HomeMy WebLinkAboutResolutions - 1981.02.05 - 14550C) 1003 February 5, 1931 MISCELLANEOUS RESOLUTION # BY: FINANCE COMMITTEE, DENNIS MURPHY, CHAIRPERSON IN RE: ACCEPTANCE OF JAIL STUDY GRANT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS Miscellaneous Resolution #8145 requires the Finance Committee to review acceptance of all grants that vary less than ten (10) percent from the grant application; and WHEREAS the Oakland County Board of Commissioners by Miscellaneous Resolution #9631 authorized application of the Jail Study Grant; and WHEREAS the subject grant covers a period of November 20, 1980 through September 30, 1981 and is in the amount of $30,989, the amount of the grant application; and WHEREAS of the $30,989, $27,890 (90%) is Federally funded and $3,099 is County funded; and WHEREAS the County is under no obligation to continue the program beyond the September 30, 1981 date or to institute any changed developed by the study. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accept the Jail Study Grant in the amount of $30,989 and that the Chairperson of the Board of Commissioners is duly authorized to execute said att:cd agreement. BE TT FURTHER RESOLVED that the Board of Commissioners appropriates $3,099, the County share, from the 1981 Federal Project Match Account to the Non-Departmental Jail Study Grant Account. THIS CONTRACT is made and entered into on the 20th day o f November LAW ENFORCEMENT ASSISTANCE ADMINISTRATION JAIL OVERCROWDING AND PRETRIAL DETAINEE PROGRAM CONTRACT 1978, by and between AMERICAN JUSTICE INSTITUTE, THE NATIONAL PROGRAM COORDINATOR, herein referred to as "NPC", and County of Oakland a governmental agency, herein referred to as "Contractor". WITNESSET H: WHEREAS, the LAW ENFORCEMENT ASSISTANCE ADMINISTRATION has established a project 0 be known as the GAIL OVERCROWDING AND PRETRIAL DETAINEE. PROGRAM, which has as its objective to fIemonstre.te that system-wide pJanning and policy making, supported by an effective information system, can ease jail overcrowd&Ilg and excessive pretrial custody timer and WHEREAS, LEAA will select some twenty (20) communities in the United States to participate in Phase I (Planning) of such a program; and WHEREAS, AMER/CAN JUSTICE INSTITUTE has been selected by LEAA to act as the National Program Coordinator (NPC) of said program for the purposes of directly supplying necessary z.x7xei required guidance for planning, program implementation, d'informatiom system development or modification, as required in each of the selected twenty communities, and providing leadership to local jurisdictions in analyzing their programs, considering alternative solutions, and determining the course of action to follow in seeking to contain jail Population, while improving the level of criminal justice services; and a selected gov- WHEREAS, Cc ,antv of Oakland •ernmental agency, has agreed to participate in this orogram. ° NOW, THEREFORE, the parties hereto, in consideration of the premises each to the other herein set forth, agree as follows: I- PURPOSE OF CONTRACT It is the purpose of this Contract to cause .local criminal justice officials to enter into the task of analyzing the causes of local jail overcrowding and criminal case processing delays and to devise remedial plans and procedures which will reduce the incidence of such Jail Overcrowding and Court delay. To this end, NPC will act as the administrator and coordinator of sucplans "id Provide the funds needed by the Contractor to accomplish these objectives. II- TERM The term of this contract shall be from the date first written above to September 30, 1981 or such further extension of time as shall be mutually agreed upon by the parties in writing. ITT- PROMISES OF CONTRACTOR A. 2lb diligently Perform in a timely manner, on behalf of its governmental jurisdiction, the tasks outlined and described in: 1) the NPC Project Narrative and, 2) thoe tasks set forth in Contractor's Statement of Work submitted to LEAP and attached hereto and marked as "Exhibit B.". The said Project Narrative and the Contractor's Statement of Work are attached hereto and incorporated herein as though fully set forth. B. To provide matching funds, in cash, in an amount ecual to ten per cent (10%) of the portion of funds actually expended of the total budget herein authorized in Section IV, and to prepare a budget of all costs for the taSks -2- _oecified in subparagraph A above, which will delineate expenditures by category. The expenditures by Contractor shall be in accordance with said budget. Prior written authorization of NPC will be recuired for transfer of project funds between direct cost categories which, cumulatively, exceed of total project funds. The said budget shall be attached to this Contract, marked