HomeMy WebLinkAboutResolutions - 1981.06.18 - 14765FINANCE COMMITTEE /1 APPROVE THE FOREOCANG RESOLUTION June 18, 1981 MISCELLANEOUS RESOLUTION 81220 BY: FINANCE COMMITTEE, DENNIS MURPHY, CHAIRPERSON IN RE: APPRAISAL FEES - MEIJER's PROPERTY/CITY OF ROYAL OAK TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the County of Oakland has been requested to participate in the cost of obtaining an appraisal to defend the 1978, 1979 and 1980 assesmorts on Meijer's property in the City of Royal Oak; and WHEREAS the County of Oakland has in the past participated with other local units of government before the Michigan Tax Tribunal; and WHEREAS in this case a decision has been reached and the City of Royal Oak was successful in their defense of all three years of the assessed value; and WHEREAS this portion of the County's tax base is secure due to their efforts; NOW THEREFORE BE IT RESOLVED that the County of Oakland does hereby agree to participate with the City of Royal Oak in the payment of appraiser fees and other costs exclusive of attorney fees in connection with the property tax appeal of the Meijer's property before the Michigan State Tax Tribunal. BE IT FURTHER RESOLVED that pursuant to Rule XI-C of this Board, the Finance Committee finds an amount not to exceed 7,6167% of the appraisal fee and expenses or an amount $407,49, the County share, available in the 1981 Contingency Account, BE IT FURTHER RESOLVED that the Board of Commissioners appropriates $4:7.-i from the 1981 Contingency Account and transfers said amount to the Equalization Division's 1981 Budget - Professional Services line-item as follows: 990-02-00-9990 Contingency $(407,49) 125-01-00-2128 Professional Services 407,49 -0- Mr. Chairperson, on behalf of of the Finance Committee, I move the adoption of the foregoing resolution, 18th day of / )June _ 1981 A CounEy Clerk/Register of Deeds #81220 June 18, 1981 Moved by Murphy supported by Lanni the resolution be adopted. Telegraph Road Pontiac, Michigan 48053 Att'n: Mr. Herman Stephens Director of Equalization Department Dear Herman: The City of Royal Oak appeared before the Michigan Tax Tribunal in regards to the 1978, 1979 and 1980 State Equalized Value of Meijers, Inc. located at 5150 Coolidge Hwy., Royal Oak, Michigan. One of the requirements of the appeal was a fee appraisal and court time for the appraiser which amounted to $5,350. . In our previous conversations it was my understanding that the county would contribute their percentage of the tax rate to such an expense. I have calculated same which is listed below: MEIJERS APPEAL 20-32-301-011 1978 Total Rate $69.86 County Rate $05.48 1979 Total Rate $69.51 County Rate $05.1449 1980 Total Rate $64.62 County Rate $04.9432 = 7.84% = 7.36% = 7.65% The average percentage of the county rate to our total tax rate for the three years is 7.6167%.
