acknowledge that making a false statement in this affidavit is perjury, punishable by a fine of up to $1,000.00 or imprisonment for up to 5 years, or both.
