Dunleavy, Chairman IN RE: DECENTRALIZATION OF DISTRICT COURTS - 52ND DISTRICT COURT, 1ST DIVISION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairman, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners is responsible for the provision of court facilities and services In the 52nd District Court; and WHEREAS requests to decentralize the 52nd District Court operations have been received and reviewed; and WHEREAS these reviews have substantiated the feasibility for decentralizing the 52nd District Court, 1st Division; NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approve the decentralization of the 52nd District Court, 1st Division, on a one-year trial basis for a court location in Milford. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners hereby authorizes the County Executive to take the necessary actions for the immediate implementation of the decentralization of the 52nd District Court, 1st Division. The Public Services Committee, by James W. Dunleovy, Chairman, moves the adoption of the foregoing resolution. PUBLIC SERVICES COMMITTEE MISCELLANEOUS RESOLUTION #7096 - DECENTRALIZAT ON OF DISTRICT June 19, 1975 FISCAL NOTE BY: IN RE: COURTS - 52ND DISTRICT COURT - 1ST DIVISION TO: OAKLAND COUNTY BOARD OF COMMISSIONERS Mr, Chairman, Ladies and Gentlemen: Pursuant to Rule XI-C of this Board, the Finance Committee has reviewed Miscellaneous Resolution #7096 and concurs in the concept of decentralization of the 52nd District Court - 1st Division. Further, the Finance Committee finds the sum of $1,345 for operating costs for the balance of 1975 available in the contingent fund in the 1975 Oakland County Budget. $5,340 for start-up costs for the Milford Satellite Court was appropriated by Miscellaneous Resolution #7149„ FINANCE COMMITTEE Richard R. Wilcox, Chairman LEAS E : THIS MEMORANDUM WITNESSETH that the COUNTY OF OAKLAND, a Michigan Constitutional Corporation, lai.,T440tEffEagnated as the Lessor, does hereby let and lease to the VILLAqE OF MILFORD, hereinafter designated as the Lessee, the following premises in the Village of Milford, more particularly described as 1100 Atlantic, Milford, Michigan, for a period of One (1) year commencing from the date of this Agreement. The Lessee hereby leases said premises aforesaid and covenants: I. To pay to the Lessor the sum of One ($1..00) Dollar per year, such sum payable annually commencing with the date of this Agreement. .2. To use and occupy said premises only for the purpose of maintaining the 52nd District Court Division #1. 3. To observe all reasonable regulations and requirements of underwriters concerning the use and condition of the premises tend i ng to reduce fire hazards and insurance rates and not permit nor allow any rubbish, waste material or products to accumulate on the premises. 4. That he will not assign this Lease nor sublet the pre- mises nor any part thereof without the consent of the Lessor thereto endorsed hereon in writing. 5. To keep the premises, including the equip m ent and fixtures of every kind and nature, during the term in as good repair and at the expiration thereof yield and deliver up the same in like condition as when taken, except reasonable wear. 6. That in the event he shall hold over after the expiration of the term demised for a sufficient period of time to create a future right of possession not evidenced by an instrument in writing, executed and delivered by the Lessor, shall be tenancy from calendar month to calendar month and for no longer term. 7. Lessee agrees to provide Fire and Public Liability Insurance on the building and premises. 8. The Lessee is to install movable partAtions, the Quantity, type and size to be determined by mutual agreement between Lessor and Lessee. In the event the parties cannot mutually agree upon the aforementioned partitions, then the Oakland County Department of Facilities and Operations shall decide as to what type of movable partitions are acceptable. The Lessor covenants that the Lessee, on payment of the rental rate at the time and in the manner aforesaid in performing all of the foregoing covenants, shall and may peacefully and quietly have, hold and enjoy the demised premises for the term aforementioned. The Lessor further agrees to provide sufficient space for all operational and organizational requirements for the 52nd District Court. 1975. COUNTY OF OAKLAND, a Michigan . The Lessor agrees to furnish all utilities which in- clude but are not limited to the following: water, sewer, gas and further to provide all custodial and maintenance service. II. The Lessor agrees to maintain the premises in a condition suitable for occupancy and to make such repairs when necessary to assure suitability for occupancy. It is further agreed between the Lessor and Lessee that what- ever furnishings and equipment that are furnished by the Lessee will be the property of the Lessee at the termination of this Lease. It is further agreed that Lessee for the consideration of One ($1.00) Dollar shall have the option of leasing the afore- mentioned premises under the same term-; and conditions for the further term of Four (4) years providing same meets with the approval of the Oakland County Board of Commissioners. It is further agreed by and between the Lessor and Lessee that the maximum usage of the premises will not exceed Twenty (20) hours per week. It is further agreed between Lessor and Lessee that either party may terminate this lease with six (6) months notice by certified mail or registered mail. The covenants and conditions herein shall bind the heirs, representatives and assigns of the Lessor and the Lessee and if more than one join in the execution hereof as Lessor or Lessee or they or either of them be of the feminine sex, or a corpor- ation, such words and the pronouns and other relative words shall be read as if written in the plural, feminine and neuter respectively. h Signed, sealed and delivered this 15t day of July STATE OF MICHIGAN) )ss COUNTY OF OAKLAND) On this 15th day of July , 1975, personally appeared F..;.e..d.
