RES. #6968 - EMINENT DOMAIN TO ACQUIRE REFUSE DISPOSAL SYSTEM SITES TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairman, Ladies and Gentlemen: The Planning and Building Committee reports Miscellaneous Resolution #6968 with the recommendation that said resolution not be adopted for reasons that P.A. 185, Public Acts of 1957, as amended,does ealcontain provision for eminent domain. The Planning and Building Committee, by Patrick M, Nowak, Chairman, moves the acceptance of the foregoing report. PLANNING AND BUILDING COMMITTEE RESOLUTION NO. 6968 RE: EMINENT DOMAIN TO ACQUIRE REFUSE DISPOSAL SYSTEM SITES BY: LEW L. COY TO: THE OAKLAND COUNTY .-201) OF COMMISSIONERS MR. CHAIRMAN, LADIES AND GENTLEMEN: WHEREAS, Act 185 of the Public Acts of 1957, as amended, permits the County, acting by and through a county department of public works to acquire and operate refuse disposal systems; and WHEREAS, said Act 185 permits a county, acting by and through a county department of public works, to exercise the right of eminent domain to acquire refuse disposal system sites; and WHEREAS, the Oakland County Board of Commissioners believes that it should not exercise the right of eminent domain to acquire refuse disposal system sites. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby establishes the policy that the County of Oakland shall not exercise the right of eminent domain to acquire refuse disposal system facilities and sites.
