B. 935, Veterans Burial Increase TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairman, Ladies and Gentlemen: WHEREAS, the Finance Committee has considered S.13.935 and recommended opposition to said bill; and WHEREAS, the Finance Committee referred their recommendation to the General Government Committee; and WHEREAS, your Committee has considered the proposed legislation contained in SB 935, which would provide payment and reimbursement of burial expenses of $300 by Counties for Honorably Discharged Members of the United States Armed Forces or their spouses who shall die not possessed of an estate, both real and personal, exceeding the sum of $35,000, over and above all encumbrances; and WHEREAS, your Committee recommends support of S. B. 935 as being in the best interest of the County's veteran citizens. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby support S. B. 935, and so recommends to the County Legislators. BE IT FURTHER RESOLVED that the County Legislators and County Legislative Agent be sent certified copies of the foregoing resolution. A bill to amend section 1 of Act No 235 of the Public Acts of 1911, entitled as amended "An act to provide for the payment and reinI7ursement by counties, in certain cases upon application therefor, of expenses incurred in the burial of the bodies of honorably discharged members of the armed forces of the United States, or their spouses, and to repeal certain acts or parts of acts," as amended by Act No. 99 of the Public Acts of 1974, being section 35.801 of the Compiled Laws of 1970. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Section 1. Section 1 of Act No. 235 of the Public Acts of 1911, as 2 amended by Act No. 99 of the Public Acts of 1974, being section 35.801 of the 3 Compiled Laws of 1970, is amended to read as follows: 4 Sec. 1. When an honorably discharged member of the armed forces of the 5 United States who served for a period of not less than 90 days of active 6 service, or who is discharged under honorable conditions after serving less 279• '75 2 / than 90 days of active service because of a service connected disability, during 2 a period of time in which the United States was at war or during the Vietnam 3 conflict, or the wife or widow of a member of the armed forces of the United 4 States, shall die not possessed of an estate, both real and personal, exceeding 5 the sum of 4-5-.-O-Q-- $35,000.00, over and above all encun-brances and was a 6 resident of the state at the 7 a period of 6 months prior to BEFORE entering the service or for a period of 8 5 years immediately 13-F4-e-F-4-e-- BEFORE his death, the county board of commissioners 9 or the board of county auditors, upon applicatione by the executor or 10 administrator of the estate of the deceased person, or by the person who 11 incurred or advanced expenses in connection with the burial of the honorably 12 discharged member of the armed forces, or the spouse of the honorably dischargel 13 member of the armed forces, shall pay to the estate of the deceased person, or 14 to the person who incurred or advanced the burial expense, the sum of $300,00. 1 5 If the investigation provided for in section 2 shows that the deceased left no 16 dependents surviving, but did leave an estate sufficient to meet lawful claims, 17 including burial expenses, then the county board of commissioners or the board 18 of county auditors shall not pay the expenses. The application shall he_ 1 9 submitted within 2 years 4t-AFTER the date of death of the deceased person 20 "Service", as used in this act, includes persons serving in the armed 21 forces of the United States in a place of emergency when ordered to -so serve 22 by the government of the United States, as defined in section 1 of Act No. 190 23 of the Public Acts of 1965, as amended, being section 35.61 of the Michigan 24 Compiled Laws, including the Vietnam conflict. 25 "Estate", as used in this section, means the ownership of realty or 26 personalty at the time of death, the title to which property was held either in 268 the sole name of the decedent or by the entireties, tenancy in common, or joint 27 tenancy with the spouse, child, or parent of the decedent. 2794 '75 time of his death and a resident of the state for #7372 Moved by Hoot supported by Simmons the resolution be adopted.