Exhibit "A", and incorporated herein as though fully set forth, and subject to IFAA and NPC approval C. Contractor certifies that it has read and is familiar with the provisions and terms of the Project Narrative, dated the 15th day of May, 1978, and en-,. tied, "A Proposal Re: Jail Overcrowding and Pretrial Detainee Assistance", and further, that it has read and is familiar with the Grant Manager Procurement manual issued by the Law Enforcement Assistance Administration, under date of February 7th, 1973, including changes as of January 25th, 1974; and that it will be bound by all of the terms and conditions of the said Project Narrative and - the said Grant Manager Procurement Manual, the same as if they were fully • set forth herein. D. Contractor will maintain a record in accordance with established NPC pro- cedures, of all services rendered under the provisions of this Contract, as ,1 as all expenditures. Monthly vouchers, on a form provided by NPC, will be Prepared and a copy thereof forwarded to NPC at the time of Contractor's request for reimbursement. The said vouchers shall delineate by category as set forth in the budget marked "Exhibit A", the expenditures incurred to achieve the purposes of this Contract during the preceding thirty (30) day period of operations, and be certified to by supervisory personnel. Special des5gnation will be givcn to the expenditures for matched funds during the period. -3- - All records Contractor and, representatives described in if requested of LEAA, the the preceding paragraph will be retained by , made available for monitoring or audit by Comptroller General of the United States, Ni or any of its duly authorized representatives for the purpose of examining, auditing, excerpting, and transcribing any directly pertinent books, docu- ments, papers, and records of Contractor, involving transactions relating to this contract. Such material .and records shall be maintained by Contractor for a period of three (3) years after the termination of this contract, or until an audit is completed by the governing organizations, or any of them, all stions arising therefrom are resolved, whichever is sooner. F. To prepare, in writing, monthly progress reports, and to forward the same to NPC, together with the monthly request for reimbursement. The report shall - be duly signed by the designated liaison officer of Contractor, and shall contain . the following items: I, A narrative report comparing the task schedule as set forth in the Contractor's Statement of Work ("Exhibits") referenced in Section III, Subparagraph A, above, with the actual progress attained during the reporting -period- ° 2. A narrative statement of problems encountered and plans proposed to - redy these. - PROMISES OF NPC Upon receipt of the proper'monthly vouchers, submitted in accordance with Section III, Subparagraph E herein, NPC will reimburse Contractor within thirty (30) days from receipt of voucher for expenditures up to $ 30,989 , less 10%, GENERAL CONDITIONS A. Independent Contractor -4- is agreed between the parties hereto that Contractor, and any agents or employees thereof, in the performance of the terms of this Contract, are acting in the camacity of independent contractor, and that while Contractor may have agents and employees in its performance of this contract, said agents and employees are not the agents or employees of NPC. B. Termination This Contract may be terminated at any time, by American Justice Institute (NPC) by the giving of thirty (30) days written notice, in advance, of intention do so, to the other party. In the event of its termination, Contractor shall be reimbursed for all work performed and all obligations incurred, in accordance with the provisions of this Contract, through the effective date of said termination, being thirty (30) days from the date of receipt of said notice. C. Ecual 0mmortunit7 During the performance of this contract, contractor will comply with Executive Order 11246, entitled, "Equal Employmerit ()Importunity", as amended by Executive Order 11 -',75, -and as supplemented in Department of Labor Regulations (41 CFR, Part 60), and will -not discriminate against any employee. or applicant for employment -ause of race, religion, color, sex or national origin. The contractor will take en.]firmative action to ensure that applicants are employed, and that employees are treated, during employment, without regard to their race, religion, color, sex or national origin. Such-action shall include, but not be limited to, the following: employment upgrading, demOtion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay of other forms of compensation; and selection for training including apprenticeship. -5- D. Arbitration Any controversy or claim by Contractor arising out of or relating to this Contract, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, through its San Francisco Office, and judgement upon the award rendered by the Arbitrator may be entered in any Court having jurisdiction thereof. It is understood that the Courts of the State of California and the laws of the State of California shall govern the interpretation of this Contract. Assicnment It is agreed between the parties hereto that in the event Contractor shall assign all or part of its obligations and rights hereunder, it shall, as a condition precedent to the right to assign, include in the agreement of assig=2nt the following conditions: (a) The Assignee shall certify that it has read and understands all the terms of this agreement and promises to be bound thereby to the extent that the . - same is relevant to its performance. This has, already e been accomplished. The Jail Study Committee, a subcommittee of the Board of Commis- sioners' Public Services Committee, has held nine meetings since it was formed in late May. In order to ensure the cooperation cf the key agencies that impact the jail pop- ulation, representatives of the Circuit Court, District Courts, Prosecutor's Office, Probation, and local law enforcement agencies sit on the Committee together with rep- . resentatives of the Board of Commissioners, County Executive Office, and the Sheriff's Department. Staff for the Committee is provided through the Criminal. Justice Coordi- nating Council. The second task is to produce a description of the criminal justice process. This will consist of a flowchart and a narrative. The flowchart will delineate relevant decision points, options, and criteria that impact the jail population. The narrative t will identify the decision-makers involved in each criminal justice event/decision, the optional routes that the defendant can take at each decision point, and the policies/guidelines that determine which route through or out of the system the defendant will take. The flowchart and narrative will be review by the Jail Stuey, Committee ben complete and then submitted to MI. After the data collection effort concludes, the flowchart and narrative will be updated and system disposition trees prepared. The revised flowchart and narrative together with the system disposition trees will be used in developing Part III "Description of the Criminal Justice Process" of the Jail Population Management Plan. The third task is to collect and analyze appropriate descriptive, statistical, and fiscal information. Because it is very inefficient to collect data without a well- defined plan or purpose,' several weeks will be set aside for planning the data collec- tion and analysis effort. Hypotheses about the causes of jail overcrowding have been developed and specific questions to be answered through the data collection and analysis program are being generated. Specific data elements required to resolve each issue will be identified with concise definitions developed of each. All values of information that can be assumed by each data element will be listed. With the apuroval of the Jail Study Committee, the work will then be submitted to AJT for review. While awaiting the results of the AJI review, source documents will be iden- tified and outhorization obtained to access them. With on-site assistance from AJI, - the sampling design and data collection instrument(s) will be developed. Following approval by the Jail Study Committee, the sampling design and data collection instru- ent (s) will be submitted to MI for review. Meanwhile, steps to implement the data collection program will be initiated. Data collectors/coders will be hired and trained. The data collection instrument(s) will be validated. Inter-coder reliability will be verified. Descrepancies will be discussed and resolved before the actual data collection program begins. It is anticipated that the data collection effort will require four months to complete. A computer will be used to process the data. In order to meet the dead- lines that have been established, it will be necessary to collect and process the data simultaneously. With regards to the latter, the Statistical Package for the Social Science (SPSS) will be utilized, With the on-site technical assistance of AJI, the data will be interpreted in light of the original hypotheses and questions. -Policy and procedural options that can be explored as well as the potential impact of these options on jail overcrowding and the use of alternatives will be suggested. The options and their potential impact will be well documented and substantiated by the data for presentation to the Jail Study-Committee inea- readily comprehensible format to include, but not be limited to, - a written report.
